April 2, 2024 7:00 p.m. Planning Department City Annex Council Chambers MEMBERS PRESENT: Commissioners Glen Ogden, Forrest Ihler, Bill Scott, Dale Storer, Arnold Cantu MEMBERS ABSENT: Kristi Brower, Marsha McDaniel ALSO PRESENT: Assistant Planning Director Kerry Beutler, David Peterson Planner, Jacob Beck, Esq, Assistant City Attorney, and interested citizens. CALL TO ORDER: Ogden called the meeting to order at 7:00 p.m. MINUTES: Ihler moved to accept the minutes of March 5, 2024; Scott seconded the motion. The motion passed unanimously. Business: 1. PLAT 24-004: FINAL PLAT. Sunnyside Crossroads Regional Center Division No. 1., First Amended. Peterson presented the staff report, a part of the record. Applicant: Cornerstone Geomatics – not present. Storer asked about the history of Outlet being deeded to the City and asked if that that road been dedicated. Peterson confirmed it is a dedicated public street. Scott moved to recommend to the Mayor and City Council approval the final plat for Sunnyside Crossroads Regional Center Division No. 1, First Amended. Cantu seconded the motion. Ogden called for roll call vote: Cantu, yes; Ihler, yes; Ogden, yes; Scott, yes; Storer, yes. The motion passed unanimously. 2. PLAT 24-006: FINAL PLAT. Rose Nielsen Addition Division No. 101, Sixth Amended. Applicant: (via Teams) Brian Whaley Brookfield Properties Whaley stated that the intent of this final plat is to do a various parcel subdivision in a proactive manner. They have been working with their investment team and asset management team and local mall team and they continue to have interest in parcels in the mall and the intent is to look at the asset overall and determine what makes sense that they could part with for another user at the mall. Whaley stated that they are proactively subdividing the property while they field information from interested parties. As a result, they have met with Staff and there was a desire to take the privately maintained water mains and take those public for the City to be in control of and they are supportive of that effort and will work with the City to make that part of the subdivision efforts. Beutler presented the staff report, a part of the record. Ihler asked if this is a new plat or a request to subdivide later. Beutler stated that the shaded area is included within the subdivision plat and the subdivision plat drawings shows 8 lots established within, including Garcias, Sizzler, Noodles Inc., Dick Sporting Goods, Large Lot of mall and parking, other lots that are on the perimeter that are undeveloped. This is a new subdivision that would create new non-existing lot lines. Ihler asked why the City is taking the water lines. Beutler stated that there is a main line that services the mall with different service lines to service different areas, and statutorily there is a requirement for the City to be the deliverer of the water and in order to do that the City has to take over the Water Mains and the service lines would continue to be the property owners responsibility. Ihler asked about the Walkability Feasibility Study done by USU and was that talked about at all in consideration of this plat. Beutler stated he is unsure if the Staff has shared with the applicant the Utah State Study. Whaley stated that he has not been made aware of the Utah State Study. If that is something the City would like to share, they are still responding to the comments provided and will take a look at the Study and see if it can be taken into account. Beutler stated that the plan was very conceptual, and the intent was to utilize the out parcels and vacant property for additional uses, and Planning Commission Minutes April 2, 2024 Page 1 of 3 that is the intent of the plat, and the current plat would keep to the concept of the plan. Ihler would like that shared with the developer. Storer asked about the proposed water easement and asked at what point do they get a dedicated easement if the City is going to operate the water system. Beutler stated that at the time the plat is approved and recorded it will be dedicated, and those reviews will be addressed between now and City Council and they will have a finalized plat document to take to City Council. Storer is concerned that it is not currently on the plat. Beutler stated that the Planning Commission doesn’t have prevue over easements. Storer stated that the purpose of showing them on the plat is to give the public notice of where they are at and is it the intent to have the assumption of the City’s ownership and maintenance at a later date. Storer stated that by accepting the plat, is the City not accepting the ownership yet. Beutler stated that they will accept ownership at the time the plat is completed and recorded, and the Planning Commission is just offering a recommendation to the City Council in relation to land use requirements of the City. The City Staff will then continue to work through the technical review comments before it goes to City Council and City Council will be the approving body and when it is approved and recorded the City will establish the easements. Storer stated that if this document is intended to accept the water system, then they are putting off the dedication of the easements as well as the acceptance of the lines as public water lines. Beutler stated that they will be resolved prior to going to City Council for approval and it typically accompanies a development agreement that will define the responsibilities. Storer is concerned that it doesn’t get lost. Beutler stated that the water division will review and make sure they have everything they need. Ted Didas, McNeil Engineering. Didas thought they showed the water line easement on the plat. Beutler agreed they are shown, but they are labeled as proposed. Storer is concerned that they are labeled as proposed and another separate document would be recorded when it comes in front of City Council. Didas stated that it can be dedicated on the plat or via separate documents, whatever the City prefers. Storer doesn’t want it forgotten. Storer asked if Public Works has done a study on the condition of the lines as this subdivision was platted in 1978 so they are approaching 50 years of the water mains and is there contemplation of having a study done on the condition. Storer is concerned that the City will be picking up a big liability if the lines are not in good shape. Beutler stated that they are in discussion with Civil Engineering Team and they do understand they are acquiring a dated system, but the Water Division has a statutory requirement to do it and if they do not they are out of compliance, and they will pick it up as it is, and the City will maintain as necessary. Ogden is happy to see additional work being done on the mall property. Ogden stated that the University Mall looked similar to this mall 15 years ago and now is better and walkable. Cantu moved to recommend to the Mayor and City Council approval of the Final Plat for Rose Nielsen Addition Division No. 101, Sixth Amended, Ihler seconded the motion. Ogden called for roll call vote: Cantu, yes; Ihler, yes; Ogden, yes; Scott, yes; Storer, yes. The motion passed unanimously. 3. PLAT 23-007: FINAL PLAT EXTENSION. The Reserve at Snake River Landing Division No. 1. Beutler presented the staff report, a part of the record. This came before the Planning Commission in April 4, 2023. If a plat has gone longer than a year the staff likes to bring it back to the Commission confirm that the recommendation is viable. It is taking longer to get all the moving pieces moving and working together. Ogden stated that there was a lot of discussion about the canals last year and asked if that is part of the hold up. Beutler stated that it is a matter of the size and timing of the project and figure out the best way to Phase the development. Ogden asked if the Battle Creek will be buried. Beutler stated that it will be above ground but will have a culvert bridge. Beutler stated that the canal that goes through the middle of the project will be piped. (Battle Creek). Ihler indicated that this project is in tandem with the PUD approved last month. Beutler agreed.
