CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 15, 2018 7:00 P.M. – 7:15 P.M. REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on February 15, 2018 at the regular meeting place of the City Council. Councilman Bolden delivered the invocation and Mayor Fletcher led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Councilman: Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Collins answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. Councilman Smith was absent. PRESENT NINE (9) ABSENT (1). Others present for the meeting were: City Attorney Robert Bamburg, Finance Director Cheryl Erkel, Fire Chief Alan Laughy, City Engineer Jay Whisker, Public Works Director Jim Oakley, Professional Administrative Consultant Geoffrey Herweg, IT Director Scott Rothlisberger, Parks and Recreation Director Kevin House, CDBG Director Theresa Watson, Planning Commissioner Patrick Thomas, Jeannie Herweg, Rick Kron, Ken Hawk, interested citizens, and members of the press. PRESENTATION OF MINUTES: Mayor Fletcher presented the minutes of the regular City Council meeting of February 1, 2018 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Councilman Bolden moved, seconded by Councilman Ray that the minutes of the regularly City Council meeting of 1 January 2018 be APPROVED. MOTION CARRIED. REGULAR MONTHLY REPORT/POLICE DEPARTMENT Councilman Ray moved, seconded by Councilman Bolden to approve the regular monthly report for January 2018 regarding annual crime statistical comparisons. REGULAR MONTHLY REPORT/FIRE DEPARTMENT Alderman Ray moved, seconded by Alderman Bolden to approve the regular monthly report for January 2018 from the Jacksonville Fire Department, reflecting a fire loss of $51,500.00 and a savings total of $543,500.00. REGULAR MONTHLY REPORT/ENGINEERING DEPARTMENT Councilman Ray moved, seconded by Councilman Bolden to approve the regular monthly report for January 2018. PERMITS/LICENSE ISSUED INSPECTIONS PERFORMED Building Permits 6 Building Inspections 31 Business License 7 Electrical 16 Plumbing 31 HVACR 10 REGULAR MONTH REPORT/ANIMAL CONTROL Alderman Ray moved, seconded by Alderman Bolden to approve the regular monthly report for January 2018. WATER DEPARTMENT: WASTEWATER DEPARTMENTS: FIRE DEPARTMENT: POLICE DEPARTMENT: STREET DEPARTMENT: SANITATION DEPARTMENT: PARKS & RECREATION: SPECIAL RECOGNITION Mayor Fletcher introduced Mr. Ken Hawk, the new SSSA State Director. Mr. Hawk related that this year’s Midwest Divisional Complex of the Year Award goes to Dupree Park in Jacksonville. Parks and Recreation Director Kevin House recognized employees James Freeman and Daniel Goossen for their contributions to the Parks success. 2  CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 15, 2018 7:00 P.M. – 7:15 P.M. Mr. Hawk explained that the competition for this award covers 13 states going out as far as New Mexico and down to parts of Florida. He related that last year, Dupree Park hosted over 39 different brackets; they had almost 500 out of town teams that came in, probably 7 to 10 thousand people coming into town. He noted that there will be a tournament in two weeks and last year it brought in 70 teams for 3 nights. He stated they really enjoyed Dupree ballpark and planned to return. The City Council commended the Parks and Recreation staff for their level of excellence and commitment to the programs. Mayor Fletcher then announced that another special recognition goes to the Finance Department in receiving again this year, the Certificate of Achievement in Financial Reporting. He noted that the City has received this Award every year since 1998. He related there are 17 grading categories, adding there are 14 entities in Arkansas that received this award and 7 of those were cities. He noted the cities to receive this award were Bentonville, Fayetteville, Fort Smith, Hot Springs, Jacksonville, Little Rock, and Texarkana. He related this is the 14th consecutive year the City has received this award. He recognized the City’s Directors and staff for exceptional standards. PLANNING COMMISSION: FINAL PLAT Kum & Go City Engineer Whisker presented the Final Plat located at the nose of West Main Street, noting that it includes all the properties excluding Popeye’s. He stated that a bond for improvements requested by the City has been posted. He added that there is a Resolution to complete the process as far as the City and then it will be on Kum & Go’s building schedule. Mr. David Robert Feibagg, site development manager for Kum & Go, stated that with this approval they hope to acquire the property in March. He then related that demolition will begin once the other tenants are relocated, he surmised it would be in the May/June time frame. He then added that hopefully it will be open by Christmas. He related they appreciate the City, adding that the City has been very accommodating. He then answered Mayor Fletcher that this store is going to be the new larger prototype store, which is approximately 6400 square feet. Councilman McCleary moved, seconded by Councilman Bolden to accept the Final Plat of the Kum & Go Addition. MOTION CARRIED. GENERAL: a. ORDINANCE 1581 (#03-2018) AN ORDINANCE AMEDNDING ORDINANCE NO. 1575(#11-2017), FILED AS PULASKI COUNTY CIRCUIT CLERK INSTRUMENT NO. 2017074521; RELEASING A LIEN; AND, FOR OTHER PURPOSES. Councilman Ray moved, seconded by Councilman Twitty to place Ordinance 1581 on FIRST READING. ROLL CALL: Councilman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Collins voted AYE. MOTION CARRIED. Councilman Bolden moved, seconded by Councilman Sansing to APPROVE Ordinance 1581 on FIRST READING and SUSPEND the rules and place Ordinance 1581 on SECOND READING. ROLL CALL: Councilman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1581. Councilman Twitty moved, seconded by Councilman Bolden to further suspend the rules and place Ordinance 1581 on THIRD AND FINAL READING. ROLL CALL: Councilman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1581. Councilman Twitty moved, seconded by Councilman Bolden that Ordinance 1581 be APPROVED AND ADOPTED. ROLL CALL: Councilmen Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Collins voted AYE. MOTION CARRIED. ORDINANCE 1581 (#03-2018) APPROVED AND ADOPTED THIS 15th DAY OF FEBRUARY, 2018. b. RESOLUTION 764 (#01-2018) A RESOLUTION APPROVING AND GRANTING AUTHORIZATION TO MAYOR FLETCHER AND OTHER OFFICIALS FOR THE TRANSFER OF CERTAIN REAL PROPERTY DESCRIBED HEREIN (GENERAL LOCATION: 1501 WEST MAIN, JACKSONVILLE, ARKANSAS); AND, FOR OTHER PURPOSES. Councilman Ray moved, seconded by Councilman McCleary to read Resolution 764 (#01-2018). City Engineer Whisker explained that this is the second part regarding items for Kum & Go, noting that there is an area on West Main that has additional asphalt that did not conform to the 60’ right-of-way. He said there is actually an extra 10’ involved and this Resolution will give that additional right-of-way back to Kum & Go, so the City will have less right-of-way to deal with regarding asphalt. He then stated this would conform with the 60’ right-of-way that the City has everywhere else. He added that Kum & Go will get additional property the City does not need, so Kum & Go can add additional landscaping for their property. City Attorney Bamburg reminded the City Council that any transfer of property has to be authorized by the City Council for the Mayor, City Clerk, and himself to sign and complete the paperwork. At this time, MOTION CARRIED. Councilman Ray moved, seconded by Councilman Bolden to approve Resolution 764 (#01-2018) in its entirety. MOTION CARRIED. APPOINTMENTS: ANNOUNCMENTS: City offices will be closed Monday, February 19, 2018 in observance of President’s Day. Sanitation routes will run one day late. Father/Daughter Banquet will be held Saturday, February 17th at the Community Center beginning at 5:00 p.m. ADJOURNMENT: Without objection, Mayor Fletcher adjourned the meeting at approximately 7:15 p.m. MOTION CARRIED.
