MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JANUARY 25, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, January 25, 2022. The meeting was called to order with Council President Pickens and Council members Zinnerman, Hurliman, and Jacks present. Council Member Wright was absent. Mayor Ware was present during the Pre -Council meeting and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP. was present. There were five individuals in the audience. Kailah Hegler was also present from the Western Star. The purpose of the meeting was to discuss general municipal business and review the City Council agenda. MINUTES OF CITY COUNCIL CITY OF HUEYTOWN, ALABAMA TUESDAY, JANUARY 25, 2022 A regular meeting of City Council of the City of Hueytown, Alabama was held in the Council Chamber of Hueytown City Hall on Tuesday, January 25, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 24P. M. with approximately seven people in the audience. The invocation was given by Council member Pickens, followed by the Pledge of Allegiance. Upon roll call, with Council members Zinnerman, Pickens, Hurliman, and Jacks _ were present. Council Member Wright was absent. Council President Pickens presided over the meeting. Mayor Ware and the City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP. were present. Kailah Hegler was also present from the Western Star. 2. APPROVAL OF MINUTES Council member Zinnerman moved, seconded by Council member Hurliman, that the minutes of the Pre -Council and the Regular Council Meeting held Tuesday, January 11, 2022 and the work session held on January 13, 2022 be approved as previously received and thereby dispensing with reading of the minutes. Upon roll call, President Pickens, and Council members Zinnerman, Hurliman, and Jacks voted yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYOR' S REPORT The Mayor welcomed everyone present even though the numbers are light due to the current wave of the COVID- 19 Pandemic. The Mayor missed everyone by not attending the last meeting and appreciates everyone for what they do for the City. The Mayor informed everyone of the limited Department Heads attendance due to the increased COVID infections. 4. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development: Council Member Jacks, no report. c) Public Safety: Council Member Wright, absent. d) Public Works and Parks: Council Member Hurliman, reports of attending the Park 8s Recreation Board meeting last week and is impressed with the board meeting and the planning that is being done. OFFICERS REPORTS a) Police Chief Mike Yarbrough: Absent. b) Fire Chief Morris: No Report. c) Public Works Director Mike Butts: Absent. d) Building and Zoning Inspector Barry Humphreys: Inspector Humphries informed the Mayor and Council he will be providing information on items under consideration later in the meeting. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) Debbie Kiker, Director for the Hueytown Chamber of Commerce, reports the following: A) The Chamber had planning meeting earlier this month for the 2022 calendar year: 1. Start the Munch and Mingle in February. 2. Business of the Month. 3. Cash Mob coming soon. 4. Easter Egg Drop with the Hueytown Fire Department will be April 16, 2022 at the Stadium Park. 5. 2021 Awards Dinner which was canceled last year due to the COVID- 19 Pandemic is rescheduled for April 29, 2022 6. Mayor' s Community Breakfast, May 5, 2022 7. Cancer Awareness Day, October 15, 2022 B) The Chamber member Business of the Month of January is T and C Donuts. C) Munch and Mingle is scheduled for February 10, 2022 at Venue 3131. D) The Chamber Scholarship Program has a goal set for $ 3, 000. 00 this year with a great start of 38 donors participating in the program. Hueytown McDonald' s has donated $ 1, 000. 00 and fees from the Christmas Parade Participants donating $ 400. 00. E) Upcoming Hueytown Arts Council Events. 1. Art Show is scheduled for March 3, 2022 2. Worship Fest is scheduled in April 2022. 3. City Fest is set for June 11, 2022. F) Hueytown Harvest Farmers Market begins March 5, 2022 G) Shop Local! A motion by Council Member Hurliman to add Resolution Numbers 6133 as item number 14 to the meeting agenda with a second from Council Member Zinnerman. Upon roll call, President Pickens and Council members Zinnerman, Hurliman, and Jacks voting yes. There were no nay votes. The motion unanimously carried. 7. CORRESPONDENCE: There was no correspondence to report. 8. BILLS FOR APPROVAL: Council member Zinnerman then moved, seconded by Council member Jacks, that the List of Bills be approved in the total amount of $ 689, 409. 10. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. Resolution 6129: Resolution 6129 was presented to consider authorizing Page 2 of 4 182 the Mayor to execute a contract with the Regional Planning Commission of Greater Birmingham for the Council Redistricting. RESOLUTION NO. 6129 CONTRACT FOR COUNCIL DISTRICT REDISTRICTING WITH REGIONAL PLANNING COMMISSION OF GREATER BIRMINGHAM Council member Zinnerman moved, seconded by Council member Hurliman to adopt Resolution 6129. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 10. Resolution 6130: Resolution 6130 was presented to consider authorizing the Mayor to execute the City of Hueytown Storm Water Management Program Plan for the 2022 Year for the City to obtain the MS4 Permit from the Alabama Department of Environmental Management. RESOLUTION NO. 6130 AUTHORIZE THE MAYOR TO EXECUTE THE CITY OF HUEYTOWN STORM WATER MANAGEMENT PROGRAM PLAN FOR THE 2022 YEAR Inspector Humphries provided information to the Mayor and Council of the City' s Storm Water program and upon completion of the presentation, Council member Hurliman moved, seconded by Council member Zinnerman to adopt Resolution 6130. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. Resolution 6131: Resolution 6131 was presented to consider the declaration of a Public Nuisance and to authorize a Public Hearing to Order it' s abatement for the location of 1000 Old Warrior River Road, Hueytown, Alabama. RESOLUTION NO. 6131 TO DECLARE PUBLIC NUISANCE AND ORDER ABATEMENT AUTHORIZE PUBLIC HEARING/ HOUSING ABATEMENT) Council member Jacks moved, seconded by Council member Hurliman to adopt Resolution 6131. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. Resolution 6132: Resolution 6132 was presented to consider amending the fiscal year 2022 budget and the authorization to execute a loan agreement with United Bank for the financing of the recent purchase of six Police Department Patrol Vehicles. RESOLUTION NO. 6132 A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF HUEYTOWN AMENDING THE FY 2022 BUDGET AND AUTHORIZING THE EXECUTION OF LOAN AGREEMENT WITH UNITED BANK FOR THE ACQUISITION, PURCHASE AND FINANCING OF SIX POLICE DEPARTMENT PATROL VEHICLES AND ASSOCIATED EQUIPMENT. Council member Hurliman moved, seconded by Council member Jacks to adopt Resolution 6132. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 13. Ordinance 22- 0125- 01: Ordinance 22- 0125- 01 was presented as a First Reading/ Public Comment to consider amending the City Code Section 94 to Regulate Engine Compression Brakes, " Jake Brake". ORDINANCE NO. 22- 0125- 01 Page 3 of 4  AMEND CITY OF HUEYTOWN, ALABAMA CODE SECTION 94 TO REGULATE ENGINE COMPRESSION BRAKES " JAKE BRAKE" Discussion by the Council to change the fine to $ 500. 00 and up to six months in Jail as permitted by law. There was no one else present who spoke either for or against the proposed Ordinance. A motion by Zinnerman to close the Public Comment with a second to the motion by Council Member Hurliman and when upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 14. Resolution 6133: Resolution 6133 was presented to consider amending the City's Employee Handbook Paid Sick Leave Benefit. RESOLUTION NO. 6133 AMENDING CITY OF HUEYTOWN EMPLOYEE HANDBOOK PAID SICK LEAVE BENEFIT After lengthy discussion by the Council, Mayor and the City attorney, Council member Zinnerman moved, seconded by Council member Jacks to adopt Resolution 6133 with a maximum of five days for the calendar year 2022. Upon roll call, President Pickens and Council members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. EXTEND FLOOR TO THE PUBLIC: Prior to extension of the floor to the public, President Pickens reminded that anyone wishing to address the Council should state their name and address; must be a resident of Hueytown to speak and should limit comments to three minutes. A) Joe Stroud at 6530 Letson Lake Road spoke of his service in the United States Military and all those that have died serving this Country. Mr. Stroud asked the Mayor and Council to consider installing something to honor all six branches of the Military in the new park area at the Storm Shelter site. Mr. Stroud presented to the Mayor and Council a design he suggests for the City's consideration. 16. ADJOURNMENT: There being no further business to come before the meeting Council Member Jacks made a motion to adjourn, Council President Pickens declared the meeting adjourned at 6: 59P. M.
