CITY OF 12003 Iowa Colon Blvd — IOWA Fax: 281-369-0005 P i/j CO 10 NY www.cityaflowacolony.com STATE OF TEXAS COUNTY OF BRAZORIA CITY OF IOWA COLONY BE IT REMEMBERED ON THIS, the 13th day of May, 2019, the City Council of the City of Iowa Colony, Texas, held a Worksession at 6:00 P.M. and a Public Hearing and Special Council meeting at 7:00 P.M. at the regular meeting place thereof in the City Hall, there being present and in attendance the following members to wit: Mayor Michael Holton Councilwoman Susan Cottrell Councilman Michael Byrum-Bratsen Councilwoman Robin Bradben’ Councilman Chad Wilsey Councilwoman Kacy Smajstrla And none being absent, constituting a quorum at which time the following business was transacted. WORKSESSION- 6:00 P.M. Larry Boyd, City Attorney presented a worksession on variances as follows: o The Council serves as the Zoning Commisssion and The Board of Adjustments o Four ways things can be done in a zoning ordinance. 1. Allowed uses- Decision is made by the ordinance 2. SUP- Council decides, subject to where they are allowed by the ordinance. There will be a list in the ordinance. 3. Special Exceptions- The Board of Adjustments gets to decide. These also must be listed in the ordinance. Very few areas where they are authorized in the zoning ordinance. The board of Adjustments make interpretation of the map where it is unclear what the zone boundary may be. 4. Variances- The Board of Adjustments decides (Council acting as Board of Adjustments) • Restrictions are outlined in the LGC (handout) • Hear appeals from the Building Official • Can ask for special exception • Can ask for variance. ‘ But the statute is very specific on variance  • If the variance is not contrary to the public interest. • Due to special conditions where a literal enforcement would be an unnecessary hardship. • To keep with the spirit of the ordinance and substantial justice is done • If granting: must be a special unnecessary hardship, and will be in conformance with the spirit of the law. • A variance cannot allow a prohibited use. It can grant a variance to the technical requirements. • See specific conditions on Section 95 of Zoning Ordinance • Home occupations there is a long list of technical requirements that — keeps it from qualifying, you may grant a variance. Councilwoman Smajstrla and Councilman Byrum-Bratsen both suggested we change the ordinance to update the list and update the acreage minimums for some home occupations. For example, a zone like residential/agricultural zone with its own criteria. So, we don’t have to decide on each of them. The worksession was adjourned at 7:01 P.M. MEETING 7:00 P.M. - 1. Call to order. 2. Pledge of Allegiance was recited. 3. PUBLIC HEARING o Hold a public hearing on the annexation of the 60— acre Khonsari tract. 4. Mayor’s comments o Mayor Holton read a prepared statement and gave his thank you’s to the consultants and staff for the time he was Mayor. He stated that the city has grown 400 % since he became Mayor. o Proclamation for National Police Week—May 12 through May 18, 2019. Mayor Holton issued the proclamation to Chief Bell for National Police Week. 5. City Council comments o Councilwoman Cottrell thanked Mayor Holton for his years of service to the city and community and as a friend and the great job he did. o Councilman Bymm-Bratsen deffered his comments. o Councilwoman Bradbery had no comment. o Councilwoman Smajstrla dittoed what Councilwoman Cottrell said. She stated that she appreciated the Mayor’s time as a Councilmember and Mayor. o Councilman Wilsey acknowledged that it is a tough job, but the Mayor was here all the time. 6. Consider action to canvas the results of the municipal election of officers. Councilman Bvmm-Bratsen moved to approve the resuLts of the 2019 municipal election and approve the ordinance. Motion seconded by Councilwoman Bradben’. Approved unanimously.  7. Administer Oath of Office to newly elected officials. Judge Atchison administered the Oath of Office to the following: Michael Byrum- Bratsen, Mayor Robin Bradbery, Alderman Position 3 Kacy Smajstrla, Alderman Position 4 Chad Wilsey, Alderman Position 5 Mayor Byrum-Bratsen spoke and expressed his appreciation to Mayor Holton. He presented Mayor Holton with a clock plaque for his years of service. Restated that he has been volunteering for 20 years and spent time away from his family and the decisions he had to , make. Mayor Byrum-Bratsen thanked everyone for participating in the election and stated that we have a lot of work before us for the next two years. 8. Councilwoman Bradbery made a motion to adjourn the meeting. Seconded by Councilwoman Smajstrla. Approved unanimously. APPROVED THIS 2O” DAY OF MAY, 2019.
