MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 22, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, August 22, 2023. President Wright called the meeting to order with Council Members Zinnerman, Hurliman and Jacks present. Also present was Mayor Stephen Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP. Council Member Pickens was absent. There were Ten individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 22, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, August 22, 2023. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 05P.M. with approximately twenty- nine individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman, followed by the Pledge of Allegiance. 3. PLEDGE OF ALLEGIANCE: 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Hurliman and Jacks being present. Council Member Pickens was absent. President Wright presided over the meeting. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were present. 5. MEDIA RECOGNITION: There was no media present. 6. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Zinnerman to approve the August 8, 2023 Pre -Council and Council Meeting and the August 21, 2023 Work Session Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Zinnerman made a motion to adopt the meeting agenda as published with the addition of Resolution Numbers 6634, 6635 and 6636 and August 22, 2023 City Council Meeting Minutes Page 1 Of 8 2 Ordinance Number 23- 0822- 02 followed by a second to the motion by Council Member Hurliman. Upon roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomes everyone attending the meeting. The Mayor spoke of students returning to school and everyone should be mindful of traffic. The Mayor also announced the progress with the University of Alabama property which is named West Rock Nature Preserve, and the Open House which is scheduled for August 24, 2023 at the Annex from S: OOP. M. to 7: OOP. M.. The Mayor invites anyone interested to come to the Open House to learn more about the project and is seeking the public' s input for the West Rock Nature Preserve project. The Mayor Read a Proclamation recognizing September 2023 as Gynecologic Cancer Awareness Month and presented the Proclamation to Ms. Sharon Syx who addressed the audience on a brief statement about Gynecologic Cancer. Proclamation MEREAS, gynecologic ( GYM cancers are among the leading cancer killers of women in the vnitedStates, and more than 125,000 women will be diagnosed, and more than 33, 000 women will die from these diseases this year and the a6sence they leave in our hearts willbe deeply felt forever,and JaREAS, the Laura Crandall Brown F(oundation and their `A State of Teal' initiative brings awareness of allG2'Ncancers to the people throughout the State ofAla6ama; and YaUAS, the good health and well-being of womenin our state and the City of Yfueytownare enhanced by increased awareness of GyNcancers and their symptoms and treatments; and will jEAS, it is also crucial that all women in our state and the City of 9fueytown take an active role in learning the symptoms and risk factors associated with GYN cancers, developing healthy habits, and undergoing regular medical e, aminations so that any occur ence of these diseases may be detected in their early and treatable stages; and WNTP, EAS,we reflect upon the memory of those lost to these diseases, the bravery of those currently battling these diagnoses, and the need forincreased awareness, screening, and research so that the women of our state might be spared from them in the future, and encourage all citizens to work together to raise awareness of G`YN cancers; NOW,, gY&METOU, I, Steve ' Ware, 9Kayor of the City of JTueytowry Alabama, do hereby proclaim September 2023,as Gynecokwic Cancer Awareness - Wonth throughout the City andencourage all residents ofYfueytown to work together to raise awareness of GrYNcancers and do commend thisobservance to all of ourcitizens. 9. Munch and Mingle held on August 19"' was a great success with plenty of networking opportunities ii. Every Monday is the Podcast called " Chamber Chat" with Coach Patterson. iii. Topical Smoothie Ribbon Cutting is Friday, September 16, 2023. iv. Fitness In Park starts August 19th at 9: OOAM with Kim Dabbs, a certified instructor with thirty- four years of nursing experience and certifications. Future dates are September 9, 23, 30, October 7, 14, 21, 28 and November 4, 11 and 18, 2023. v. Announced the fifth annual " Paw Palooza 8v Weiner Dog Races" is scheduled for September 16, 2023 at the New City Center Park. vi. Shop Local! b) Hueytown Library, Carroll Rector Reporting: i. Reports the Jefferson County Library Cooperative computer systems have been off-line since August 11, 2023 with hopes to being back on- line in another week. ii. The summer reading class had fourteen students with fifteen tutors. iii. The Library has started Dewey the Book Worm rock snake and all are welcomed to add to the Dewey' s growth. c) Hueytown Arts Council, Michelle Reporting: i. The next Movies In The Park is August 29th and will be held in the City Center Park on Forest Road starting at 7: OOPM. The rescheduled movie date is September 29, 2023. Additional information can be obtained from the Hueytown Arts Council' s Website, https:// hueytownarts. org/ and Facebook page. ii. Hubert the " Rock Snake" has been started at the City Park and all are welcomed to add. iii. The mural team has two projects in the works. iv. The Worship Fest event is being planned for November 9th, 2023 at North Highlands Baptist Church with the events proceeds benefiting the Neighborhood Bridges program. 12. Ms. Jennifer Harris addressed the Mayor and Council with the City Inspector reporting the property has been secured. A motion by Council Member Zinnerman was made to adopt Resolution Number 6615 followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. o) RESOLUTION 6629 Resolution 6629 was presented to the Council to authorize the Intergovernmental Lease Agreement with the Jefferson County Board of Education. The motion carried unanimously. p) RESOLUTION 6630 Resolution 6630 was presented to the Council to authorize the contract with the United Way Area on Aging of Jefferson County. The motion carried unanimously. u) RESOLUTION 6637 Resolution 6637 was presented to the Council to adopt the Personnel Board of Jefferson County Public Safety Job Class Reclassification and to authorize an Employee Five Percent ( 5%) Cost of Living Allowance, " COLA". A motion by Council Member Hurliman was made to adopt Resolution Number 6637 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. v) RESOLUTION 6638 Resolution 6638 was presented to the Council to authorize a Grant Application for the West Rock Mountain Preserve and authorize access to the Trail System at Dee Hendricks Road. A motion by Council Member Hurliman was made to adopt Resolution Number 6638 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. ORDINANCES: a) ORDINANCE 23- 0822- 01 Ordinance 23- 0822- 01 was presented as a First Reading/ Public Hearing to adopt for the CITY OF HUEYTOWN AND ITS POLICE JURISDICTION THE 2021 EDITION OF THE INTERNATIONAL BUILDING CODE; THE 2021 EDITION OF THE INTERNATIONAL FIRE CODE; THE 2021 EDITION OF INTERNATIONAL RESIDENTIAL CODE; THE 2021 EDITION OF THE INTERNATIONAL EXISTING BUILDING CODE; THE 2021 EDITION OF THE INTERNATIONAL PLUMBING CODE; THE 2021 EDITION OF INTERNATIONAL MECHANICAL CODE; THE 2021 EDITION OF THE INTERNATIONAL FUEL GAS CODE; THE 2020 EDITION OF THE NATIONAL ELECTRIC CODE/ NFPA 70; AND THE CONTINUED ADOPTION OF THE 2015 INTERNATIONAL ENERGY CONSERVATION CODE AND THE 1998 PROPERTY MAINTENANCE CODE. Inspections Officer Humphries supplied brief description of the a proposed Ordinance to the Mayor and Council. President Wright closed the Public Hearing after no other person present spoke for or against the proposed Ordinance. b) ORDINANCE 23- 0822- 02 August 22, 2023 City Council Meeting Minutes Page 7 Of 8 L Ordinance 23- 0822- 02 was presented as a First Reading/ Public Hearing to adopt regulations for the control of Noise pollution within the City of Hueytown. President Wright closed the Public Hearing after no person present spoke for or against the proposed Ordinance. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. _ a) Shante Brown addressed the audience as a candidate for the Criminal Judge position at the Jefferson County Bessemer Division Court House. The election is March 05, 2024. b) Rene Morgan at 432 Laird Avenue, the owner of Southern Grace, spoke about the Senior Center. Mayor Ware addressed Ms. Morgan and referred her to contact the Senior Center Manager. c) Libby Rich at 142 Lindberg Road addressed the Mayor and Council of names being used to threaten Seniors and to condemn property via DHR. Ms. Rich advises the Mayor and Council of the scam operators within the City and requests the Council to investigate. d) Paul at 2040 Edenwood Drive has been trying to get in contact with the Park and Recreation regarding signage on the ball field fence. Council Member Zinnerman will follow-up on this matter. e) Walter Bush at 1520 27' Avenue North, addressed the Mayor and Council regarding an alley behind his property. Mr. Bush states of having to cleanup and is seeking the City to surrender the property or the City should be maintaining the area. 17.
