REGULAR CITY COUNCIL MEETING - - CITY HALL #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on September 18, 2014 at the regular meeting place of the City Council. Alderman Bolden delivered the invocation and Mayor Fletcher led a standing audience in the "Pledge of Allegiance" to the flag. ROLL CALL: Aldermen: Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, Robinson, and Howard answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. PRESENTATION OF MINUTES: Mayor Fletcher presented the minutes of the regular City Council meeting of September 4, 2014 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Howard moved, seconded by Alderman Bolden that the minutes of the regular City Council meeting of 21 August 2014 be APPROVED. MOTION CARRIED . REGULAR MONTH REPORT/ANIMAL CONTROL Alderman Bolden moved, seconded by Alderman Elliott to approve the regular monthly report for August 2014. ADOPTION FEES/FINES $1,525.00 CONTRIBUTIONS 250.00 TOTALS $1,775.00 YARD WASTE In response to a question from Alderman Sansing, Public Works Director Jim Oakley related that they started transporting yard waste material the following Monday after the previous City Council meeting. He then answered that $5,000.00 was spent the first week to handle the material and he believes the second week will come in at around the same costs. He noted that around 40,000 yards are done annually at $ 5 . 0 0 per yard, which is approximately $200,000 annually. He then related that the large bearings were installed on the yard waste grinder but there is still some vibration in the machine. He added that there were other parts that were identified as damaged and they will be having those repaired. He stated that he hopes to have the machine completely repaired by next week. PLANNING COMMISSION: ORDINANCE 1516 (#9-2014) AN ORDINANCE RECLASSIFYING PROPERTY IN THE CITY OF JACKSONVILLE, ARKANSAS (GENERAL LOCATION: 109 DENNIS LANE) ; AMENDING ORDINANCE NOS. 213 AND 238 AND THE LAND USE MAP OF THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES. Alderman Ray moved, seconded by Alderman Sansing that Ordinance 1 5 1 6 be placed on FIRST READING. ROLL CALL: Alderman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, Robinson, and Howard v o t e d ' ~ ~ ~ . NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1 5 1 6 . City Engineer Whisker explained that the property was originally residential but had been rezoned to commercial for a computer business. He then related that the business has not be located there for some time and the new owner has requested that it be rezoned back to residential.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 18, 2014 7:00 P.M. - 7:19 P.M. Alderman Bolden moved, seconded by Alderman Sansing to APPROVE Ordinance 1516 on FIRST READING. Alderman Sansing moved, seconded by Alderman Robinson to suspend the rules and place Ordinance 1516 on SECOND READING. ROLL CALL: Alderman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, Robinson, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1516. Alderman Robinson moved, seconded by Alderman Sansing to further suspend the rules and place Ordinance 1516 on THIRD AND FINAL READING. Whereupon City Attorney Barnburg read the heading of Ordinance 1516. Alderman Ray moved, seconded by Alderman Bolden that Ordinance 1516 be APPROVED AND ADOPTED. ORDINANCE 1516 (#09-2014) APPROVED AND ADOTED THIS 1 8 ~ DAY~OF SEPTEMBER, 2014. GENERAL: Recognition of businesses regarding support of sister city delegation Mayor Fletcher related that a month ago, Jacksonville hosted a delegation from Kpando, Ghana including the Mother Queen, King, representative of the National Youth Organization that represents 6 million people, and the Mayor of Kpando. He stated that this was made possible through the generosity of local businesses who donated meals and hotel rooms. The following businesses were recognized with certificates for their contributions: Best Western, Chicken Country, Firehouse Subs, Chambers Drugs, Tropical Smoothie Cafe, Wendy's, BBQ Shack, and Golden Coral. b. DISCUSSION School Election He stated that Jacksonville and the outside the City areas in Pulaski and Lonoke came together to pass the school issue. He noted that it overwhelmingly passed with 95% approval, which has almost certainly never happen before. He stated that this is a chance for our communities to come together and tell the rest of the State that education is improvement our City. He stated that there is a process according to State law and currently we are in the process, but it is on its way. He related that the State is accepting applications until the end of this month for the interim school board. He stated that it will be a position that is held until the fall/September time frame.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 18, 2014 7:00 P.M. - 7:19 P.M. He went on to explain the importance of the position, saying that the interim school board will be laying some very serious groundwork that will be the basis of things to come. He stated that the Committee appointed by the State Board of Education to oversee the applications consists of Senator Eddie Joe Williams, Senator Jane English, Senator Linda Chesterfield, Representative Doug House, Representative Mark Perry, Justice of the Peace/State Representative elect Bob Johnson, and Mayor Fletcher. He stated that the process will continue through the month of October and recommendations will be made to the State Board of Education in November. He added that those recommendations will go through a certification process by the Board, which will take approximately 30 days . He then explained that the issue still has to go back to Federal court as part of the process. He related that the School Board will start the process of advertising for a Superintendant, adding that once the Superintendent is selected and his salary will be paid through the Pulaski County Special School District. He explained that this person will work with Dr. Guess, while the process will be finalized regarding separation of property. He stated that the State has estimated a 24 month time period for the process to complete itself. He stated that this is a great opportunity for the City and in many ways is a "game changer". He noted that beginning with a blank canvas is going to be better than trying to change an established district. He stated that we have an opportunity to model this right the first time. APPOINTMENT (S): ANNOUNCEMENT(S): Parks and Recreation Director Kevin House announced that FestiVille will be held next weekend at Dupree Park, adding that everything is in place. He noted that the event will feature carnival rides, stage entertainment for both stages, adding that there will be approximately 40 vendors for the event. He related that FestiVille shirts are on sale at the Community Center. Director of Administration Jim Durham related that through efforts with the City, County Collector Debra Buckner announced this morning that she would leave a County collector representative at the Jacksonville location. He noted that efforts to keep this available were achieved with some renovations to the building. He stated that the renovations will be completed by the end of the year and will maintain that presence in the City of Jacksonville. Mayor Fletcher noted that efforts between the State, County and City were able to keep this for the residents of Jacksonville.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 18, 2014 7:00 P.M. - 7:19 P.M. An election was subsequently held, at which time the qualified electors of the City voted in favor of the tax to be collected with those taxes collected in the year 2015. P~~rsuant to an amendment to the Arkansas Constitution, the taxes were rolled back to the levy of Three-tenths (3110) mill. However, the qualified electors of Jacksonville voted in favor of an increase in said millage rate to One (1) mill during a June 8, 1995, Special Election, called by Ordinance No. 1041 of April 6, 1995; WHEREAAS, Ordinance No. 173, dated May 19, 1966, called for a Special Election to determine the question of levying a tax of One-half (112) mill on all real and personal property within the City for the purpose of establishing and funding the Policemen's Pension and Relief Fund. An election was subsequently held, at which time the qualified electors of the City voted in favor of the tax to be collected with those taxes collected in the year 2015. Pursuant to an amendment to the Arkansas Constitution, the taxes were rolled back to the levy of Three-tenth (3110) mill. However, the qualified electors of Jacksonville voted in favor of an increase in said millage rate to One (1) mill during a June 8, 1995, Special Election, called for by Ordinance No. 1041 of April 6, 1995; and, ORDINANCE NO. 2527 (#I0 PAGE TWO - 2024) WHEREAS, Ordinance No. 1254, dated May 19, 2005, called for a Special Election to determine the question of levying a tax of One (1) mill on all real and personal property within the City for the acquisition, construction, and equipping of land and capital improvements for the City's public library. An election was SIJ bsequently held, at which time the qualified electors of the City voted in favor of the tax to be collected with those taxes collected in the year 2015. SECTION TWO: A tax of One (1) mill on each dollar of assessed valuation of all real and personal property within the City be and hereby is levied by the City Council to be collected with those taxes collected in the year 2015 for the purpose of funding the Policemen's Relief and Pension Fund. SECTION THREE A tax of One (1) mill on each dollar of assessed valuation of all real and personal property within the City be and hereby is levied by the City Council to be collected with those taxes collected in the year 2015 for the purpose of funding the acquisition, construction, and equipping of land and capital improvements for the City's Public Library. SECTION FOUR= A certified copy of this Ordinance shall be delivered to the County Clerk of Pulaski County, Arkansas, whose duty it shall be to levy and collect taxes according to the terms of this Ordinance. SECTION FIVE: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. ORDINANCE NO. 2527 (#I0 PAGE THREE - 2024) SECTION SIX: This Ordinance, necessary for the improvement of public facilities and the health, safety, and welfare of the citizens of Jacksonville, should be irr~plementedimmediately.
