Call to Order Mayor Anzevino called to order the meeting of Hudson City Council at 6:30 p.m., in accordance with the Sunshine Laws of the State of Ohio, O.R.C. Section 121.22. Present: 7 - Mr. Banweg, Dr. Bird, Mr. Foster, Dr. Goetz, Mrs. Heater, Mrs. Kowalski and Mr. Sutton 2. Executive Session A motion was made by Mr. Foster, seconded by Mrs. Heater, to enter into executive session for the purpose of interviewing applicants to Park Board. Invited to executive session were all members of Council, the Mayor, and the applicants. The motion carried by the following roll call vote: Aye: 7 - Mr. Banweg, Dr. Bird, Mr. Foster, Dr. Goetz, Mrs. Heater, Mrs. Kowalski and Mr. Sutton Mayor Anzevino recessed the meeting into executive session at 6:30 p .m., and reconvened the regular meeting at 7:30 p.m. 3. Approval of the Minutes A. 24-0011 Minutes of Previous Council Meetings Brief Description: Draft minutes of previous meetings are provided for City Council’s review and approval. Proclamations A. 24-0012 Special Recognition of Random Acts of Kindness Week Brief Description: This Proclamation encourages citizens to perform acts of kindness, especially during February 11-17, 2024, as we celebrate Random Acts of Kindness Week. Representatives from the Hudson League for Service will accept the Proclamation. Attachments: Random Acts of Kindness 2024 Mrs. Barbara Bos, representing the Hudson League for Service, and BSA #7327 accepted the Proclamation . Mayor Anzevino read the Proclamation in its entirety. 7. Public Hearings A. 23-154 AN ORDINANCE AMENDING CHAPTERS 1205 “ZONING DISTRICTS-CITY OF HUDSON MAP” AND 1206 “USE REGULATIONS” OF THE LAND DEVELOPMENT CODE RELATIVE TO THE REGULATION OF VAPE SHOPS, PAWN SHOPS, TATTOO PARLORS, AND MARIJUANA DISPENSARIES. Brief Description: Proposed Land Development Code text amendment relative to the regulation of Vape Shops, Pawn Shops, Tattoo Parlors, and Marijuana Dispensaries. B. 23-155 AN ORDINANCE AMENDING CHAPTER 1206 “USE REGULATIONS” OF THE LAND DEVELOPMENT CODE RELATIVE TO THE REGULATION OF TEMPORARY USES - CONTRACTORS OFFICE/TEMPORARY CONSTRUCTION USES. Brief Description: Proposed Land Development Code text amendment relative to the regulation of temporary contractor offices and temporary construction sites. Attachments: City Council memo temp use regulations 10.13.23 Ordinance No. 23-155 Public Hearing Notice: Ordinance No. 23-155 Signed PC Decision Ordinance No. 23-155 (as recommended by Planning Commission for 2-6-24) Mayor Anzevino opened the public hearing at 7:37 p.m. Mr. Steve Snyder, 7216 Hayward Rd., stated that he was glad to see some progress with the language and suggested that Council should be the only body to approve temporary use permits . Mr. Foster submitted a letter into the record from The Beaver Excavating Company regarding Ordinance No . 23-155. A copy of the letter is on file in the Clerk of Council's office. There being no additional speakers, Mayor Anzevino closed the public hearing at 7:41 p .m. A public hearing was held for Ordinance No. 23-155. 8. Public Comments Mr. Ron Brubaker, 7593 Partridge Meadows Dr. East, stated that since there is interest in a recreation center, it would be financially and logistically sensible for the City to purchase LifeCenter Plus . 9. Correspondence and Council Comments Mr. Sutton thanked everyone for participating in the Comprehensive Plan Open House that took place on January 31st. The Commission has not met since then but will review the comments. He also provided a Tree Commission update and briefly mentioned Beech Leaf Disease . Further, Mr. Sutton noted that he has a conflict of interest on Resolution No. 24-11 and would abstain from voting on that piece of legislation. City of Hudson, Ohio Page 3 City Council Meeting Minutes - Final February 6, 2024 Dr. Goetz thanked staff for the orientation meetings and also thanked Mr. Sheridan and Mr. Hannan for speaking with a resident concerned about light poles at Western Reserve Academy . Mrs. Kowalski stated that the Environmental Awareness Committee will update their goals followings its presentation to Council. Mr. Foster mentioned the Planning Commission public hearing signs at the YDC . He reminded residents that the north part of YDC is managed by Summit County Metroparks, with the hopes to turn that area into a park with access from Hines Hill Road to Maple Grove. Mr. Banweg thanked staff for all the work they did for the Council retreat . Mayor Anzevino stated that he is working with staff for the City's 225th Anniversary, listed a number of scheduled meetings he will be attending or attended, and has a follow up meeting at Kent State University to continue to discuss a city flag design. 10. Report of Manager Mr. Sheridan thanked the Mayor and Council for attending the Council retreat, and also thanked those who participated in the Comprehensive Plan Open House last week . Mr. Sheridan further stated that City offices will be closed on February 19th in observance of Presidents' Day and that the State of the City Address will be February 22nd at the Hudson Country Club . 11. Appointments No appointments were made, however, Mr. Foster reminded residents that there were still openings on the Community Television Advisory Committee. 12. Suspension of the Rules for the Consent Agenda A motion was made by Mr. Foster, seconded by Mrs. Heater, to suspend the rule requiring three readings. The motion carried by the following vote: Aye: 7 - Mr. Foster, Dr. Goetz, Mrs. Heater, Mrs. Kowalski, Mr. Sutton, Mr. Banweg and Dr. Bird Approval of the Consent Agenda A motion was made by Mr. Foster, seconded by Mrs. Heater, to approve the Consent Agenda.The motion carried by the following vote: Aye: 7 - Dr. Goetz, Mrs. Heater, Mrs. Kowalski, Mr. Sutton, Mr. Banweg, Dr. Bird and Mr. Foster B. 24-12 A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION TO AND ENTER INTO AN AGREEMENT WITH THE NORTHEAST OHIO REGIONAL SEWER DISTRICT (NEORSD) FOR FUNDING ASSISTANCE THROUGH THE NEORSD COMMUNITY COST SHARE PROGRAM FOR DESIGN OF THE RAVENNA STREET STORMWATER MANAGEMENT IMPROVEMENTS. City of Hudson, Ohio Page 4 City Council Meeting Minutes - Final February 6, 2024 Brief Description: The Northeast Ohio Regional Sewer District’s (NEORSD) Community Cost Share Program provides funding to member communities, like the City of Hudson, for community specific stormwater management projects. These funds would be used to reimburse the City for the Engineering costs associated with the Ravenna Street Stormwater Management Improvements Project. The project will reduce flooding to Ravenna Street residences and being upstream of the Barlow Community Center Dams, it will increase the benefit to the Downtown properties. C. 24-13 A RESOLUTION APPROVING THE CITY OF HUDSON’S WITHDRAWAL FROM THE SUMMIT COUNTY INTERGOVERNMENTAL MEMORANDUM OF UNDERSTANDING FOR JOB CREATION AND RETENTION AND TAX REVENUE SHARING Brief Description: This Resolution formally withdraws the City of Hudson from the County agreement. Attachments: Resolution No. 24-13 Resolution No. 24-13 was approved on the Consent Agenda. D. 24-14 A RESOLUTION TO APPROVE THEN AND NOW CERTIFICATES FOR PURCHASES MADE; AND DECLARING AN EMERGENCY. Brief Description: Council authorization is required for payment of the invoices shown on this Resolution, each in excess of $3,000, for which commitments were made before Purchase Orders were generated. Removed from the Consent Agenda A. 24-11 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES CONTRACT WITH OSBORN ENGINEERING FOR THE DESIGN OF THE RAVENNA STREET STORMWATER MANAGEMENT IMPROVEMENTS. Brief Description: The purpose of this request for proposal (RFP) was to solicit proposals from professional design, engineering and surveying consultants (Consultant) for the analysis, engineering, and design of the Ravenna Street Stormwater Management Improvements. The project will include the review, analysis of the existing pond volumes and discharges in order to maximize storage in a new regional storm water pond and reduce City of Hudson, Ohio Page 5 City Council Meeting Minutes - Final February 6, 2024 overland flooding to downstream properties along Ravenna Street. In addition to the project reducing flooding to properties on Ravenna Street, the site is located upstream of the Barlow Community Center Dams which will help with flood control for downtown properties. D. 24-9 AN ORDINANCE AMENDING CHAPTER 848 ENTITLED “REFUSE HAULERS” OF THE CODIFIED ORDINANCES TO INCLUDE ADDITIONAL QUARTERLY REPORTS REQUIREMENTS Brief Description: This amendment would add an additional requirement to quarterly reports submitted to the Public Works Department by licensed residential trash haulers operating within the city.
