A. Action Item: Resolution - Appointment of Committee Chair + Nomination of Vice Chair
The Chair explained the process and asked if any member wished to stand for election for
Vice Chair.

B. Action Item: Resolution - Recommend 2024 Consolidated Plan
Mendizabal stated that this Consolidated Plan amplifies some big issues addressed in
the past, namely the critical need for affordable housing and to reduce homelessness.
In this Consolidated Plan, housing instability as a result of the high cost of housing and
as a driver of homelessness was discussed in greater depth than in previous
Consolidated Plans. It also includes discussion of resiliency in regard to human-caused
climate change. The County has completed Phase I of its Resiliency Plan, which
includes planning and response to Drought, Flooding, Debris Flow (as a result of
flooding), and Economic Recovery as it relates to these disasters. Mental Health and
Substance Use Disorder (especially as it relates to the opioid epidemic) are also lifted
up in this Consolidated Plan.
(18:20) Williams asked how HUD and/or the City of Ithaca would handle enforcement
of NYS’s laws prohibiting Source of Income (SOI) Discrimination in light of the ruling
and appeal involving Source of Income Discrimination and Ithaca Renting, LLC case.
(The NYS Attorney General’s Office is appealing a lower court ruling that found in favor
of Ithaca Renting that its 4th Amendment rights were violated by the HUD-required
inspection that accompanies renting to a Housing Choice Voucher (HCV) holder). What
would happen if a developer with a history of discrimination were to apply for IURA
funds, how would IURA know and would the Consolidated Plan prohibit funding of that
project sponsor? Mendizabal responded hypothetically. (First, all IURA contracts
specify that all applicable laws apply and must be followed by the Project Sponsor).

Perhaps IURA in its decision-making would ask the developer for evidence of
correction of past practices of illegal discrimination. If the project were funded,
perhaps IURA would institute a higher level of monitoring to ensure fair housing. IURA
could seek to find a way to affirmatively further fair housing (AFFH) through its work
with this developer. IURA would use the Consolidated Plan as a guide in informing its
decision. The Consolidated Plan itself does not specify courses of action in specific
scenarios. Williams wondered: If IURA decided not to fund a project, how would IURA
defend itself against possible suit by the developer? Williams followed up with
questioning about how IURA would defend its Board/Committee Members against
possible suit from developers or anyone who believes discrimination against them has
occurred. Mendizabal responded that she doesn’t have the legal background to be
able to respond with specificity. Osterreich asked for clarification from Williams.
Williams stated that in his professional work, there is guidance about avoiding
litigation. Williams wondered why there is information about the Fain/Ithaca Renting,
LLC lawsuit in the Draft Consolidated Plan. Mendizabal responded: The AFH is part of
the Consolidated Plan and the AFH discusses prevention of SOI discrimination. In the
local context, this lawsuit is ongoing—it is now unsettled law. (Her previously noted
consultation with CNY Fair Housing indicated that in Tompkins County currently CNY
Fair Housing monitors SOI discrimination complaints but is not litigating them pending
outcome of the NYS AG Office’s appeal. However, the State’s anti-discrimination laws
involving SOI still apply throughout the State. This lawsuit is specific to Tompkins
County.) Graham instructed Staff to report more on insurance coverage for
Board/Committee Members. Robust discussion of this topic continued.

Note (45:00) Mendizabal was startled that the HUD-provided data for the
Consolidated Plan was so seemingly old or outdated. She reached out to HUD Buffalo
and was informed that this is a known issue. Mendizabal was advised to indicate
throughout the plan the data limitations but not to remove the charts in the template.
Mendizabal acknowledges (or fears) this might be confusing to the reader.
C. Action Item: Resolution – Update to 2017 Assessment of Fair Housing (AFH)
Williams wondered if it is difficult to adopt the AFH given the above-discussed lawsuit
in appeal. Mendizabal responded that the AFH can be adopted and if laws change, the
City/IURA will respond accordingly.

D. Action Item: Resolution – CHDO + CBDO Designation – INHS
Osterreich noted that the Resolution’s title needs correction (typo). Mendizabal will
make the correction.
Toy asked if Staff had any hesitations about approving this agency as a CHDO and
CBDO. Mendizabal acknowledged the analysis memo looks different. She further
explained that the CHDO designation has a involves a much greater amount of
documentation and detail than does the CBDO designation. Per HUD regs, in most
cases (but not all, as discussed previously), agencies approved for CHDO are
automatically CBDOs. This is why there is not also a CBDO analysis memo
accompanying this resolution.

VI. Other Business
A. IURA Grants Summary
Mendizabal reported that it appears that IURA will meet the annual CDBG Spenddown
Snapshot.
TCAT Update: Mendizabal reached out to the new TCAT General Manager and set a
new deadline – June 1, 2024 – as a(other) final deadline. She’s been informed
installation is complete except at those bus stops where the City is doing other
infrastructural work that prevents the installation. Mendizabal will visually inspect the
sites.

B. Staff Report
Mendizabal reported that HUD notified the City of its 2024 award amounts on May 8,
2024 (oddly, same day as 2022’s late notice).
Contingencies adopted with the draft 2024 Action Plan mean that,
For 2024 CDBG increase over anticipated, OAR will be funded up to the maximum
possible under the Public Services cap, CDBG Admin will be increased to the maximum
allowed, and the remainder will go into the ED Loan Fund.
For 2024 HOME decrease, HOME Admin will be decreased accordingly. The remaining
HOME deficit will be accounted for by subtracting that amount from The Beacon and
replaced it with HODAG.
Following up on last month’s news of Ithaca City School District’s (ICSD) termination of
support of Housing for School Success, Mendizabal reported that the HSS stakeholders
(IURA, Lynn Truame at INHS, CCTT, IHA, and CoC) met with ICSD’s Deputy
Superintendent, Lily Talcott. The principal and (one of) the social workers from BJM
were also present. ICSD clarified that activities associated with assisting with a
housing search could be considered gifting. The HSS Stakeholder group clarified that it
was not the original intention of the program to provide housing search but rather to
link/refer the HSS families to housing services.
The HSS Stakeholder group made two requests of ICSD:
1) ICSD’s guidelines for permitted/non-permitted social worker tasks to assist the
HSS Stakeholder group for its planning going forward. Ms. Talcott said that
ICSD could provide such.
2) Data on HSS student attendance, tardiness, behavioral issues, parental
involvement (such as attending parent-teacher conferences). These data
points were metrics HSS used to evaluate effectiveness and will assist the HSS
Stakeholder group in developing a proposal to other funders.

The Village at Ithaca has been providing some stop-gap support to HSS families. They
have joined the HSS Stakeholder group and are interested in moving forward to seek
funding for a case manager/social worker to work in earnest with the HSS program.
This position would be housed at The Village, not BJM.

Proposed Resolution
IURA Neighborhood Investment Committee
July 12, 2024
Consent to Change Ownership of 2007 Project #1, “ Cedar Creek Housing”
WHEREAS, on July 1, 2024, the IURA received a request to consent to a change in ownership of
the Cedar Creek Housing project to consolidate ownership to Ithaca Neighborhood Housing
Services and its affiliate organization, and
WHEREAS, the City of Ithaca’s 2007 HUD Entitlement Program Annual Action Plan allocated
$100,000 in HOME funding to Project #1 “Cedar Creek Housing” (“the Project”), 39 units of
affordable housing located at 310 Floral Avenue, Ithaca, NY, and
WHEREAS, Project funding was subject to a mortgage and leasehold mortgage given by Cedar
Creek, LLC, (“Borrower”) and Housing Opportunities Housing Development Fund Corporation
(“Fee Owner”) to Ithaca Urban Renewal Agency (“Lender”), and
WHEREAS, Project funding was further subject to a Building Loan Agreement between Borrower
and Lender, and
WHEREAS, the Borrower is comprised of three members: (1) Marketview Housing, Inc.
(“Marketview”), (2) NHS Housing Corp. (“NHS”), which is wholly owned by INHS and is a co-
managing member of the Borrower, and (3) Enterprise Housing Partners XVII Limited Partnership
(“Enterprise”), and
WHEREAS, Enterprise and Marketview desire to assign their membership interests to INHS and
NHS, respectively, and
WHEREAS, the Fee Owner desires to transfer its fee title interest in the Project to INHS, the
Borrower member that would remain, in a transaction known as a “fee transfer” (“Transaction”),
and
WHEREAS, upon the closing of the Transaction, Cedar Creek, LLC will hold fee title to the Project
and have two members: (1) NHS as the managing member, and (2) INHS as the investment
member. INHS will continue to manage the property, and
WHEREAS, per the Building Loan agreement, the Transaction is subject to IURA approval and
consent, and
WHEREAS, the IURA Neighborhood Investment Committee considered this matter at their July
12, 2024 meeting and recommends the following action; now, therefore, be it
RESOLVED, the IURA hereby authorizes the IURA Chairperson to consent to the above-described
Transaction regarding the Cedar Creek Housing project. .
My Recommendations on Pedestrian Snow Removal

Crosswalks -- First priority – The City should be explicitly responsible for clearing
crosswalks wherever DPW clears the streets. Even if that’s not the first thing they do
after a snow event, it should be an integral part of the job. Snow clearing is not done
until the crosswalks are cleared.
Sidewalks
1) The City should plow sidewalks on identified high priority routes. For example,
clear all sidewalks along TCAT routes and school bus routes.
2) Also, if the City is already clearing crosswalks, then that hardware has to travel
from each intersection to the next. It makes sense to clear those sidewalks along
the way.
3) The City already clears sidewalks by City buildings, parks, bridges, etc. That
hardware also needs to travel.
4) Tompkins County, Cornell, ICSD, and other tax-exempt entities own much
property. How best to collaborate?
These four together include more than half the City’s sidewalks. Cost estimates require
good information on hardware & personnel costs to yield cost per mile or cost per
intersection estimates. A good GIS map would help a lot. Independent contractors can
provide more personnel when DPW is short-staffed due to a snow event (as in
Rochester).
Compare the cost of this plan with the cost of the City plowing all sidewalks after large
snowfalls. Economies of scale and efficiency may make that more cost-effective.
Clearing paved trails and park walkways would be a valuable addition.
Enforcement
Consolidate two enforcement programs.
Publicize enforcement program.
Require routine data gathering on enforcement program activities & results.
Funding
Potential grant funding for pilot project. Long term, collect user fees on the property tax
bill, as Ithaca already does for sidewalk repairs, and as Rochester does for sidewalk
snow removal.
