BE IT REMEMBERED ON THIS, the 8th day of April, 2019, the City Council of the
City of Iowa Colony, Texas, held a Public Hearing and a Special Council meeting at 7:00 P.M. at
the regular meeting place thereof in the City Hall, there being present and in attendance the
following members to wit:
Mayor Michael Holton
Councilwoman Susan Cottrell
Councilman Michael Byrum-Bratsen
Councilwoman Robin Bradbery
Councilman Chad Wilsey
Councilwoman Kacy Smajstrla
And none being absent, constituting a quorum at which time the following business was
transacted.
PUBLIC HEARING- 7:00 P.M.
Mayor Holton opened the public hearing at 7:03 p.m. The City Council of Iowa Colony
will hold public hearings at 7:00 p.m. on April 1 and 8,2019, at the Iowa Colony City Hall,
12003 Iowa Colony Boulevard (formerly County Road 65), Iowa Colony, Texas, to
consider annexing the following property (first public hearing):
Part One: A 206.73 acre tract and an adjoining 46.09 acre tract, together bounded on the
west by Highway 288, on the north by Davenport Parkway (former County Road 64), and
on the east by Iowa Colony Boulevard (former County Road 65), and extending
approximately 2477 feet southward from Davenport Parkway, in Brazoria County, Texas,
to the extent such property is not already in the city limits of Iowa Colony.
Part Two: A portion of the road rights of way of County Road 64 and State Highway 288
located in and near the intersection of those two roads, to the extent such rights of way are
not already in the city limits of Iowa Colony. No comments from the public.
A metes and bounds description and a map of the area proposed for annexation are
available at no charge from the Iowa Colony City Secretary at City Hall, telephone 281-
369-2471. The public is invited to attend and speak at the hearings.
Mayor Holton opened the public hearing at 7:20 p.m. The Iowa Colony City Council will
hold a public hearing at 7:00 p.m. on Monday, April 8,2019, at the Iowa Colony City Hall,
12003 Iowa Colony Boulevard (former County Road 65), Iowa Colony, Texas, pursuant to
the Comprehensive Zoning Ordinance and the Unified Development Code, as amended, to
consider a specific use permit and variance to the above listed ordinances, to allow a pet
grooming business in a Single Family Residential Dwelling District on the following
property:
Tract 103A, HT&BRR. Abstract 517. Brazoria County, Texas. which is Property ID
Number 176434 of the Brazoria County Appraisal District, commonly known as 4113
Cedar Rapids Parkway (former County Road 57), Iowa Colony, Texas.
The City Attorney, Larry Boyd and City Planner, Kent Marsh spoke in regards to the
public hearing to consider a specific use permit and variance to allow a pet grooming
business in an SFR dwelling district. Brenda Ledbetter, Jimmy Ledbetter, Douglas
Chumlee, Rebecca Hester, and Carolyn Bowen all spoke in favor of the SUP for a dog
grooming business. Robert Wall, Carolyn Wall, Rosie Flores, and Lisa Powers spoke
against the SUP stating their concerns with the dog grooming business.
The Mayor opened the public hearing at 7: 06 p.m. The Iowa Colony City Council wilL hold a
public hearing at 7:00 p.m. on Monday, April 8, 2019, at the Iowa Colony City Hall, 12003
Iowa Colony Boulevard (former County Road 65), Iowa Colony, Texas, pursuant to the
Comprehensive Zoning Ordinance and the Unified Development Code, as amended, to
consider a specific use permit and variance to the above listed ordinances, to allow a pharmacy
or other retaiL business to operate 24 hours per day on the following property:
Restricted (Commercial) Reserve “C” of Karsten Boulevard Phase I Street
Dedication and Reserves, according to the plat recorded at File No. 2018053880 in
the Plat Records of Brazoria County, Texas, commonly known as 2810 Meridiana
Parkway (former County Road 56), Brazoria County, Texas.
Kent Marsh, The City Planner presented a letter of recommendation for the
drive thru to be open between the hours of midnight and 5 am. Councilman
Chad Wilsey asked the reasoning the CVS retail store and drive thru could
not operate 24 hours. Kent Marsh responded to Councilman Vilsey’s question
stating the concern of safety and traffic issues.
Residents including Douglas Chumlee and Rosie Flores asked questions
regarding the operation of the store and drive thru being 24 hours. Mr. Bryan
Morris with Foresite Group, the engineer for the project also spoke in regards
to the project.
Mayor Holton closed all of the public hearings at 8:37 p.m.
MEETING — 7:00 P.M.
I. Mayor Holton called the meeting to order at 8:14 P.M.
2. Pledge of Allegiance was recited.
3. Consideration and possible action to approve an ordinance amending the Heavy Load
Ordinance. Councilwoman Cottrell made motion to approve the ordinance with corrections.
Motion seconded by Councilwoman Smajstrla. Motion approved unanimously.
4. Consideration and possible action to adopt an ordinance amending the fee schedule based on
the revised Heavy Trucking Ordinance. Councilwoman Bradbery made a motion to approve the
ordinance amending the fee schedule. Seconded by Councilwoman Cottrell. Approved
unanimously.
EXECUTIVE SESSION
• Council convened in Executive Session at 8:37 P.M. in accordance with 55 1.072 Texas
Gov’t Code to deliberate on land sale andlor acquisition-
o EMS property andlor City Hall property.
o Property’ next to City Hall
The Council returned to open session at 8:52 P.M.
RETURN TO OPEN SESSION
5. Consideration and possible action regarding sale of property to ESD # 3. No action taken.
6. Consideration and possible action regarding property adjacent to City Hall. No action taken.
7. Councilwoman Bradbery made a motion to adjourn. Seconded by Councilwoman Smajstrla.
Approved unanimously.
