I. Call to Order
Chairman Drew called to order the regularly scheduled meeting of the Board of Zoning & Building Appeals at 7:30
p.m., in accordance with the Sunshine Laws of the State of Ohio, O.R.C. Section 121.22.
II. Roll Call
Present: 5 - Ms. Bronstein, Mr. Dohner, Mr. Drew, Ms. Keller and Mr. Wagner
III. Identification, by Chairman, of Amanda Davey, Associate Planner & Greg Hannan,
Director of Community Development
IV. Swearing in of Staff and Audience Addressing the Board.
Mr. Drew swore-in staff and all the persons wishing to speak under oath.
V. Approval of Minutes

A motion was made by Ms. Bronstein, seconded by Ms. Keller, that the May 20, 2021,
Minutes be approved as submitted. The motion carried by an unanimous vote.
VI. Public Hearings - New Business
BZBA 2021-619 A request for a variance of (4) feet from the required five (5) foot
perimeter landscaping requirement resulting in a one (1) foot
landscaped perimeter in order to construct a parking lot pursuant
to Section 1207.04(l)(3), “Perimeter landscaping for parking lots”
of the City of Hudson Land Development Code.

The applicant is Jeff Gibbon - Gibbon Architecture, 3012 Chadbourne Road,
Shaker Heights, OH, 44120. The property owner is L7 Properties LLC, 44
Clinton Street, Hudson, OH, 44236 for the property at 48 Clinton Street in District
5 [Village Core District].

Ms. Davey introduced the application by reviewing the property, proposed work and purpose of the structure .
Ms. Davey also noted the application was approved on June 18, 2020; however, the BZBA decision expired after
one-year since a zoning certificate was not issued. The applicant has subsequently made minor changes to the
design and layout which were displayed and described by Ms. Davey, thereby requiring less of a setback.
Mr. Jeff Gibbon, Gibbon Architecture, was present for the meeting and explained the reasons for the minor
changes to the design as well as noting the building footprint and design have remained the same. Mr. Gibbon
also explained the parking lot will be shared with a neighboring property.
The Board, staff and Mr. Gibbon discussed the use of on-street parking, Mr. Hannan noted the applicant has met
the requirements for parking and Mr. Gibbon was agreed to comply with the previous Board conditions of the
variance.
Ms. Bronstein made a motion, seconded by Ms. Keller, based on the evidence presented to the Board, reviewing
all documentary submissions of interested parties and by taking into consideration the personal knowledge of
the property in question, the Board of Zoning and Building Appeals hereby grants the following variance with
the two conditions:
A request for a variance of (4) feet from the required five (5) foot perimeter landscaping requirement
resulting in a one (1) foot landscaped perimeter in order to construct a parking lot pursuant to Section
1207.04(l)(3), “Perimeter landscaping for parking lots” of the City of Hudson Land Development Code.
1. The owner to consult with the library, owner of the adjacent property to the south, to discuss possible
additional buffering and landscaping on the east.
2. The applicant shall plant additional, low-level landscaping on the west side of the property and such
landscaping to be discussed and agreed to by the City Arborist.
The Board finds and concludes:
1. The property in question will not yield a reasonable return and there cannot be a beneficial use of the
property without the variances. The required landscape buffer would impact the parking lot design, the
building design, and the surrounding parking needs.
2. The variance is substantial; however, it is necessary to meet the parking needs for the new building.
3. The essential character of the neighborhood would not be substantially altered, and adjoining properties
would not suffer a substantial detriment as a result of the variances because the property owner has stated
that they have a good relationship with the neighbor and will work with them on a sufficient landscaping
plan.
4. The variance would not adversely affect the delivery of governmental services, (e.g. water, sewer, garbage).

5. The applicant purchased the property with knowledge of the zoning requirements.
6. The applicant's predicament feasibly cannot be resolved through some other method other than granting
the variance.
7. The spirit and intent behind the zoning requirement would be observed and substantial justice would be
done by granting the variance because the parking needs would be able to be fully met on the property.
The motion was approved by the following vote:
Aye: 5 - Ms. Bronstein, Mr. Dohner, Mr. Drew, Ms. Keller and Mr. Wagner
VII. Other Business
Ms. Davey discussed the potential two applications for the July meeting.
VIII. Adjournment
A motion was made by Mr. Dohner, seconded by Mr. Wagner, that the meeting be
adjourned. The motion carried by an unanimous vote.
