Action Item: Resolution – 2023 Project #7 Alternatives to HOME Funding This is a resolution to make some changes to one of the projects that was funded in the 2023 Entitlement Annual Action Plan, Saint John’s Community Service. The project was funded using HOME funding, but some information has come to light and modifications must be made. Mendizabal explained that rehabilitation is a compliant use of HOME funds, and IURA would have imposed a 20-year affordability period on the rehabilitated structure. However, HOME requires a lease for transitional housing, and Saint John’s will not be offering leases – they planned to have a program agreement. Mendizabal reached out to the HUD Buffalo Regional Field Office to ask if there were any allowances for transitional housing. The response was that the regulations do say there needs to be a lease unless, by mutual agreement, the person living in the space and the landlord agree for it to be less than one year. Saint John’s feels that it would be hard to operate their program on this structure, so they will not be offering leases.  The first alternative on the matrix is to simply defund the project since it’s not compliant with HOME. The design that Saint John’s has presented is that the transitional housing is for people who are exiting residential drug treatment without permanent housing identified for their future. It is for people who don’t have permanent housing identified, are low to moderate income, and Medicaid eligible in most cases. This program would seem to fit the regulations governing CDBG COVID-19 fundin. There is currently $8,671.31 of this funding available to reallocate. The 2019 Project with GIAC Youth Programming has not yet submitted its cost documentation for any of the $175,000 they were awarded. Nels Bohn, IURA Director of Community Development, is exploring whether some of those funds may be available. Saint John’s was originally given an allocation of $88,000, but they could still go forward with a substantially similar program with less than the original allocation – they would be happy to accept any amount the Committee can provide. The SJCS site identified for this project is habitable. The targeted rehabilitation is for upgrades. Williams asked if the remaining $76,000 of HOME funds that will not be allocated can be used for anything else, such as infrastructure. Mendizabal replied that HOME funds must be used for affordable housing projects. The additional HOME funding that isn’t allocated can be disbursed to the 2024 Annual Action Plan; there is a six-year timeline on it. IURA also identified traditional CDBG funding in the amount of $5,349.87, which normally would roll over into the 2024’s AAP. However, since there is an identified eligible use for it right now, it could be used for the Saint John’s project. De Aragón made a motion to approve, seconded by Osterreich. Program Amendment #1 to the 2023 HUD Action Plan: Project #7, “SJCS Reintegration Services Project” Alternative Funding WHEREAS, the City of Ithaca’s 2023 HUD Entitlement Action Plan included an allocation of $88,000 in HOME Funds for Project #7, “SJCS Reintegration Services Project,” to address a community need for temporary or transitional housing in a sober living environment for LMI individuals exiting substance use treatment programs, and WHEREAS, the current program design of 2023 Project #7 does not include leases for each tenant, so it does not meet qualifications for HOME-eligible affordable rental housing at CFR 24 Section 92.253, making 2023 Project #7 ineligible for HOME funds, and WHEREAS, 2023 Project #7 as currently designed would meet eligibility requirements for CDBG 1 and CDBG-CV funds, and WHEREAS, IURA Staff explored an array of alternatives to replace HOME funding with compliant funding sources, and WHEREAS, changes in use of $25,000 or less from one eligible activity to another eligible activity is categorized as a non-substantial Program Amendment to the Action Plan that does not require a 1 According to the Centers for Disease Control (CDC) the COVID-19 pandemic exacerbated drug use and overdose deaths in the United States, “Substance during COVID-19 pandemic: impact on the underserved communities” https://www.ncbi.nlm.nih.gov/pmc/articles/PMC8896880/  Public Hearing or Common Council approval, and WHEREAS, the IURA Neighborhood Investment Committee has reviewed alternatives presented by IURA Staff and recommends the following, now, therefore be it RESOLVED, that the IURA hereby adopts Program Amendment #1 to the 2023 Action Plan to reallocate $48,421.18 in CDBG and CDBG-CV funding to Project #7, “SJCS Reintegration Services,” from the sources specified below:  $8,671.31 in unallocated CDBG-CV funds  $5,349.87 in unallocated CDBG (2023 R/U) funds  $9,500.00 in CDBG funds from 2023 Project #4, “CHT Sears St. Development”  $24,900.00 in CDBG-CV funds from 2020 CDBG-CV Project #32, “GIAC Youth Programming,” subject to confirmation from the City Controller that remaining $150,100.00 funding for the GIAC project is anticipated to be sufficient to reimburse all documented eligible GIAC costs, and be it further RESOLVED, that $88,000.00 in 2023 HOME funds be reallocated from Project #7, “SJCS Reintegration Services,” as follows:  $9,500.00 to 2023 Project #4, “CHT Sears St. Development”  $2,500.00 for a new project to conduct housing inspections of HOME-assisted projects  $76,000.00 designated as unallocated HOME funds available to be disbursed through the 2024 Action Plan process. Unanimous, 4-0 VI. Old/Other Business A. Draft Meeting Schedule (48:16) The city of Ithaca is changing to a city manager style, and there will be a new Mayor in January. Usually, the mayor is a member of the IURA Board, so the schedule of meeting dates is sent to the mayor to make sure he can attend the tentative meeting dates. There are extra meetings for the NIC in the first few months of the year. An idea for the summer could be to revisit the Citizen Participation Plan B. IURA Grant Summary (56:23) The GIAC Youth Program project from 2019 is still a “No”, which was discussed during the new business section. The gym renovation project is a “No” but there is a lot of activity happening. The TCAT project still has $12,000 left to expend, and they plan on spending this down. There are a few lease payments that are past due, but there are no concerns. C. Staff Report (1:00:00) The New York State Homes and Community Renewals Department has released their HOME- ARP notice of funding availability. Their application period opened on November 29 th and will close on December 22nd. This funding is available to non-profit and for-profit housing developers, and public housing authorities. They have over $57 million to allocate. It’s a very short turnaround for a complex process, so Mendizabal is looking for ways to support applicants. There is a meeting with the mayor-elect to discuss IURA planning and they are  planning to do an informational session about IURA and the HUD entitlement program. After the IURA meeting next week, there is a volunteer appreciation event. VII.
