Rehabilitation Standards for HOME Assisted Projects
Whereas, the City of Ithaca became an Entitlement Community in September, 2003, receiving both
Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME)
funds, and
Whereas, one of the program requirements for HOME funding is the adoption of minimum rehabilitation
standards to ensure that all HOME assisted units are decent, safe and sanitary, and
Whereas, HOME regulations require that all new construction undertaken with program funds must comply
with the Model Energy Code, and
Whereas, the Housing, Neighborhoods and Infrastructure Committee of the IURA has determined a benefit
in adopting flexible standards and acknowledging the ability of the IURA to impose stricter, site specific
standards to individual projects on a case by case basis, and
Whereas, the City of Ithaca has an adopted housing code with detailed and stringent building standards,
and
Whereas, all new construction within the City requiring a building permit must meet the Model Energy Code
to receive Building Permit approval, and
Whereas, each HOME assisted project will require a building permit, as only full rehabilitation or new
housing units are eligible as construction projects under HOME regulations, and
Whereas, all HOME housing projects are required to assist housing units meeting the Housing Quality
Standards, as defined at 24 CFR section 92.251, and
Whereas, these Housing Quality Standards offer a minimum acceptable rehabilitation standard and are
exceeded by the City’s Housing Code, and
Whereas, the Housing Neighborhood and Infrastructure Committee of the IURA has created a statement of
intent to clarify how proposed housing projects will meet minimum housing quality desired by the IURA, now
therefore be it

Resolved, that the Ithaca Urban Renewal Agency adopts the City of Ithaca Housing Code and the
Statement of Intent as the Rehabilitation Standards for HOME funded projects.
Statement of Intent
HOME Rehabilitation Standards
Rehabilitation Projects funded through the Home Investment Partnerships (HOME) Program must meet the
minimum standards set forth in the City of Ithaca Housing Code. While no project will be funded that does
not meet this standard, it is the intent of the Ithaca Urban Renewal Agency (IURA) that all rehabilitation
projects result in an attractive, energy-efficient, durable and desirable finished product. More specifically, it
is the intent of the IURA that all Housing Rehabilitation Projects:
1. Consider the character, identity and needs of a neighborhood and ensure that residential rehabilitation
is in keeping with these considerations.
2. Identify the end users or use of a building and ensure that the rehabilitation maximizes the productive
use of the building.
3. Identify site-specific or area conditions (traffic, soils, noise, etc.) and mitigate the impact of the project
on the area and vice-versa.
4. Result in a high quality of construction without a likely need of a significant capital expenditure to
maintain the building for at least 20 years.
5. Increase the energy efficiency of the building or units.

Revised Rehabilitation Standards for HOME-Assisted Projects
WHEREAS, the City of Ithaca became an Entitlement Community in September 2003, receiving both
Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME) funds
beginning in 2004, and
WHEREAS, one of the program requirements for HOME funding is the adoption of minimum rehabilitation
standards to ensure all HOME-assisted units are decent, safe and sanitary, and
WHEREAS, in 2006, the IURA adopted qualitative HOME rehabilitation standards, and
WHEREAS, in 2013 HOME regulations were amended to clarify what elements must be included in the
standards, including an inspection protocol, and
WHEREAS, HUD Housing Quality Standards for the Housing Choice Voucher program establishes a
minimum housing rehabilitation standard in compliance with HOME regulations, and
WHEREAS, the City of Ithaca minimum housing standards with detailed and stringent building standards,
and
WHEREAS, a certificate of compliance is issued upon verification by City inspection that no violations of the
Building Code, Energy Code, Housing Standards contained at Chapter 210 of the City of Ithaca Municipal
Code, New York State Multiple Residence Law exist, thereby documenting compliance with HUD HQS, and
WHEREAS, the Neighborhood Investment Committee reviewed this matter at their January 2023 meeting
and recommended the following action; now, therefore, be it:
RESOLVED, the IURA hereby adopts HUD’s Housing Quality Standards (HQS) for the Housing Choice
Voucher program (formerly known as the Section 8 program) as the rehabilitation standard for HOME-
assisted projects, and be it further
RESOLVED, that as the City of Ithaca’s Housing Code exceeds the U.S. Department of Housing & Urban
Development (HUD) HQS standards and issuance of a certificate of compliance for housing rehabilitation
offers an alternative means to verify compliance with HOME rehabilitation standards.

If the owner is required to correct any lead-based paint hazards at the property including deteriorated paint or other hazards identified by a
visual assessor, a certified lead-based paint risk assessor, or certified lead-based paint inspector, the PHA must obtain certification that the
work has been done in accordance with all applicable requirements of 24 CFR Part 35. The Lead -Based Paint Owner Certification must be
received by the PHA before the execution of the HAP contract or within the time period stated by the PHA in the owner HQS violation notice.
Receipt of the completed and signed Lead-Based Paint Owner Certification signifies that all HQS lead-based paint requirements have been
met and no re-inspection by the HQS inspector is required.

Housing Quality Standards (HQS) – Frequently Asked Questions
What is the purpose of Housing Quality Standards?
The goal of the Housing Choice Voucher (HCV) program is to provide “decent, safe and
sanitary” housing at an affordable cost to low-income families. Housing Quality Standards
help HUD and local Public Housing Authorities (PHAs) accomplish that goal by defining
“standard housing” and establishing the minimum quality criteria necessary for the health
and safety of program participants. All HCV housing units must meet these housing quality
standards in order to participate in the HCV program.
What are the 13 key aspects of housing quality covered by performance
requirements and acceptability criteria in the HQS?
The 13 key aspects of housing quality covered by the HQS include:
• Sanitary facilities; • Interior air quality;
• Food preparation and refuse • Water supply;
disposal; • Lead-based paint;
• Space and security; • Access;
• Thermal environment; • Site and neighborhood;
• Illumination and electricity; • Sanitary condition; and
• Structure and materials; • Smoke Detectors.
How are Housing Quality Standards enforced?
HQS inspections are conducted by PHA staff and contractors to ensure that potential and
current HCV housing units meet the minimum performance and acceptability criteria for
each of the 13 key housing quality aspects.
When do HQS inspections occur?
HQS inspections come in three different varieties. Initial Inspections occur when a voucher
holder indicates to their PHA that they desire to lease a specific housing unit. The unit must pass the
initial inspection before the execution of the assisted lease and housing assistance payments (HAP)
contract and the initiation of payments. Annual Inspections occur once a year on housing units that are
currently under lease by an HCV participant family. Annual inspections ensure that HCV housing units
continue to meet HQS throughout the tenancy of the HCV participant family. Special Inspections may be
complaint inspections or quality control inspections. Complaint inspections occur when a tenant, owner,
or member of the public complains about the condition of an HCV housing unit. Quality control
inspections examine a sample of housing units within a give PHA’s jurisdiction each year and occur
throughout the year.
