BOARD OF ADJUSTMENT

Member Present: Alden Allen, Wendy Nobles, Gene Hicks, Nathan Kennedy, Kristi Brower
Staff Present: Naysha Foster, Current Planner
Call to Order: Kristi, called the meeting to order at 12:15 p.m.
Minutes: Gene made a motion to approve the April 23, 2020 minutes as written. Nathan seconded the
motion. The motion carried unanimously.
Conditional Use Permit
CUP20-001 Naysha Foster presented the staff report for the Conditional Use Permit (CUP) for two mobile
classrooms at Idaho Falls High School located at 601 S Holmes Ave. in Idaho Falls, ID. The
proposed CUP is to move two mobile classrooms. Each unit will include two classrooms. The
mobile units are 64 feet by 27.8 feet. The R3A Zone allows schools and associated facilities
with a Conditional Use Permit. The mobile classrooms are consistent with the current use of the
property. The location of the mobile classroom will not affect the surrounding neighborhood
and will not be visible from public streets. 66 public hearing notices were mailed on 5/8/20 to
property owners within 300 feet. A legal notice was published in the Post register on Sunday,
May 10th and the property was posted with a public hearing notice sign on 5/14/20. Staff
recommends approval of the CUP and informed the board that the condition of Fire Department
guidelines for final location of the modular units is no longer necessary as the Fire Department
has already been to the school and cleared placement. Jonathan Gallup from Resin Architecture
located at 305 1st Street in Idaho Falls represented School District 91 and stated that Naysha
described what they needed. Gene asked about classroom access to the buildings. Jonathan
stated that they will have entrance in the southwest corner and vehicle access throughout the
Civic Center.
There was no other Public Testimony. Kristi closed the public hearing.
Board Discussion: Wendy questioned what happens to the buildings after the five year timeframe listed on the
application. Naysha stated that that has nothing to do with the City it was the applicant’s
statement. Jonathan said that this is meant to be a short term solution and hopefully in five
years the modular classrooms will no longer be needed. There was no further discussion.
Nathan made a motion to approve the CUP as presented. Gene seconded the motion. Motion
carried unanimously.
Reasoned Statement: Kristi read the reasoned statement. Nathan made a motion to approve the reasoned statement as
read. Gene seconded the motion. Motion carried unanimously.
Adjourn: Kristi adjourned the meeting at 12:36 p.m.

Public Hearings:
CUP20-001: Conditional Use Permit for Idaho Falls High School Mobile Classrooms
APPLICANT: Resin Architecture
LOCATION: North of E 8th St, East of S Holmes Ave, South of John Adams Parkway,
West of Tiger Ave
Business: None
In response to the COVID-19 crises, on March 19, 2020, Governor Brad Little issued a proclamation
suspending the portion of Idaho Code 74-203(5) which requires government agencies to allow the public to
attend public meetings in person. The purpose of the proclamation was to allow public business to be
conducted while also following guidance to limit gathers to 10 or fewer people. The proclamation
encouraged, but did not require, public agencies to provide other means of participation. Idaho Falls believes
in public participation and has established the following methods of participation:
1. Provide any written testimony to nfoster@idahofallsidaho.gov. Written testimony will be sent to the board
and read into the record verbatim during the hearing.
2. If you wish to provide oral testimony, you may do so remotely through a Webex meeting. The Webex will
allow you to watch and listen to the hearing, as well as provide testimony. You may participate with a phone
or computer, but you must send your email address to nfoster@idahofallsidaho.gov no later than 11:00 a.m.
on May 28th so log in information can be sent to you.
3. If you are interested in watching and listening, but not testifying, you can watch the live stream of the
meeting at idahofallsidaho.gov.
4. A copy of the above application documents are maintained on file in the Planning Department, City Hall
Annex, 380 Constitution Way, Idaho Falls. These items can be provided to the public for review by email. If
you would like to review these materials or discuss the application with a Planning Division representative
please call 208-612-8276.
5. If a group of residents have similar comments, but wish to provide in person testimony rather that written
testimony, it is recommended that the group choose a spokesperson to attend the hearing via Webex and
provide those comments while the others view the regular live stream.
