Call the Meeting to Order and Establish a Quorum Mayor Cynthia Clinesmith Mayor Pro Tem Elsie Thurman Council Member Frank Hosea Council Member Jeff Jones Council Member Dwight King Council Member Elaine Waddill Mayor Clinesmith called the meeting to order at 3:00pm. All present. 2. Invocation - Father Ruben Patino from St. Paul the Apostle Catholic Church, gave the invocation. 3. Pledges to the Flags - Mayor Clinesmith led the pledges of allegiance to the United States flag and the Texas flag. 4. Proclamations A. Proclamation Declaring the week of September 24-30, 2023 as "Source Water Protection Week" – Mayor Clinesmith read aloud the proclamation. B. Proclamation Declaring the week of October 8-14, 2023 as "Fire Prevention Week" - Mayor Clinesmith read aloud the proclamation. 5. Announcements and Staff Recognition A. Applications being accepted for City Boards, Commissions, and Committees for appointments to be made in Dec 2023 - Deadline to apply is Nov 1, 2023 - Legislative Services Director Kerri Craig announced the upcoming application period and available positions. B. New City Team Member: Alex Ocasio (Code Compliance Officer) – Code Enforcement Supervisor Ray Garcia welcomed Mr. Ocasio to the team. 6. Public Comment – No one spoke. 7. Adoption of the Fiscal Year 2024 Budget A. Ordinance 2023-38: Adopting a Budget for the Fiscal Year Beginning 10-1-2023 and Ending 9-30-2024 in Accordance with the Laws of the State of Texas, Appropriating the Various Amounts Thereof, and Repealing All Ordinances in Conflict Therewith – Finance Director Chris Thomas provided a report, which is on file. Council Member King motioned to approve Ordinance 2023-38 which will adopt the budget beginning 10-1-2023 and ending 9-30-2024. Council Member Waddill seconded. ROLL CALL VOTE: Mayor Pro Tem Thurman – Aye, Council Member Hosea – Aye, Council Member Jones – Aye, Council Member King – Aye, Council Member Waddill - Aye. VOTE: 5-0 in favor, motion passed. 1 8. Public Hearing Items Public Hearing and possible action regarding: A. Public Hearing Regarding the Proposed 2023 (Fiscal Year 2024) Ad Valorem Tax Rate – Finance Director Thomas provided a report, which is on file. Mayor Clinesmith opened the public hearing at 3:15pm. No one spoke. Mayor Clinesmith closed the public hearing at 3:18pm. No action taken. 9. Business Discuss, Consider, and Possibly Take Action Regarding: A. Ordinance 2023-39: Levying Ad Valorem Taxes for the Use and Support of the Municipal Government of the City of Horseshoe Bay, Texas, and Providing for the Interest and Sinking Fund for the Fiscal Year 2023-2024; Directing the Collection Thereof; and Providing for the Time of Paying the Ad Valorem Taxes Levied and Providing that Taxes Become Delinquent If Not Paid – Finance Director Thomas provided a report, which is on file. Council Member Hosea motioned to approve Ordinance 2023-39 and that the property tax rate be increased by the adoption of a tax rate of $0.26775/$100 comprised of an M&O rate of $0.20101/$100 and an I&S rate of $0.06674/$100, which is effectively a 10.66 percent increase in the tax rate. Council Member Jones seconded. ROLL CALL VOTE: Mayor Pro Tem Thurman – Aye, Council Member Hosea – Aye, Council Member Jones – Aye, Council Member King – Aye, Council Member Waddill - Aye. VOTE: 5-0 in favor, motion passed. B. Ratify the Property Tax Revenue Increase Reflected in the Adopted Annual Budget for Fiscal Year 2024 – Finance Director Thomas provided a report, which is on file. Council Member Jones motioned to ratify the property tax increase reflected in the adopted annual budget for Fiscal Year 2023-2024. Mayor Pro Tem Thurman seconded. VOTE: 5-0 in favor, motion passed. C. Request for an Eighth Building Permit Extension for the Property Located at 100 Lighthouse Drive, Randy Cate, Applicant – Mayor Clinesmith stated this item will not be considered because the applicant withdrew their request. No action taken. D. Ordinance 2023-40: Amending Appendix A Fee Schedule of the City of Horseshoe Bay’s Code of Ordinances, Articles A8.01 Water Service Rates, A8.02 Sewer Service Rates and Conditions, and A8.04 Garbage Collection Rates; Making Other Provisions Related and Incidental Thereto, Providing for Findings of Fact, Repealer, Severability, Effective Date, and Proper Notice and Meeting – City Manager Jeff Koska provided a report, which is on file. Mayor Pro Tem Thurman motioned to approve Ordinance 2023-40 as presented. Council Member Jones seconded. VOTE: 5-0 in favor, motion passed. E. Resolution 2023-15: Nominating Individuals for the Burnet Central Appraisal District Board of Directors for the Years 2024-2025 – Legislative Services Director Kerri Craig provided a report, which is on file. Council Member King motioned to nominate Gene Broadway, Cary Johnson, Bruce Jones, Phillip Thurman, and Darlene Oostermeyer for the Board of Directors of the Burnet Central Appraisal District for the years 2024-2025. Council Member Waddill seconded. VOTE: 5-0 in favor, motion passed. 10. Consent Agenda All consent items are considered to be routine and will be enacted by one motion and vote. A.
