REGULAR CITY COUNCIL MEETING - CITY HALL- #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on September 3, 2015 at the regular meeting place of the City Council. Alderman Bolden delivered the invocation and Mayor Fletcher led a standing audience in the "Pledge of Allegiance" to the flag. ROLL CALL: Aldermen: Elliott, Bolden, McCleary, Sansing, Ray, Traylor, Smith, and Howard answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. PRESENT EIGHT (8), ABSENT (2). PRESENTATION OF MINUTES: Mayor Fletcher presented the minutes of the regular City Council meeting of August 20, 2015 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Howard moved, seconded by Alderman Ray that the minutes of the regular City Council meeting of 6 August 2015 be APPROVED. MOTION CARRIED. MOTION CARRIED. WATER DEPARTMENT: WASTEWATER DEPARTMENTS:  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 3, 2015 7:00 P.M. - 7:14 P.M. FIRE DEPARTMENT:Presentation of Arkansas EMS Service of the Year Award Battalion Chief Dewey Coy explained that the Department was honored with the Arkansas EMS Service of the Year award on August 2, 2015 at the Arkansas EMT Association Conference in Hot Springs. He stated that the award is sponsored by the Arkansas Fire and EMS Society, adding that the intent of the Award is to recognize fire departments for services that have significantly contributed to the development and improvement of pre- hospital care and first response delivery. He emphasized that the eligibility requirements are to provide pre-hospital EMS through an organized fire department in the State of Arkansas; a written package regarding the department's accomplishments has to be submitted and validated that is judged by a five member panel. He mentioned that some of the crediting agencies that are followed are the Arkansas Department of Health, the International Fire Service Accreditation Congress, FEMA, the Arkansas Fire Academy, the National Fire Academy, as well as the National Association of EMS educators. He added that they also work with the Faulkner County Sheriff's Department regarding certification from Fire Marshall Williams and the Jacksonville Police Department. He related that the training over the last twelve months has resulted in 81 certifications for various members of the Fire Department; in addition, they have three members enrolled in either the Chief Officer or Executive Officer programs that are graduate level classes, and two members enrolled in various leadership schools, two members enrolled in nursing school, two members seeking State recommendation adjunct instructors for the State Fire Academy, five members enrolled in college for professional development, and one member enrolled in arson investigation course. He added that training and education plants the seed for success and is taken very seriously. Fire Chief Laughy added that as with any organization, the only way you can have success is with proper training, certification, and education that plants a seed and makes it possible to do anything that you need to do. He related that in his 26 years in the fire service it is his experience that approximately 90% of citizens with a complaint will make a call and only 10 to 20% of people who have a compliment will take time to write or make a call. He stated he is proud to announce that in the past twelve months, the Fire Department has a 2-1 ratio of people calling to compliment rather than criticize. He thanked the City Council and Mayor for their support. POLICE DEPARTMENT : STREET DEPARTMENT : SANITATION DEPARTMENT: PARKS & RECREATION: Update FestiVille Report Parks and Recreation Proqram Specialist Supervisor Dana Rozenski explained that the ~esti~ill-e is approximately one month away, being set for October 2nd and 3rd at Dupree Park. She stated that some activities are the same as last year; adding that one new element is that they were able to get the BBQ competition sanctioned through Memphis.  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 3, 2015 7:00 P.M. - 7:14 P.M. Mayor Fletcher pointed out that 3 or 4 years ago the festival was put on by an organization that decided it was too much work and it is a lot of work. He added that the planning for the next year is actually started shortly after FestiVille takes place. He related that one year the City went without a festival, pointing out that most cities have festivals as a way to promote and celebrate community. He stated that Parks and Recreation stepped up to take on the responsibility of the FestiVille, which was added to their daily jobs. He stated that they have performed great and he would like to take this opportunity to thank everyone responsible for ensuring that this event is as successful as it is. He confirmed with Supervisor Rozenski that approximately 8 to 10 thousand people attended last year and the first year there was 500. PLANNING COMMISSION: GENERAL: RESOLUTION 731 (#07-2015) A RESOLUTION APPROVING AND GRANTING AUTHORIZATION TO MAYOR FLETCHER AND CITY CLERK DAVITT FOR APPROVAL OF CERTAIN DOCUMENTS TO TRANSFER CERTAIN PROPERTY OWNED BY THE CITY OF JACKSONVILLE, FOR CERTAIN PROPERTY OWNED BY D & D REAL ESTATE RENTAL, INC. IN THE CITY; AND, FOR OTHER PURPOSES Alderman Elliott moved, seconded by Alderman Bolden to read Resolution . 731 (#2-2015) MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Resolution 731 (#07-2015). Mayor Fletcher explained that the City was offered an abandoned house by the Bank that owned it, pointing out that a goal of the City has been to obtain properties surrounding Galloway Park so that Park could be enlarged and opened up regarding Park safety for the Sunnyside residents. He stated that this was approved by the committee and it will provide another lot for Galloway Park. Alderman Ray moved, seconded by Alderman McCleary to approve the adoption of Resolution 731 (#07-2015) in its entirety. MOTION CARRIED. APPOINTMENTS: PLANNING COMMISSION Alderman Elliott moved, seconded by Alderman Bolden to approve the appointment of Patrick Thomas to fill the unexpired term of Joe Ott for a term to expire 1/01/2018. Whereas, Ritter Communications Holdings, Inc., through its subsidiaries, who will, if approved, provide fiber optic cable and electronic transmission communication services to certain areas of Jacksonville, is willing to pay a franchise fee for the privilege of providing said services and utilizing the City's public Rights-of-way. SECTION TWO: Franchisee, Ritter Communications Holdings, Inc., and its subsidiaries, agrees to pay City a Four and One-Quarter Percent (4.25 %) annual Franchise Fee since installationof their lines and equipment in City Rights of Way effective August 1,2015, and throughout the term of the franchise period in exchange for the use and benefit of City's Rights-of-way for their fiber optics, cable, digital corrrmunication, and networking and data management systems. Said payments shall be calculated based on all monies (Gross Revenues) received by Franchisee from its fiber optics cable and communications system for transmission to business and residential customers' cable, corr~munications,data, internet, and networking services and systems, together with subscr'iber interaction required for the selection and use of such services within the City. Ordinsnce No 1533 (#I3 Page Two - 2015) SECTION THREE: Franchisee, Ritter Comm~~nications Holdings, Inc., and its subsidiaries, agrees to pay City a Four and 25/100 Percent (4.2S0/0) annual Franchise Fee since installation of their lines and equipment in City Rights of Way effective August 1, 2015, and through the term of the franchise period in exchange for the use and benefit of City's Rights-of-way for their telecommunication services. Said payments shall be calculated based on all monies (Gross Revenues) received by Franchisee from its communications system for transmission to business and residential customers' telecommunications services and systems, together with subscriber interaction req~~ired for the selection and use of said services within the City. SECTION FOUR: The term of this franchise shall be for a period up to and including December 31,2020, together with options to renew said franchise for Four (4) periods of Five (5) years each at the discretion of City and Franchisee. This franchise may be renewed in accordance with proper procedures as contain in 47 USC 5 546, which is incorporated herein by reference, and the Mayor and City Clerk are hereby authorized to execute a Franchise Agreement containing like terms and conditions after approval of the City Attorney as to such form and terms. SECTION FIVE: All other terms and conditions as outlined in the parties' Franchise Agreement not specifically modified herein shall cor~tinuein full force and effect as if restated herein word for word. SECTION SIX: Should any section, clause, or provision of this Ordinance or the Franchise Agreement pursuant thereto be declared invalid by a Court of competent jurisdiction, such a ruling shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so declared invalid.
