BOARD OF ADJUSTMENT November 10, 2020 City Annex Building, Conference Room 680 Park Avenue Member Present: Alden Allen, Wendy Nobles, Gene Hicks, Nathan Kennedy, Kristi Brower, Ron Johnson, James Wyatt Staff Present: Naysha Foster, Current Planner Call to Order: Ron, called the meeting to order at 12:19 p.m. Minutes: Gene made a motion to approve the July 23, 2020 minutes with a modification of the word “was” to “wash” in the first sentence. Kristi seconded the motion. The motion carried unanimously as modified. Conditional Use Permit CUP20-004 James stated his firm is working on a part of this project for led that $2000.00 and thinks it is low enough that he does not feel he needs to recuse himself. The Board agreed. Naysha Foster presented the staff report for the Conditional Use Permit (CUP) for a pavilion located at 1200 Dunbar Dr. The CUP is to construct a pavilion in the same location the picnic shelter or previous pavilion was on the Northwest side of the 5.4 acre parcel. There is an existing gravel parking lot that will not be required to be improved at this time, also no street improvements would be required at this time. The use is consistent with the existing use of the property and is permitted in an R1 zone with a CUP. Conditional Use Permits are required for Public Service Facilities, Religious Institutions and Schools located in an R1 Zone. Any site modifications would require a new CUP unless a master plan was approved and implemented within a year. The Board of Adjustment may approve the CUP, approve with conditions, table for additional information or deny, with findings supporting the decision. A legal notice was published on October 25, 2020. Public Hearing notices were mailed to property owners within 300 feet on October 23, 2020 and the property was posted on October 30, 2020. The staff recommends approval of the Conditional Use Permit with no conditions. The applicant, Jeff Nielson from NBW Architects reported the pavilion will be 30’X60’ with metal columns and wood beams. There is a handicap stall and an unimproved parking lot. The pavilion will be lit and operated on a timer. The pavilion will be open air to aid in security. The Board had no questions for the applicant nor staff. James closed the public hearing and opened discussion to the Board. There was no further discussion. Gene made a motion to approve the CUP as presented and Ron seconded. The motion passed unanimously. There was no other Public Testimony. Ron closed the public hearing. Board Discussion: Gene asked about a prior case brought before the Board of Adjustment regarding the tire shop on Yellowstone. Naysha gave an update letting the Board know the case was moving forward and will be going through the court. Reasoned Statement: Naysha read the reasoned statement. Ron made a motion to approve the reasoned statement as read. Alden seconded the motion. Motion carried unanimously. However, because social distancing is still required seating will be extremely limited and alternative methods of participation are still highly encouraged. Idaho Falls believes in public participation and has identified at least three methods of participation. 1. Via Livestream on the Internet: The public may view the meeting at www.idahofallsidaho.gov 2. Email: Public comments may be shared with the Board via email at nfoster@idahofallsidaho.gov 3. Live Meeting Attendance: Members of the public wishing to participate in a live meeting that has been legally noticed for this agenda may do so remotely through the WebEx meeting platform with a phone or a computer. This platform will allow citizens to provide testimony at the appropriate time.
