JESSUP BOROUGH COUNCIL REGULAR MEETING MINUTES June 4, 2025, at 7:00 PM The regular monthly meeting of Jessup Borough Council was held on Wednesday, June 4, 2025, at 7:00 p.m. in the Jessup Borough Building, 395 Lane Street, Jessup, PA 18434. The following business was transacted. Pledge of allegiance to the flag was given. Call to Order: Meeting was called to order at 7:00 p.m. by Council President, Roberta Galati Roll Call: Present 6 Absent 1 Gregg Betti Tom Fiorelli Curt Camoni Roberta Galati Jerry Crinella Joe Mellado - Absent Jeffrey Castellani Consent Agenda: A motion was made by Gregg Betti second by Jerry Crinella to approve the Minutes of the Regular Meeting on May 7, 2025. Aye carried. (6-0) A motion was made by Jerry Crinella second by Gregg Betti to approve the Secretary Report. Aye carried. (6-0) A motion was made by Gregg Betti second by Jeff Castellani to approve the May Payroll in the amount of $ 66,685.15. Aye carried. (6-0) A motion was made by Gregg Betti second by Jerry Crinella to approve monthly payments from the general fund in the amount of $125,772.66. Aye carried. (6-0) A motion was made by Tom Fiorelli second by Gregg Betti to approve payments from the capital improvements account in the amount of $19,025.00. Aye carried. (6-0) Old Business: Community Vision Plan Reports: Mayor Buckshon reported May was a great month in Jessup. It started with the Wine Tasting at Station Park that included wine vendors and local restaurants and ended with St. Ubaldo. He thanked the Police Department and DPW for all of their hard work. On June 14 th there will be community yard sales. The July 5th Celebration is right around the corner as is out first National Night Out on August 9th. Zoning Hearing Board Chairperson: Jeff Smith reported the noise at Kearney Steel was horrible. He reached out to the attorney again. Controller: Benjamin Cardoni gave an overview of the Borough’s finances for the month. Tax Collector: Genevieve Lupini reported she collected $10,242.11 for the month of May. Zoning Officer: Anthony Mengoni reported that he is still waiting on the Magistrate for dates regarding 3 properties he filed complaints against. Police Chief: Chief Derek Fozard discuss his after action report he held with the Hose Company and the St. Ubaldo Society after the festivities. Calls for the month were 547. That was up 66 calls from the previous month. He reported he is in the process of addressing abandoned vehicles throughout the Borough. There are 18 on the list. Kost Tire donated LED stop signs for the Borough Crossing Guards. National Night Out T-Shirt sale is going on. They can be ordered online. DWP: Tyler Havrilak gave a report on the work DPW has done throughout the Borough this past month. Solicitor: Maura Armezzani Tunis reported she heard from the Planning Commission and they will be holding a special meeting on June 9th. She was in contact with H.R.G. but she still has not received a quote from them for services related to the zoning amendment. June 11 th at 6:00 p.m. there will be a public hearing regarding the zoning amendment. Lackawanna County Planning Commission will meet June 12th. Borough Manager: Coleen Watt reported the food drive wrapped up and she thanked all who participated. The Dodge dump truck is in need of a transmission. The cost is $12,000.00. She will call for additional prices. Lawler Drive paving is complete. Lawn restoration will take place as soon as the weather cooperates. 924 Constitution Ave restoration is completed. The Church Street manhole project is to begin June 23rd. Roberta Galati thanked the police, DPW, Jen and Coleen for all they did leading up to the week long festivities related to St. Ubaldo and the parade. Tom Fiorelli thanked everyone for all they did for St. Ubaldo festivities. Public Comment: Bill Muchal thanked Council, the police department and DPW for all they did for Hose Company #2 during the carnival. Ben Cardoni is concerned about parking at the bank. He is curious as to the liability on the Borough and suggested park at your own risk signs be installed. Angela Muchal noted Citizens for a Healthy Jessup held a cleanup after the carnival and they will hold another one at Memorial Field after the July 5th celebration. There is a large pile of dirt on the corner of Ellen and Palmer. PPL had a contractor do work in the spring and they never came back. Melissa Maus is concerned with the condition of her driveway after the project that was done on Lawler Drive. Genevieve Lupini stated the site of the future data center will be in her backyard and she hopes Council does their due diligence, so this does not drain our power. She asked if it is possible for the Borough to partner with Jessup 21st Century for a grant. Sabrina Shander said the road project on Jessup Ave. is a disaster. There are dips, ruts and rocks in the roadway where the construction took place. She voiced her concerns regarding noise coming from the recent Hose Company #2 Carnival. Moving forward she asked that Council consider amending the noise ordinance and she feels the bands should shut down an hour earlier than this year. She 100% supports the Hose Company. She also has concerns about people parking on Saxon and Vass the night of the parade. It causes gridlock in that area. She suggests closing the road until after the parade. Jeff Smith asked why the grant writer for the Hose Company doesn’t include their fee in the grant. He noted Citizens for a Healthy Jessup are very successful at writing grants and urged the Hose Company to reach out. He said he remembers the Olga Street stormwater project coming before the stormwater committee. He has a lot of concerns about data centers and suggests the Borough reach out to communities in Virginia. A. Motion to distribute the 2025 Fire Company Disbursements to Hose Company #1 and Hose Company #2. Each Company is to receive $40,000.00. A motion was made by Jerry Crinella second by Jeff Castellani. Aye carried. (6-0) B. Motion to authorize a press release in conjunction with Senator Brown and Representative Mullins regarding the $125,000.00 Jessup Borough received from the State Treasury from an uncashed check. A motion was made by Curt Camoni. Motion died for lack of a second. C. Motion to retain ____ for planning services to revise the Jessup Borough Zoning Ordinance. A motion was made by Gregg Betti second by Curt Camoni to table. Aye carried. (6-0) D. Motion to advertise for bids to pave Jessup Avenue from 109 to the intersection of Hudson Street. A motion was made by Gregg Betti second by Jeff Castellani. Aye carried. (6-0) E. Motion to approve licensing for Movies Under the Stars in the amount of $1,350.00. A motion was made by Jerry Crinella second by Tom Fiorelli. Aye carried. (6-0) F. Motion to adopt Ordinance 2 of 2025 amending the Jessup Borough Rental Registration Ordinance. A motion was made by Curt Camoni second by Gregg Betti. Aye carried, (6- 0) G. Motion to allocate $3,000.00 for a grant writer for Hose Company #2 to help them secure grant funding for a new truck. A motion was made by Jerry Crinella second by Gregg Betti. Aye carried (6-0) H. Motion to adopt Resolution No. 11 of 2025 authorizing an application for a Flood Mitigation Program Grant in the amount of $453,466.50 to be used for Flood Mitigation on Hill Street/Constitution Avenue. A motion was made by Gregg Betti second by Jerry Crinella to table. Aye carried. (6-0) I. Motion to adopt Resolution No. 12 of 2025 authorizing an application for a Flood Mitigation Program Grant in the amount of $208,607.85 to be used for Flood Mitigation on Lawler and Mary Jo Drives. A motion was made by Gregg Betti second by Jerry Crinella to table. Aye carried. (6-0) J. Motion to reinvest up to $137,016.62 in a treasury security that matures on or about March 31, 2026 to continue the ladder investment at People’s Security Bank and Trust Company. A motion was made by Gregg Betti second by Tom Fiorelli. Aye carried. (6-0) K. Motion to adopt Resolution No. 13 of 2025 creating alternate members of the Jessup Borough Planning Commission and appointing Corey Mahon as an alternate member. A motion was made by Jerry Crinella second by Gregg Betti to amend the motion to read Resolution No. 11 of 2025. Aye carried. (6-0) Motion to adopt Resolution No. 11 of 2025 creating alternate members of the Jessup Borough Planning Commission and appointing Corey Mahon as an alternate member. A motion was made by Curt Camoni second by Gregg Betti. Aye carried. (6-0) L. Motion to appoint Steve Pitoniak to the Jessup Borough Planning Commission. Motion to hire Timothy Long as an independent contracted Emergency Medical Technical at a rate of $17.00 per hour and subject to signing the Independent Contractors Agreement. Jessup Borough Project Update May 22, 2025 2022 (Remaining Projects) 3272-22-12 Ball Fields – JYSA • We recommend holding off on final payment of retained funds until 70% coverage is achieved for the lawn restoration and rain garden repairs and also reduce all of the expenses needed to obtain compliance. Ms. Maura Armezzani Tunis, Borough Solicitor is aware of our recommendation. • There has been a drainage issue with a section of the impervious pavement that was clogged with topsoil during the lawn restoration by Kobalt Construction. They are working on resolving this issue and have scheduled to have the sediment vacuumed out of the pavement for the last week of May. • The Borough will need to occasionally have this service performed as a maintenance item to maintain working order of the pervious pavement. • Mr. Dennis Peters, Borough Engineer, advised Kobalt Construction to install an inlet and pipe to the existing French drain to the west of the concrete sidewalk and along the curb at its lowest elevation. No response has been received from Kobalt. 3272-22-16 Lackawanna County Office of Community Development. Borough Restrooms, ADA, Automatic Door, Status of Plans, Etc. • As requested, we sent a follow up email to the contractor, Sean Byrne Construction asking for an update regarding the status of having the glass repaired. Sean Byrne Construction stated they would follow up with the glass subcontractor, Scranton Glass, and that they have asked for a price to replace the glass. • The two-year warranty bond is held with Lackawanna County. • Mr. Joseph Rovinsky of Lackawanna County has followed up with Sean Byrne Construction, requesting they be aggressive in resolving the issue, advised that the glass has been ordered but has a long lead time. Sean Byrne Construction is assuming the cost of replacing the glass, as the stress cracks are not covered under the supplier warranty. 3272-22-34 Constitution Avenue Stormwater Separation Project (Morgan Street, Ferdinand Street and Flynn Street/Tony Ligi Stormwater Project) • COVID-19 grant funding in the amount of $151,000.00 was received. • Survey work completed and permitting, contract documents and plans are complete • A PA DEP Chapter 105 permit application response letter was received on March 10, 2025. An extension has been provided by PA DEP, making the deadline July 8, 2025. • We are awaiting approval from the Lackawanna Conservation District for resubmission of this permit application. • The review of the submission package was completed by the subcontracted Engineer, as required by PA DEP. • We expect a 90–120-day review period, based upon recent PA DEP and Lackawanna Conservation District submissions. • The easements needed for the project were sent to Ms. Coleen Watt, Borough Manager, and Ms. Maura Armezzani Tunis, Borough Solicitor, on May 12, 2025 for processing. Jessup Borough Project Update May 22, 2025 3272-22-43 Multimodal Transportation Fund - Hill Street Sidewalks • The Borough received PennDOT Transportation Alternatives Set-Aside (TASA) grant funds in the amount of $1,277,655.00 for this project. • The grant contract was received by our office on April 16, 2025 for inclusion into the contract documents, plans, and HOP application. • Project Meetings will be held bi-monthly with the PennDOT Project Manager, Ms. April Hannon. The next meeting is scheduled for June 23, 2025. • A Scoping Meeting is scheduled for June 10, 2025 at 8:00 A.M. onsite. • Survey work has been completed and we are preparing plans for the PennDOT HOP submission based on the grant information received as of April 16, 2025, which required DM-3 compliance and individual driveway permits per PennDOT requirements. 3272-22-61 Olga Street Stormwater Installation Project • Borough received $126,908.00 from the COVID-19 grant. • Bids were received and the Borough voted to award the project to Maiocco Excavating, Inc. in the amount of $184,960.00. • The proposed pipeline was moved by our office due to marked PA American Water lines and UGI gas lines in the way of construction not matching the plans provided during the Design Phase PA One Call. • All submittals provided by Contractor and approved. • The Notice to Proceed was issued on May 16, 2025, with a start date of May 26, 2025. 2023 (Remaining Projects) 3272-23-11 Jessup Crossings Senior Housing Development • This matter is being handled by Ms. Maura Armezzani Tunis, Borough Solicitor. • Inspection report from PA DEP was received on March 7, 2025, which stated no violations were observed, however, the entire site was stripped and proposed stormwater facilities shown on the plans were never installed. 3272-23-20 St. Ubaldo Society- Chapel Renovation Project • Bids were received and the Borough voted to award the project to H&P Construction, with a bid of $51,855.00 with removal of items 3, 4, and 9 from the bid schedule. • A Change Order was received from the contractor on May 15, 2025 for item 8 on the bid schedule, providing a credit of $1,682.00, as there was no exact replacement available for the columns. The closest replacement includes a collar that will extend off the existing porch. Instead of replacing the columns, they will fix and paint the existing. The new contract cost is $50,173.00, if approved. Submittals received from H&P Construction include items for the Stone and Concrete Work. • The proposed Change Order and submittals are rejected and we have requested the contractor to supply shop drawings of the new columns, El Dorado stone samples, and concrete coating alternatives for review. • Anticipated Notice to Proceed date of June 2, 2025 after the St. Ubaldo Society festivities are completed. Jessup Borough Project Update May 22, 2025 3272-23-42 Mary Jo Drive Sewer Line Replacement Project • COVID-19 grant funding in the amount of $213,000.00 was received. • Project awarded to Pioneer Construction Company, Inc. in the amount of $374,300.00. • Notice of Substantial Completion was issued. Contractor to provide the Consent of Surety for Final Payment and Release, two-year Maintenance Bond and As-Built plans. • Contractor advised on May 12, 2025 that their paving crew has had delays due to weather to complete the remaining items, and plan to be onsite the week of May 19, 2025. The lawn restoration will be completed prior to paving or at the same time as paving. • As of this date, no onsite paving or lawn restoration has been started. 2024 (Remaining Projects) 3272-24-11 Sanitary Sewer Repair of Church St. between Grassy Island Ave and Upper Front St. • Borough voted to award the manhole replacement/installation portion of the project to Snyder Environmental Services, Inc. in the amount of $113,621.25 and the sliplining portion to InfraHorse in the amount of $49,557.00. • PennDOT Traffic Control Supplement was approved on May 16, 2025. • Contractor at Snyder Environmental Services, Inc. was instructed on May 16, 2025 to provide a start date as soon as possible. • As soon as the manhole replacement/installation portion of the project is completed by Snyder Environmental Services, Inc., sliplining of the sewer lines will be completed by InfraHorse. • We received PennDOT approval of the barrier/end treatment/flaggers at each manhole during construction. We are obtaining traffic control pricing per PennDOT approval. Contractor wants to install manholes the second week of June with estimated timeline of four days. 3272-24-15 Stormwater Replacement – Constitution Ave/Hill Street to the Lackawanna River • Meeting on site with Ms. Coleen Watt, Borough Manager, PennDOT, Mr. Joe Cirba, DPW Foreman and Mr. Dennis Peters, Borough Engineer, was held on March 4, 2025 in order to complete dye testing and determine where the inlets within the project limits discharge to. This information was used to complete the design of the project. • We are working on obtaining a PA DEP Chapter 105 permit for the project for the proposed outfall structure into the Lackawanna River. • Per discussion at the March Stormwater Committee meeting, the Stormwater Committee expressed that we should proceed with completing the entire project at once, and would like to look into additional grant funding. • We are preparing a PennDOT Traffic Control Plan for a HOP at present. Jessup Borough Project Update May 22, 2025 3272-24-20 Emergency HOP - Sewer Line Repair at 940 Constitution Ave • PennDOT permit was obtained and provided to the contractor and Borough. • Contractor will notify PennDOT at least three days in advance of the final paving. • The permanent pavement has been completed, and as of May 15, 2025 the sidewalk work in the Right of Way is the only outstanding item. • Once all work is completed and found to be satisfactory by PennDOT, we will closeout the PennDOT permit. 2025 Projects 3272-25-1 Kids Korner – ADA Restroom Installation • A formal letter of request for a time extension of use of the 2020 CDBG funds was submitted to Lackawanna County for consideration. • Contract documents and plans are being prepared currently for a restroom at the northeast corner of Kids Korner. • A field survey was completed on Wednesday, May 21, 2025. • Contract Documents and plans are being prepared. • The County is conducting an environmental audit. 3272-25-2 Floodplain Manager – NFIP • FEMA National Flood Insurance Program (NFIP) form was completed by our office and provided to Ms. Coleen Watt, Borough Manager, for submission to FEMA. • FEMA provided a report outlining some violations which need to be addressed. Per Ms. Coleen Watt, Borough Manager, we are to address the violations. Majority of the violations pertain to new structures being built in the floodway. • A call with Ms. Coleen Watt, Borough Manager and Mr. Dennis Peters, Borough Engineer was held on April 24, 2025 at 8:00A.M. to discuss issues in the Borough raised by EPA at the March Meeting. • Our office is awaiting mapping from FEMA and a follow up call as needed with FEMA. 3272-25-3 Sarah Bratty Park - CDBG Funds - ADA Improvements • Borough wants to use CDBG funds towards ADA improvements at this park, including ADA entrance and ADA playground equipment. • Mr. Dennis Peters, Borough Engineer met with Ms. Coleen Watt, Borough Manager on April 8th to discuss the project. • Ms. Maura Armezzani Tunis, Borough Solicitor provided the Agreement of Sale between the Borough and the Helcoskis. • Project description, cost estimate and activity description for this project was sent to Mr. Joseph Rovinsky at Lackawanna County for use of CDBG funds. • The County hearing for CDBG funding was held May 16, 2025. This will then go to the State level for review, approval, and any changes. • We surveyed the site on Wednesday, May 21, 2025. • We are preparing contract documents and plans. • The County is to conduct and environmental audit. Lackawanna County is conducting an income survey of these areas to confirm eligibility for use of CDBG funds. These surveys were held the weeks of May 12, 2025 and May 19, 2025. If eligible, project descriptions, cost estimate and activity descriptions will be drafted for the eligible streets. • A Teams Meeting has been scheduled regarding the detention basin by lot 16C of the Industrial Park for May 27, 2025 at 1:00 P.M. with Mr. Patrick McLane of KSG Engineering and Ms. Coleen Watt, Borough Manager. Consultation on-going with Borough Manager, Assistant Borough Manager, Borough Solicitor and Borough Council Members on items listed above and other additional on-going projects.
