422 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 21, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, March 21, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. Mayor Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were present at the meeting. There were six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 21, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, March 21, 2023. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Council President Wright at 6: 01P. M. with approximately fifteen individuals in the audience. The invocation was given by Council Member Hurliman followed by the Pledge of Allegiance. Upon Roll Call, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks were present. City attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Jacks to approve the March 14, 2023 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 3. MAYORS REPORT The Mayor had nothing to report but welcomes everyone present by taking time out of their busy schedule to attend the Council Meeting to learn whats happening in the City. 4. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report as the Planning and Zoning Commission was meeting in the Annex at the same time as the Council Meeting. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, reports the ball field light fixtures have been repaired, Spinners have been ordered and base material installed to address some " ADA" issues with thanks to the City for the appropriation of funds to make all this possible. Council Member Jacks read a letter from Zane Allen who is a youth baseball player March 21, 2023 City Council Meeting Minutes Page 1 Of 5  423 who thanks the Mayor and City Council for making the ball field light repairs possible. 5. OFFICERS REPORT a) Police Department: Chief Yarbrough - thanks the Mayor and Council for the recent authorization to purchase six Police Patrol vehicles. b) Fire Department: Chief Sullivan - thanks the Mayor and Council for the recent authorization to purchase two administrative vehicles. c) Public Works/ Street and Parks Department: Director Butts - thanks the Mayor and Council for the recent authorization to purchase two vehicles. Director Butts also announced the date for the upcoming City Wide Cleanup event scheduled for April 15, 2023. d) Building and Zoning Department: Inspector Humphries - absent, attending the Planning and Zoning meeting being held in the Annex. 6. GREAT THINGS HAPPENING IN HUEYTOWN a) Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports: i. The Chamber Scholarship Application Forms are now available on the Chamber' s website. The application submission deadline is April 3, 2023 with the Scholarship Reception scheduled for April 18, 2023. ii. Participation with The Hometown Hero Pole Banners program has been extended to Friday, March 24, 2023. Currently there have been seventeen banners sold to date. iii. The Easter Egg Drop is scheduled for Saturday, April 1, 2023 at the City Central Park. iv. Shop Local! 7. CITY BOARDS REPORT: a) Parks And Recreation Board: Board President Michael Merritt reports: i. The Baseball and Softball season is off to a good start. ii. Thanks the Mayor and Council for the appropriation of funds for repairs to the ball fields to get the program started for a successful year. iii. The Soccer Program starts April 1, 2023. b) Library Board, Carroll Rector, Director Reports: i. The Library has on display the pieces of art from the five winners of the Hueytown Arts Council Art Contest. ii. The Arts Council encourages other locals to contact the library to schedule a time for their art " showings". iii. The " Chicks with Sticks" knitters and crochet ladies who meet at the Library on Mondays will also have an art display soon. iv. The Summer Reading Program will be held on each Wednesday in June at 11: 00A. M. Fliers are being developed to take to the local Schools. v. The Summer Reading Class program is being developed which will be held on Tuesday, Wednesday and Thursday during the month of July. A flier is being created to distribute to the local schools. vi. Reminder the Library and Staff Members are to be a service to the community and remember the slogan, " When In Doubt, Go To The Library". 8. CORRESPONDENCE a) Letter received from the Alabama Department of Revenue requesting nominees for the County Equalization Board. 9. BILLS FOR APPROVAL March 21, 2023 City Council Meeting Minutes Page 2 Of 5 424 Council Member Zinnerman presented a list of bills totaling $ 198, 134. 85 and made a motion to approve the list of bills which were presented for payment. Council Member Jacks made a second to the motion. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. RESOLUTION 6517 Resolution 6517 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 1725 261h Avenue North. A motion by Council Member Hurliman was made to adopt Resolution Number 6517 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 11. RESOLUTION 6518 Resolution 6518 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 3100 20t' Street North. A motion by Council Member Hurliman was made to adopt Resolution Number 6518 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 12. RESOLUTION 6519 Resolution 6519 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 3400 Carrie Road. A motion by Council Member Hurliman was made to adopt Resolution Number 6519 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 13. RESOLUTION 6520 Resolution 6520 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 3404 Carrie Road. A motion by Council Member Hurliman was made to adopt Resolution Number 6520 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 14. RESOLUTION 6521 Resolution 6521 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 3473 Virginia Drive. A motion by Council Member Hurliman was made to adopt Resolution Number 6521 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. RESOLUTION 6522 Resolution 6522 was presented to the Council to order the abatement of a Public Nuisance of an Unsafe Structure located at 3481 Virginia Drive. A motion by Council Member Hurliman was made to adopt Resolution Number 6522 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 16. RESOLUTION 6523 March 21, 2023 City Council Meeting Minutes Page 3 Of 5  425 Resolution 6523 was presented to the Council to authorize the City Attorney to file eminent domain lawsuits as relates to the State of Alabama Project STPBH- 70201( 600),known as Hueytown Road Widening. A motion by Council Member Zinnerman was made to adopt Resolution Number 6523 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 17. RESOLUTION 6524 Resolution 6524 was presented to the Council to declare and deem certain Municipal Personal Property surplus and not needed for Public purposes and to authorize and approve the disposal thereof. A motion by Council Member Zinnerman was made to adopt Resolution Number 6524 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 18. RESOLUTION 6525 Resolution 6525 was presented to the Council to consider amending the fiscal year 2023 budget to authorize the paving of Old Johns Road. A motion by Council Member Zinnerman was made to suspend the rules to adopt Resolution Number 6525 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. ORDINANCE 23- 0321- 01 Ordinance 23- 0321- 01 was presented to the Council as a First Reading/ Public Hearing for the Council To Consider the Annexation of property located at 3387 Davey Allison Boulevard, Hueytown. After no person came forward to speak either for or against the Ordinance, a motion by Council Member Pickens was made to close the Public Hearing followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 20. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Bernard Cook at 596 Yellow Bird Lane suggests the City consider naming the new park currently known as City Center Park as " Veterans Park". b) Eric Frey at 2845 Brooklane Drive, from the American Legion Post 2845 spoke about naming the City Center Park as " Veterans Park". c) Mike Pugh at 2703 Novel Drive addressed the Mayor and Council about the recent Garbage rate increase and his account was paid for the year and why he received an invoice when the year has not been realized. 21.
