REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on June 18, 2015 at the reqular meeting place of the City Council. Alderman Howard delivered the invocation and Mayor Fletcher led a standing audience in the "Pledge of Allegiance" to the flag. ROLL CALL: Aldermen: Elliott, Sansing, Ray, Mashburn, Traylor, Smith, and Howard answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. PRESENT TEN (7), ABSENT (3). WATER DEPARTMENT: WASTEWATER DEPARTMENTS: FIRE DEPARTMENT: POLICE DEPARTMENT: PRESENTATION for JAG grant public comments welcomed Chief Boyd explained that the Bureau Justice Assistance is a federal program that assists state and local law enforcement with funds. He related that each year the Edward Byrne JAG Grant is made available and an agency is selected for the application process. He related that it is a non-matching grant, announcing that the Jacksonville Police Department was awarded $20,159.00. He explained that the Grant funds would be used to replace out of date tasers and purchase additional body cameras. In response to a question from Nlder~nanMashburn, Chief Boyd related that the Grant monies would not be enough to replace all the tasers. SANITATION DEPARTMENT: PARKS & RECREATION:  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JUNE 18, 2015 7:00 P.M. - 7:10 P.M. PLANNING COMMISSION: ORDINANCE 1531 (#11-2015) AN ORDINANCE MODIFYING THE JACKSONVILLE MUNICIPAL CODE 517.04.020 [JURISDICTION-SUBDIVISION REGULATIONS]; ADOPTING MODIFICATIONS TO THE CITYS'S EXTRA TERRITORIAL PLANNING JURISDICTION; AND, FOR OTHER PURPOSES. Alderman Kay moved, seconded by Alderman Mashburn that Ordinance 1531 be placed on FIRST READING. ROLL CALL: Aldermen Elliott, Bolden, Sansing, Ray, Mashburn, Traylor, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1531. City Attorney Bamburg related that formerly state law provided that cities have a five mile extra territorial jurisdiction; however that has recently changed to one mile, which is now mandated and observed by all cities. City Engineer Whisker demonstrated the ext.ra territorial jurisdiction area regarding the surrounding cities. He then answered that when two cities share the extra jurisdictional area, it is split equally. Alderman Kay moved, seconded by Alderman Bolden to APPROVE Ordinance 1531 on FIRST READING and suspend the rules and place Ordinance 1531 on SECOND READING. ROLL CALL: Alderman Elllott, Bolden, Sansing, Ray, Mashburn, Traylor, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1531. ORDINANCE 1531 (#11-2015) APPROVED AND ADOPTED THIS 18TH DAY OF JUNE, 2015 GENERAL: RESOLUTION 729 (#05-2015) A RESOLUTION AUTHORIZING THE CITY CLERK TO DESTROY SPECIFIED CITY DEPARTMENTAL RECORDS; AND, FOR OTHER PURPOSES. Alderman Ray moved, seconded by Alderman Elliott to read Resolution 729 (#05-2015) . MOTION CARRIED whereupon City Attorney Bamburg read the heading of Resolution 729 (#05-2015)  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JUNE 18, 2015 7:00 P.M. - 7:10 P.M. City Attorney Bamburg related that Resolution 729 is a standard housekeeping item of business, clarifying that this authorizes the City Clerk and staff to destroy old records no longer needed. He noted that a list of those records have been provided as part of the Resolution. Alderman Ray moved, seconded by Alderman Elliott to approve Resolution 729 (#05-2015) in its entirety. MOTION CARRIED. Mr. Floyd McMurtrey stated he represents the ASPCA and is a representative of the humane society of the United States of America. He related that lie has asked the City of Jacksonville not to euthanize animals. He then added that he has a big concern with the law enforcement and that he 1s being harassed. He said that law enforcement has cameras and is watchlng him 24 hours d day, adding that the City has a satellite that watches him. Mr. McMurtrey became inflamed and loud. Mayor Fletcher attempted to calm Mr. McMurtrey by assuring him the City did not have cameras or a satellite watching him. Mr. McMurtrey continued to raise his voice and argue with Mayor Fletcher. Police Officers escorted Mr. Floyd McMurtrey from the City Council Chamber and off City Hall property. Representatives of the City and the Water Department have negotiated satisfactory terms and conditions for Magellan's requested Easements and Use Agreements of certain real property owned by the City and the Water Department for installation, operation, and maintenance of their new petroleum products pipeline; and, WHEREAS, after consideration and negotiation, it is hereby found that it is in the best interests that the City and the Jacksonville Water Works enter into Agreements and subsequent Easements be approved for use of certain City property and Water Department property for installation, operation, and maintenance of Magellan's new petroleum products pipeline. Use of said property and Easements will not, as designed and planned, be destructive and/or hazardous to the City's property nor the aquifer that the Water Department's wells obtain water from for our public water system. NOW, THEREFORE, BE I T RESOL VED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARK4 NSAS, THAT: SECTION ONE= Approval and authority is hereby granted for Easements, in substantially the form shown on the attached drawings, between the City of Jacksonville and the Jacksonville Water Department and Magellan Pipeline Company, L.P. Upon recommendation and request by the Water Commission and the same by City officials and staff, execution of Agreements with Magellan regarding the terms and conditions upon which said Easements and Use of Property are granted that are, in the parties' involved respective opinions, favorable to the City, the Water Department, and are vital in continuing the mission of the United States Air Force as performed by the Little Rock Air Force Base. SECTION TWO: The Agreements and Easements, in substantially the form presented at the meeting at which this Resolution is addressed, are hereby approved, Resolution No. 730 (#06-2015) Page Two and the Mayor, the City Clerk, and the Chair of the Water Commission are requested and authorized to execute the Agreement and Easements on behalf of the City and the Jacksonville Water Works, with such changes as may be approved by Mayor Fletcher, Chair Peacock, and City Attorney Bamburg consistent with the Agreements and Easements as presented through this Resolution. SECTION THREE: Mayor Fletcher, City Clerk Davitt, and Chair Peacock of the Water Commission are hereby authorized to execute such documents and take such actions as may be appropriate to carry out the terms of this Resolution.
