121 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 24, 2021 The City Council of the City of Hueytown met on Tuesday, August 24, 2021 in the Council meeting room at 5: 30P.M. at City Hall. The meeting was called to order with Council President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks present. Mayor Ware was present and the City Attorney, Charlie Waldrep of Waldrep Stewart &, Kendrick, LLC. was present during the Pre -Council meeting. The purpose of the meeting was to discuss general municipal business and review the City Council agenda. MINUTES OF CITY COUNCIL CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 24, 2021 A regular meeting of City Council of the City of Hueytown, Alabama was held in the Council Chamber of Hueytown City Hall on Tuesday, August 24, 2021. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 06P. M. with approximately Seven people in the audience. The invocation was given by Council Member Jacks, followed by the Pledge of Allegiance. Upon roll call, with Council Members Pickens, Zinnerman, Hurliman, Wright and Jacks were present. Council President Pickens presided over the meeting. Mayor Ware was present and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLC. was present. Kailah Hegler was present from the Western Star. 2. APPROVAL OF MINUTES Council member Zinnerman moved, seconded by Council member Jacks, that the minutes of the Pre -Council and the Regular Council Meetings held Tuesday, August 10, 2021 and the Work Session Meeting of August 16, 2021 be approved as previously received and thereby dispensing with reading of the minutes. Upon roll call, President Pickens, and Council members Zinnerman, Hurliman, President Pickens Wright and Jacks voted yes. There were no nay votes. declared the minutes approved. A Motion by Council Member Jacks to add item 17b Resolution Number 6080 and to remove item 17 Resolution Number 6079 was made with a second by Council Member Hurliman. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 3. MAYOR' S REPORT The Mayor welcomed everyone present and was glad of their attendance to take time out of their schedule to listen to what's happening in the City. The Mayor reports the paving project continues with the recent weather events slowing The Mayor was pleased to report the Hueytown " Gophers" Football progress. Hegler Team looked good! The Mayor presented a Proclamation to Kailah recognizing the Hueytown Sports Programs. 4. STANDING COMMITTEE REPORTS Finance Committee: Council Member Jacks announced the Finance a) Committee is working on the City' s fiscal year 2022 budget and extends a thank you to Police Chief Mike Yarbrough and Public Works Director Mike Page 1 of 5 122 Butts for the presentations they gave regarding their respective Departments. b) Planning and Development: No Report c) Public Safety: No Report d) Public Works and Parks: Council Member Wright thanks with gratitude, the Public Works Department on behalf of Ms. Gains for cutting grass. 5. OFFICERS REPORTS a) Police Chief Mike Yarbrough: Chief Yarbrough reports the school traffic continues to improve. Chief Yarbrough informed everyone of fielding complaints from various neighborhoods on speeders. If anyone has a_ complaint to come to the Council Meeting or come to City Hall and not use Social Media. b) Fire Chief Morris: No Report. c) Public Works Director Mike Butts: No Report. d) Building and Zoning Inspector Barry Humphries: Absent 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) Debbie Kiker, Acting Director for the Hueytown Chamber of Commerce, reports the following: A) Announced the Pre -sell begins today for the Hueytown Chamber Keepsake Cookbooks. The Chamber expects to have the books in- house the week of September 20, 2021. There are over 400 recipes with the hardback cover for a cost of $ 20. 00. B) Announced the Jr. Ambassador Program is being re -branded as the Jr. Leadership Team. The program anticipates Team members attending a Council Meeting and then meet with the Council briefly after a Council Meeting. The team members would also meet with the Police and Fire Departments and be involved with the Schools. C) Announced the Paw Palooza and Wiener Dog Races will be Saturday, September 11, 2021 at the Stadium Park from 9: OOA. M. to 1: OOP. M.. The event is sponsored by the Hueytown Veterinary Clinic and Pet Lodge. D) Announced 20- 24, the Hueytown High School Homecoming Week is September 2021 with a Parade and Bonfire. Also Paint the Town Purple Contest. Be on the lookout for additional information. E) Announced the Hueytown Area Chamber of Commerce 2021 Awards Dinner on Friday, October 1, 2021 at Venue 3131. There is limited seating and includes a Dinner and participation in a Silent Auction. F) Announced the Chamber Fall Fest is in the works with the date of Saturday, October 30, 2021. G) Announced a reminder of the Hueytown Harvest Farmers Market continues every Saturday from 8: OOA. M. to Noon at the Stadium Park. H) Announced the Fast Pitch Softball Registration ends August 27, 2021. I) Remember to Shop Local! 7. CORRESPONDENCE: Acknowledged receipt of a Thank You letter addressed to the Mayor and Council from the Hueytown Arts Council. 8. BILLS FOR APPROVAL: Council member Jacks then moved, seconded by Council member Wright, that the List of Bills be approved in the total amount of $ 589, 154. 36. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. RESOLUTION 6075: Resolution 6075 was presented to consider acknowledgment of receiving funds from State Representative Merika Coleman. RESOLUTION NO. 6075 ACKNOWLEDGE RECEIPT OF FUNDS FROM STATE REPRESENTATIVE MERIKA COLEMAN FOR THE BENEFIT OF MLK PARK AND THE YOUTH FOOTBALL PROGRAM Council member Jacks moved, seconded by Council member Wright, to adopt Resolution 6075. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 10. Resolution 6076: Resolution 6076 was presented to consider the continuation of the Transportation plan pursuant to the Rebuild Alabama Act. RESOLUTION NO. 6076 CONTINUING THE TRANSPORTATION PLAN PURSUANT TO THE REBUILD ALABAMA ACT Council member Jacks moved, seconded to by Council member Zinnerman, adopt Resolution 6076. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. Resolution 6077: Resolution 6077 was presented for the consideration to comply with Alabama Act 2011- 676. RESOLUTION NO. 6077 COMPLIANCE TO ALABAMA ACT 2011- 676 Council member Hurliman seconded by Council member Wright, to moved, adopt Resolution 6077. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. Resolution 6078: Resolution 6078 was presented to declare certain properties to have conditions which create a Public Nuisance and order their abatement. RESOLUTION NO. 6078 TO DECLARE PUBLIC NUISANCE AND ORDER ABATEMENT AUTHORIZE PUBLIC HEARING/ WEED ABATEMENT) Council member Wright moved, seconded by Council member Zinnerman, to adopt Resolution 6078. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were - no nay votes. The motion unanimously carried. 13. Ordinance 21- 0810- 1: Ordinance 21- 0810- 1 was introduced to consider amending the City' s Code of Ordinances Article II Chapter 18 Licensing. ORDINANCE NO. 21- 0810- 1 AN ORDINANCE TO SUPPLEMENT AND AMEND THE CODE OF ORDINANCES OF THE CITY OF HUEYTOWN- ARTICLE II- CHAPTER 18 ( LICENSING) Council member Hurliman moved to adopt Ordinance 21- 0810- 1 with a second to the motion by Council member Wright. Upon roll call, President Pickens and Wright and Jacks voting yes. Ordinance 21- 0810- 2: Ordinance 21- 0810- 2 was introduced to consider amending the City' s Code of Ordinances Article I of Chapter 82 Solid Waste. ORDINANCE NO. 21- 0810- 2 AN ORDINANCE TO SUPPLEMENT AND AMEND THE CODE OF ORDINANCES OF THE CITY OF HUEYTOWN- ARTICLE I- CHAPTER 82 ( SOLID WASTE) Council member Zinnerman moved, seconded by Council member Wright, to adopt Ordinance 21- 0810- 2. Upon roll call, President Pickens and Council + members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried with President Pickens declaring the Ordinance adopted. 15. Ordinance 21- 0824- 1: Ordinance 21- 0824- 1 was introduced for a First Reading/ Public Hearing to consider the annexation of property located at 4961 15r' Street Road, Hueytown into the City. ORDINANCE NO. 21- 0824- 1 AN ORDINANCE TO ANNEX CERTAIN REAL PROPERTY 4961 15TH STREET ROAD, HUEYTOWN, ALABAMA WHICH IS CONTIGUOUS TO THE CITY OF HUEYTOWN, ALABAMA Upon no one coming present to discuss Ordinance 21- 0824- 1, Council member Hurliman moved, seconded by Council member Wright, to Close the Public Hearing. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried with President Pickens closing the Public Hearing. 16. Ordinance 21- 0824- 2: Ordinance 21- 0824- 2 was introduced for a First Reading/ Public Hearing to consider amending Section 18- 41 of Chapter 18 of the City Code. ORDINANCE NO. 21- 0824- 2 AN ORDINANCE TO AMEND SECTION 18- 41 ENTITLED " LICENSE SCHEDULE" OF ARTICLE III ENTITLED " LICENSE SCHEDULE" OF CHAPTER 18 ENTITLED " BUSINESSES AND BUSINESS REGULATIONS" OF THE CODE OF ORDINANCES OF THE CITY OF HUEYTOWN, ALABAMA, AND TO PROVIDE FOR THE EFFECTIVE DATE THEREOF. Upon no one coming present to discuss Ordinance 21- 0824- 2, Council member Zinnerman moved, seconded by Council member Wright, to Close the Public Hearing. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried with President Pickens closing the Public Hearing. 17. Resolution 6079: Resolution 6079 was removed from the meeting agenda. 17B. Resolution 6080: Resolution 6080 was introduced to consider to proceed with the Public Nuisance abatement of a structure located at 3046 Allison Bonnett Memorial Parkway. RESOLUTION NO. 6080 A RESOLUTION TO PROCEED WITH ABATEMENT OF UNSAFE BUILDING OR STRUCTURE Council member Jacks moved, seconded by Council member Wright, to adopt Resolution 6080 with the end date of November 30, 2021 for the property owner to abate the Public Nuisance. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 18. EXTEND FLOOR TO THE PUBLIC Page 4 of 5  125 Prior to extension of the floor to the public, President Pickens reminded that anyone wishing to address the Council should state their name and address; must be a resident of Hueytown to speak and should limit comments to three minutes. A) Sharon Syx at 3805 Sharon Circle spoke about receiving a Proclamation the past seven years to affirm the City's support for Ovarian Cancer. Ms. Syx reminds everyone of September is Ovarian Cancer Awareness Month. 19. ADJOURNMENT There being no further business to come before the meeting, and upon the motion of Council member Zinnerman which unanimously carried, the meeting was adjourned at 6: 39P. M.
