CouncilmemberLollmovedtoapprovetheConsentAgendaandwassecondedbyCouncilmemberOlson. Themotion
passedunanimously, 9-0.

Transmission,Inc.afranchisetolayagaslinewithinthecitylimitsandright-of-waytoservePaver’s Supplyfora
periodoften (10)years,firstreading. [AronKulhavy,DirectorofCommunityandEconomicDevelopment,and
LeonardSchneider, CityAttorney]
Therewasnodiscussionontheitem.
b. Presentation, discussion, andpossibleaction toapproveOrdinance2013-11,amendingthebudgetforFY12-13.
SteveRitter,InterimFinanceDirector]
CouncilmemberOlsonmadeamotiontoapprovetheOrdinanceandwassecondedbyCouncilmemberJohnson.
CouncilmemberAllenaskedifthewallcausedtheissuewiththemural. AronKulhavy, DirectorofCommunityand
EconomicDevelopment,saidtheengineeringreportgave thelikelycausesweretheeffectofthedroughtonthesoil
causingcracks,thenallowingmoistureinatthetopofthemuralbetweenitandthewall. Headdedthatthestructureof
thewallwasin “goodshape.” Hecontinuedthatthewallwasabrickmasonrywallandthetie-inofthemuraltothewall
wastheconcern.
CouncilmemberAllenaskedifthewallcausedthemuraltoseparateinanyway. Mr.Kulhavyallowedthatitcouldhave
beenacontributingfactor. CouncilmemberAllenaskedifanyCityemployeehadbeentocheckthewall. Mr.Kulhavy
saidtherehadnotbutthattheownerhadhiredastructuralengineertoevaluatethewallandreadfromthereportthe
notationthatthesoilhadcausedtheminutecracksinthebrickwork. CouncilmemberAllenaskedwhytheCityspent
17,600toattachthemuraltoawallwithissuesratherthanwaitinguntilthewallwasrepaired, andiftherewereboltsin
theholes. Mr.Kulhavysaidhedidnotknow. CouncilmemberAllenaskedifthebuildingownerwoulddotherepairsand
Mr.Kulhavysaidtheownerhadtoldhimtherepairswereinprocess.
CouncilmemberAllenaverredthattheCityshouldhavedonetheinspection. Councilmember Allenmovedtotablethe
itemandwassecondedbyCouncilmemberHumphrey. Themotionpassed8-1,Councilmember Olsonvotingagainst.
TheMayoraskedthatsomeonefromtheengineeringfirmbepresentatthenextmeeting. Councilmember Olsonnoted
themoneyhadbeenspentandthequestionwastheappropriationoffunds.
c. Presentation, discussion,andpossibleaction toconsiderthebidfortheMagnoliaWayStreetReconstruction
Project. [AronKulhavy,DirectorofCommunityandEconomicDevelopment]
CouncilmemberFitchmadeamotiontoawardthecontractandwassecondedbyCouncilmember Johnson. Themotion
wasapprovedunanimously, 9-0.
7. MAYOR/CITYCOUNCIL/CITYMANAGERANDCITYATTORNEYREPORT
a. AnnualupdatefromtheFinanceCommittee. [CouncilmemberOlson]
CouncilmemberOlsonnotedtheworkoftheFinanceCommittee intheirsixteenmeetingsintheprioryear,concentrating
oncontracts, policies,andbudgeting. TheMayorthankedthecommitteemembersfortheirwork.
b. CityManager’sReport
1. UpdatesonCityconstruction, grants,studies,Cityprojects,Citypurchases, andeconomicdevelopment.
Mr.BenoitannouncedtheCity’s receiptoftheSAFERgranttofundfourfirefighterpositionsandnotedhehopedto
havethesepositionshiredbyMarch1.
