67 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JANUARY 23, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, January 23, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were also present. There were four individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JANUARY 23, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, January 23, 2023. 1. CALL TO ORDER: with The meeting was called to order by Council President Wright at 6: 02P. M. approximately twenty- three individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was lead by Council Member Hurliman. 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: Kailah Hegler from the Western Star was identified at the meeting. 6. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Pickens to approve the January 09, 2024 Pre -Council and Council Meeting and the January 18, 2024 meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published followed by a second to the motion by Council Member Jacks. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present and invites others to attend for any concerns they may have with the City. The Mayor expressed his thanks to the City' s Public Works and Public Safety departments for the hard work to maintain city services through the past weeks' deep freeze. _ 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, announced the Council has received the City's financial report through December 2023 at the Work Session and to address any questions to the Finance Committee or to the City Clerk. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, reports the Park 8v Recreation Committee rescheduled their meeting which was very lengthy. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - no report. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Acting Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce, Debbie Kiker Reports: i. Information can be obtained from the Hueytown Area Chamber of Commerce website, https: / / hueytownchamber. com and Facebook page. b) Library, Carroll Rector, Director, reports: i. Due to the Holidays and weather the Library was open for five workdays for the first fifteen days in January. ii. The Summer Reading Program will continue in June 2024 with flyers being sent to the local schools and posted on the Library' s Facebook page to advertise the program. iii. The student tutored reading classes will be held in July 2024. The classes will be free and offered on Tuesday, Wednesday and Thursday during the month of July. Flyers will be sent to the local schools and posted on the Library' s Facebook page to advertise the program. iv. Planning continues with ticket sales for the special event of Sean Dietrich being scheduled to perform on April 13, 2024 at the North Highlands Baptist Church. Tickets be can purchased through www. eventbrite. com v. The Library is a drop- off point for the Hueytown High School Peer Helpers " Winter Coat Drive" which ends February 16, 2024. The Library was also a drop- off point during the November and December Toys For Tots and the Oak Grove High School Baseball Team' s " Donated Shoe Drive". vi. The Library offers Notary Public services Monday through Friday from 10: 00AM to 6: OOPM for a $ 5. 00 fee. c) Arts Council, Jake Ware reports: January 23, 2024 City Council Meeting Minutes Page 2 Of 7  i. The Executive Committee is planning the budget with a full list of events. ii. March is the Arts Show scheduled to be held at the North Highlands Baptist Church. iii. Sean Of The South scheduled for April 13, 2024 with tickets on sale through www. eventbrite. com iv. Information can be obtained from the Hueytown Arts Council Facebook page https:// www. facebook. com/ HueytownArts/ d) Hueytown Parks 8s Recreation Board, Tammy Pickens, President, reports: i. Thanks Michael Merritt for all the work he had done the past few years as the Board' s President. ii. The Board is assessing the various " Pocket Parks" which are located through the City to catalog and develop a plan to address issues at each of the parks. iii. Thanks the Council for looking into the lighting issues at the Parks. iv. Continue to do some updates at the two Community Centers. v. Announced the rate increase of the hourly rental rate at the Community Centers. 12. CORRESPONDENCE a) There as no correspondence to report. 13. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 364, 320. 86 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Zinnerman was made to adopt Resolution Number 6730 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6731 Resolution 6731 was presented to the City Council to declare a Public Nuisance and to order the abatement of weeds, trash and/ or inoperable vehicle for the property located at 112 Brooklane Drive, Hueytown. The motion carried unanimously. c) Resolution 6732 Resolution 6732 was presented to the City Council to declare a Public Nuisance and to order the abatement of weeds, trash and/ or inoperable vehicle for the property located at 317 Pope Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6732 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. d) Resolution 6733 Resolution 6733 was presented to the City Council to declare a Public Nuisance and to order the abatement of weeds, trash and/ or inoperable vehicle for the property located at 1282 Hueytown Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6733 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. e) Resolution 6734 Resolution 6734 was presented to the City Council to declare a Public Nuisance and to order the abatement of weeds, trash and/ or inoperable vehicle for the property located at 1716 28th Avenue North, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6734 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. A motion by Council Member Hurliman was made to adopt Resolution Number 6735 followed by a second to the motion by Council Member Pickens. The motion carried unanimously. g) Resolution 6736 Resolution 6736 was presented to the City Council to declare an unsafe structure as a Public Nuisance for the property located at 206 Pinewood Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6736 followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. h) Resolution 6737 Resolution 6737 was presented to the City Council to declare an unsafe structure as a Public Nuisance for the property located at 216 Pinewood Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6738 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. j) Resolution 6739 Resolution 6739 was presented to the City Council to declare an unsafe structure as a Public Nuisance for the property located at 98 Wheeler Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6739 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. k) Resolution 6740 Resolution 6740 was presented to the City Council to authorize the annual software support agreements for Southern Software Programs being used by the Police and Fire Departments. A motion by Council Member Zinnerman was made to adopt Resolution Number 6740 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 1) Resolution 6741 Resolution 6741 was presented to the City Council to approve the Alcohol Beverage Control License for Steve' s Package Store located at 5973 Johns Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6741 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. m) Resolution 6742 Resolution 6742 was presented to the City Council to approve the lowest 2024 Workers Compensation Insurance proposal. A motion by Council Member Zinnerman was made to adopt Resolution Number 6742 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. n) Resolution 6743 Resolution 6743 was presented to the City Council to adopt the Americans With Disabilities Act pursuant to Title II of the Americans With Disabilities Act and Section 504 of the Rehabilitation Act of 1973. A motion by Council Member Hurliman was made to adopt Resolution Number 6743 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. A motion by Council Member Hurliman was made to adopt Resolution Number 6744 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. p) Resolution 6745 Resolution 6745 was presented to the City Council to authorize the Alabama Association of Fire Chiefs Mutual Consortium agreement. A motion by Council Member Pickens was made to adopt Resolution Number 6745 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. q) Resolution 6746 Resolution 6746 was presented to the City Council to authorize a one- time donation to the Hueytown High School Cheerleading Booster Club. A motion by Council Member Zinnerman was made to adopt Resolution Number 6746 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. r) Resolution 6747 Resolution 6747 was presented to the City Council to authorize a one- time donation to the Hueytown High School Band. A motion by Council Member Pickens was made to adopt Resolution Number 6747 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. s) Resolution 6748 Resolution 6748 was presented to the City Council to authorize a donation to the scholarship program of the Concerned Citizens of Hueytown, Inc. Black History Scholarship Banquet. A motion by Council Member Hurliman was made to adopt Resolution Number 6748 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. t) Resolution 6749 Resolution 6749 was presented to the City Council to authorize the Mayor to negotiate the purchase of real property. A motion by Council Member Hurliman was made to adopt Resolution Number 6749 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) There were no Ordinances To Consider. 16. EXTEND THE FLOOR TO THE PUBLIC January 23, 2024 City Council Meeting Minutes Page 6 Of 7  73 Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Tammy Pickens at 3404 Sharon Lane addressed the Mayor and Council regarding the sink -holes on the Jefferson County Board of Education Forest Road ball fields and what the community can do to assist the City to resolve The Mayor suggests the community reach out to the problem. Oscar Mann who represents the Hueytown area on the Jefferson County Board of Education. b) Abdul Alwahiid addressed the Mayor, Council and audience as a candidate for the Jefferson County Constable District 57. c) Ron Marshall addressed the Mayor, Council and audience as a candidate for the Jefferson County Assistant Tax Collector for the Bessemer Cut- off division. d) Yashiba Blanchard addressed the Mayor, Council and audience as a candidate for the Jefferson County Probate Judge Place 1. 17.
