Finance & Legal Committee Building, Planning & Zoning Committee Civic Center & Promotion Committee May 23, 2023, 4:00 PM Present: Heinrich, Kamlitz, Steele, Schloegel, Geroux, Hellekson, Blackmore, Blinsky, Fosse, Michel, Reuther, Stroh and Sveum. FINANCE & LEGAL COMMITTEE Chair Heinrich convened the meeting at 4:00 p.m. Kamlitz moved to recommend the City Council approve and authorize the City Administrator to enter into an underwriter Agreement with Colliers Securities LLC, for the issuance of improvement warrants for $4,370,000 Refunding Improvement Bonds of Series AG 2023 (Paving District 22-41 and Paving District 23- 41), and to schedule the sale at the August 7, 2023, City Council meeting. Seconded by Schloegel. Unanimous aye vote. Carried. Chair Heinrich announced that hearing from the public relative to XLT Taxicab service has been moved to the Police & Fire Committee meeting on Thursday, May 25, 2023, at 4:00 p.m. Steele moved to recommend the City Council direct the City Attorney to draft a purchase agreement for the property described as Jamestown Southwest 2nd Addition Outlot A in the amount of $445,000 plus closing costs and the unpaid specials assessments of approximately $29,000 to be paid from the City Sales Tax Fund and authorize the City Administrator and Mayor to sign the agreement. Seconded by Kamlitz. Unanimous aye vote. Carried. Steele moved to forward to the June 2023 Finance and Legal agenda an ordinance for fire protection within the City limits for areas serviced by other entities, address access and regulation of hydrants. Seconded by Schloegel. Unanimous aye vote. Carried. Buchanan moved to forward to the City Council meeting on June 5, 2023, without recommendation, the request from Central Sales, Inc. to enter into a license agreement to locate a stormwater pond in the right of way located on the Jamestown Southwest Second Addition with the NE ¼ Section 3, T139, R64W. Seconded by Kamlitz. Public Works Director Michel and Assistant City Attorney Geroux provided information. Unanimous aye vote. Carried. Schloegel moved to recommend the City Council approve the Special Use Permit for a Compassion Center Dispensary as required under City Code Appendix C, Sec. 12, from July 1, 2023, to June 30, 2024. Seconded by Steele. Unanimous aye vote. Carried. Kamlitz moved to recommend the City Council approve the request from Oviatt LLC DBA Corner Bar for a permit to conduct street dances on Saturday, June 10, 2023, and on Saturday, July 22, 2023, on 2nd St SW from 1st Ave S westward to the alley. Seconded by Steele. Council Member Steele requested staff clean up the application. Assistance Chief Blinsky stated the music must stop at midnight and the street remains closed until 2:00 a.m. for safety reasons. Unanimous aye vote. Carried. Kamlitz moved to recommend the City Council approve the request from Jamestown Hockey Boosters for site authorization to conduct gaming at Wilson Arena located on University of Jamestown campus for October 1, 2023, through February 29, 2024. Seconded by Schloegel. Unanimous aye vote. Carried. Kamlitz moved to recommend the City Council approve the request from Jamestown Hockey Boosters for a site authorization to conduct gaming at the Gladstone Inn on Friday, February 2, 2024, and Saturday, February 3, 2024. Seconded by Steele. Unanimous aye vote. Carried. Steele moved to recommend the City Council approve the request from The Cure Starts Now – ND Chapter to be recognized as an other public spirited organization and to authorize the issuance of a 2023 raffle permit. Seconded by Schloegel. Unanimous aye vote. Carried. Chair Heinrich led a discussion on the upcoming changes to the Renaissance Zone incentives that begin August 1, 2023. Steele moved to forward to the June 2023 Finance and Legal agenda changes to the Renaissance Zone incentives that begin August 1, 2023. Seconded by Kamlitz. Unanimous aye vote. Carried. Chair Heinrich adjourned the meeting at 4:29 p.m. BUILDING, PLANNING & ZONING COMMITTEE Chair Kamlitz convened and adjourned the meeting at 4:29 p.m. as there were no items for discussion. CIVIC CENTER AND PROMOTION COMMITTEE Chair Schloegel convened the meeting at 4:30 p.m. Kamlitz moved to recommend the City Council approve the SCEP (State Community Energy Programs) EECBG (Energy Efficiency and Conservation Block Grant) grant application and authorize the City Administrator and Mayor to sign the application. Seconded by Heinrich. Unanimous aye vote. Carried. Sara Hegerle, Jamestown High School head volleyball coach, addressed the committee members regarding the potential of having volleyball courts for the Civic Center. Civic Center Director Fosse provided information. Hegerle will work with Fosse. No action was taken. Chair Schloegel adjourned the meeting at 4:50 p.m. Sarah Hellekson, City Administrator
