REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on May 21, 2015 at the regular meeting place of the City Council. Alderman Bolden delivered the invocation and Mayor Fletcher led a standing audience in the "Pledge of Allegiance" to the flag. WATER DEPARTMENT : WASTEWATER DEPARTMENTS: FIRE DEPARTMENT: POLICE DEPARTMENT: SANITATION DEPARTMENT: PARKS & RECREATION: PLANNING COMMISSION: GENERAL: a. ORDINANCE 1529 (#9-2015) AN ORDINANCE AMENDING JMC 5 15.04 AND PROVIDING MODIFICATION OF THE FLOOD DAMAGE PREVENTION PROGRAM OF THE CITY OF JACKSONVILLE, DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. City Engineer Whisker related that the Ordinance will adopt the flood maps that were completed in 2007. He explained that the delay in time came as a result of Hurricanes Katrina and Rita, which brought about flooding issues regarding the levees for the Arkansas River. He noted that while these issues did not affect Jacksonville, it did affect Little Rock and North Little Rock. He stated that it then took seven years for everyone to be comfortable with the revisions, additionally there was advertising considerations which added another 6 months to 1 year. Alderman Elliott moved, seconded by Alderman Ray that Ordinance 1529 be placed on FIRST READING. ROLL CALL: Aldermen Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, Smith, and Howard voted AYE. NAY (0). Alderman McCleary abstained. MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1529. Alderman Ray moved, seconded by Alderman Bolden to APPROVE Ordinance 1529 on FIRST READING and suspend the rules and place Ordinance 1529 on SECOND READING. In response to a question from Alderman Traylor, City Engineer Whisker related that the new maps have affected 100 Jacksonville property owners. He stated that 50 owners who were in the flood plain are not out of the flood plain and 50 property owners that were not considered in the flood plain are now considered in the flood plain. He then answered that any building in the flood plain would need an elevation certificate to reduce the required flood insurance. He then added that the standards are going to a 2' freeboard instead of 1' , meaning that construction has to be 2' above the flood elevation. He then explained that adopting the Ordinance will put Jacksonville in line with Pulaski County and it will help the City to maintain its Class 8 rating, which means that anyone having to buy flood insurance will be able to get a 10% discount.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING MAY 21, 2015 7:00 P.M. - 8:02 P.M. He then answered Alderman Elliott, that Hurricanes Katrina and Rita were responsible for the increase in flood insurance rates. He explained that it is a self-sustaining insurance and Katrina and Rita depleted those funds. He noted that while increases were high it could have been even higher but the Government brought it down to a more reasonable number. He then cautioned that rates will continue to climb as they try to build the fund for flood victims. ROLL CALL: Alderman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, Smith, and Howard voted AYE. NAY (0). Alderman McCleary abstained. MOTION CARRIED. ORDINANCE 1529 (#9-2015) APPROVED AND ADOTED THIS 21ST DAY OF MAY, 2015. b. ORDINANCE 1530 (#lo-2015) AN ORDINANCE AUTHOR1 ZING THE MAYOR AND/OR HIS DESIGNATED REPRESENTATIVE TO JOIN AND PARTICIPATE IN THE PULASKI COUNTY ENERGY IMPROvXCMENT DISTRICT; DESIGNATING MAYOR GARY FLETCHER AS THE CITY OF JACKSONVILLE'S INITIAL REPRESENTATIVE ON SAID DISTRICT BOARD; AND, FOR OTHER PURPOSES. Mayor Fletcher related that he had met with County Judge Barry Hyde and the County's attorney Adam Fogelman, explaining that the PACE program allows businesses and property owners a new way of bringing their property up to energy efficient standards. He stated that while it is a new concept in the South, it is a proven program in the North. Mr. Adam Fogelman stated that the program has already been established, adding that the Ordinance will entitle Mayor Fletcher or his designee a seat on the County's Board.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING MAY 21, 2015 7:00 P.M. - 8:02 P.M. Whereupon City Attorney Bamburg read the heading of Ordinance 1530. Alderman Ray moved, seconded by Alderman Sansing to APPROVE Ordinance 1530 on FIRST READING and suspend the rules and place Ordinance 1530 on SECOND READING . Alderman Traylor clarified with Mr. Fogelman that funds are obtained on a loan basis, which is repaid through property taxes. Mr. Fogelman stated that it is only applicable to commercial and industrial properties. He explained that a property owner would make known their interest in participating in the program and an audit would be performed regarding energy use, and then proposals would be submitted to the property owner for energy improvements. He noted that these improvements could be anything that would improve energy efficiency, generate energy on sites through renewable generation or through water conservation or any combination of those three. He related that the qualifier for the project is that it has to save more money on an annual basis than the annual payment, thus being cash flow positive. He stated that the rules and regulations adopted by the Board will offer assurance to the Board that it continues to be cash flow positive for the life of the loan. Alderman Traylor questioned where the funds for the loans would come from, Mr. Fogelman stated that the PACE Board would have bonding authority, however; when the County's RFP goes out, they will be looking for a one-stop shop that is a turnkey operator that brings the day-to-day administration in along with private funding. He then assured the City Council that the City of Jacksonville would not have any financial or legal obligations. MOTION CARRIED.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING MAY 21, 2015 7:00 P.M. - 8:02 P.M. ORDINANCE 1530 (#lo-2015) APPROVED AND ADOTED THIS 21ST DAY OF MAY, 2015. c. SPECIAL PRESENTATION by Lieutenant Leo Foster honoring Robert (Bert) Laws Lieutenant Leo Foster recognized the family of Robert Laws; Hollie, Rhet, Landon, J.T., and Caleb. He then acknowledged the attendance of Mr. Ed Jaros and Wade Marshall from the Arkansas Professional Firefighters Association, along with Bill Plunk, Bill Baldridge and Craig Blazevich. He stated that it is his honor to present to the family of Robert Laws, the Martin E. Pierce Line of Duty Death Medal on behalf of the International Association of Firefighters and Local 2030. He stated that Captain Robert Laws served the citizens of Jacksonville at the Jacksonville Fire Department for 28 years with honored distinction. This dedication ultimately led to his death from occupational cancer. He related that Bert (as he was known to everyone) first contracted testicular cancer, a cancer that firefighters are twice as likely to develop. He then related that Bert later succumbed with cancer to the liver, a cancer that has strong ties to asbestos exposure and a toxic soup smoke that is a result of our modern manufacture materials in structure fires. He stated that on behalf of the City, the Local and International Associations, he would like to present a medal of honor as a token of appreciation to Captain Laws sacrifice regarding his service to the City of Jacksonville. Lieutenant Foster presented Hollie Laws, wife of Robert (Bert) Laws with the Martin E. Pierce Line of Duty Death Medal. Mayor Fletcher stated that his service to the City of Jacksonville is greatly appreciated and Bert is deeply missed. APPOINTMENTS: ANNOUNCMENTS: City Offices will be closed Monday, May 2 5 t 9 n observance of Memorial Day. Sanitation routes will run one day late. Splash Zone's anniversary is being celebrated tomorrow night beginning at 6:00 p.m. through 9:00 p.m. Parks and Recreation Director Kevin House added that the slides are free with a $5.00 admission. Mayor Fletcher stated that he appreciates the hard work of the Parks and Recreation Department, adding that Splash Zone has been an exemplary facility for other cities. He noted that improvement and expansion plans were discussed at the previous Council meeting. He stated that the facility is so popular that people are continually turn away once maximum attendance of 352 is achieved, saying that as it is expanded more children will be able to use the facility.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING MAY 21, 2015 7:00 P.M. - 8:02 P.M. He then announced that the Wally Hall Tournament will be held this weekend hosting 60 teams. He stated that he would make note that for the last three weekends there have been huge numbers of attendance at the Shooting Range around 1150 for the smallest tournament. Alderman Twitty announced that Jacksonville High School will host its graduation Friday, May 22, 2015. Said paperwork and records range from Twenty- three (23) to Ten (10) years old, and Arkansas law (ACA 514-59-114) allows destruction of records after Three (3) or Seven (7) years. Continued maintenance of said records and others of which electronic copies are maintained and preserved no longer serves the public good and is cost prohibitive; and, WHEREAS, Susan Davitt, City Clerk, as the official keeper of records for all City Departments, executed the appropriate and required Affidavit verifying need for destruction of said records.
