City of OS hua MINUTES ctry couNctL WORK SESSION REGULAR SESSION THURSDAY, FEBRUARY 21, 2019 6:30 PM City Council Present: Joe Hollarn, Mayor; Rick DePriest, Place 1; Mike Kidd, Place 2; Sharlotta Connally, Place 3; Robert Purdom, Place 4; Jerry Moore, Mayor Pro-Tem; and Scott Kimble, Place 6. City Council Absent None City Staff Present Josh Jones, City Manager; Terry Welch, City Attorney; and Lisa Dawn Cabrera, City Secretary. A. CALL TO ORDER AND ANNOUNCE A QUORUM PRESENT Mayor Hollarn called the meeting to order at 6:43 pm. B. INVOCATION Councilman Kimble performed the invocation. C. PLEDGE OF ALLEGIANCE Councilman Kidd led the pledges of allegiance. D. WORK SESSION 1 Review and discuss status of FY 2015-2019 Strategic PIan including review of policy action items, management action items, and activities last month. (Staff Resource: J. Jones) No discussion was held concerning the strategic plan. 2. Review, discuss and update of S-Year Strategic Plan. (Staff Resource: J. Jones) A brief discussion was held concerning the strategic plan update concerning the notes from last month and the SWOT analysis notes. 3. Review and discuss S-Year Capital lmprovement Plan. (Staff Resource: J. Jones) A short discussion was held regarding the CIP plan concerning the assessment of the plan with possible bond election to be held in November. 4. Review and discuss questions related to the budget report and financial statement for January 2019. (Staff Resource: J. Jones) No discussion was held concerning the financial statements. 5. Questions regarding Regular Session agenda items. No questions were posed to the staff concerning the regular session items. 6. Requests for future reports and agenda items. Requests for a possible ordinance revision for beekeeping and a request for an update of the issues discussed during the Animal Control Advisory Board meetings. E, REGULAR SESSIO Mayor Hollarn called the Regular Session to order at 6:55 pm F, PUBLIC FORUM Ricardo De Los Santos, 204 Roaring Springs, Joshua, TX addressed the members of the Council regarding partnering with the Joshua ISD to establish a swim team. Glen Walden, 201 Trailwood, Joshua, TX addressed the members of the Council regarding beekeeping. No one else wished to address the members of the Council. G NSENTAGEN 1. Approval of minutes from the meetings dated January 17,2019. Councilman Kimble made a motion to approve the minutes as presented, seconded by Mayor Pro-Tem Moore. Motion passed without objection. H. REPORTS& ACTION ITEMS FROM THE PLANNI NG & ZONING MMISS toN Mayor Hollarn opened the public hearing at7:O2 pm. 1 Case # PZ 2019-01 to conduct a public hearing to receive citizen's comments regarding an amendment to Ordinance No. 450-2008 being a Planned Development of Residential Town Homes. The property is commonly known as 531 Cooper Lane and the legal description being Lots 1-51, Block 1 of the Joshua Crossing Addition in the City of Joshua, Johnson County, Texas as requested by Tom Mitchell. (Staff Resource: J. Jones) a. Staff Presentation Mr. Jones gave the members of the Council a brief description of the amendment request. b. Owner'sPresentation Marcela Olsen, 500 W. 7th Street, Fort Worth, TX addressed the members of the Council with a brief overview of the request. c. Those in Favor No one wished to speak for the request d. Those Against Crystal Lysek, 547 Cooper Lane, Joshua, TX addressed the members of the Council against the request. Kenny Robinson, 1005 Yvonne Drive, Joshua, TX addressed the members of the Council against the request. David Albaugh, 705 W Sheila Circle, Joshua, TX addressed the members of the Council against the request. No one else wished to speak against the request. e. Owner's Rebuttal Ms. Olsen presented the members of the Commission with a short rebuttal. Mayor Hollam closed the Public Hearing at7:22 pm. 2 Discuss, consider and take action on Ordinance No. 739-2019 being an Ordinance of the City Council of the City of Joshua, Texas, amending Ordinance No- 450-2008, the Zoning Ordinance and the Zoning Map relative to the Planned Development Zoning on approximately 6 acres out of the McKinney and Williams Survey, Abstract No. 636, City of Joshua, By changing "Residential Townhomes" to "Multifamily Quadraplexes and/or veftical duplexes" throughout; making findings relative thereto; providing a severability clause; providing for publication; providing for a penalty; and providing for an effective date. (Staff Resource: J. Jones) A lengthy discussion was held concerning Ordinance No. 739-2019 being original floor plans submitted, property being platted, sidewalks on Cooper, fencing, activity center size, pool size, fence on property line, landscaping options, and traffic study. Mayor Hollarn recessed into to Executive Session to obtain advice from the City Attorney at 7:50 pm. Mayor Hollarn called the Regular Session to order at B:22 pm. Mayor Pro-Tem made the following motion, seconded by Councilwoman Connally: I move to approve Ordinance No. 739-2019, as reflected in the agenda packet, with the additional requirements: 1. An activity center of no less than 2,000 square feet shall be constructed on the property and an adjoining pool to sufficiently accommodate the residents of the development. Approval of the activity center and pool construction plans by the City shall be required. 2. Bradford pears as reflected on the Landscape Plan shall be replaced with a species to be approved by the City administratively. 3. A 4-foot wide concrete sidewalk shall be constructed on the subject property adjacent to Cooper Lane. 4. Bollards shall be placed along the property line where Palo Duro Drive abuts the subject property. 5. ln addition to the fencing currently reflected in the plans, a 4-foot tubular steel fence shall be constructed along Cooper Lane, with the sidewalk to be located between the tubular steel fencing and the roadway. 6. The quadraplex units shall be constructed of complementary masonry products to reflect a diversity of colors and products. 7. The attached Landscape Plan shall be amended to include additional landscaping at the property entrances, around individual quadraplex units and parking areas. Landscaping enhancements may be approved administratively by the City. Additionally, the density should reflect 15.8 units per acre for a total of 100 units. Motion passed with a vote of six (6) to one (1) with Councilman DePriest voting nay. t. GENERAL ACTI ON ITEMS 1 . Discuss, consider and take action on Resolution No. 2019-01 being a Resolution of the city council of the city of Joshua, Texas to express its opposition to legislative interference with local services, local revenue, and local control. (staff Resource: J. Jones) A short discussion was held concerning the Resolution regarding s82 and H82, rollback rate vs values vs collections, and unfunded mandates. councilman Purdom made a motion to approve Resolution with the addition of adding unfunded mandates to the document, seconded by Councilwoman Connally. Motion passed without objection. 2 Discuss, consider and take action on Ordinance No. 740-2019 being an Ordinance of the City Council of the City of Joshua, Texas, adding Article 8.08, "Habitual Criminal Properties," to Chapter 8, "Offenses and Nuisances," of the Code of Ordinances of the City of Joshua, Texas; amending Appendix A, "Fee Schedule" of the Joshua Code of Ordinances adding certain fees in Article 44.000, "Miscellaneous Permits and Fees"; providing that this ordinance shall be cumulative of all ordinances; providing a severability clause; providing for a penalty for violations hereof; providing a savings clause; providing for publication in the official newspaper; and providing an effective date. (Staff Resource: S. Short) A brief discussion was held concerning the ordinance regarding false alarm properties and other cities with similar ordinances. Councilman Purdom made a motion to approve Ordinance No.740-2019, seconded by Councilman Kimble. Motion passed unanimously. 3. DiscuSS, consider and take action to authorize the use of General Fund Reserves to purchase EMS equipment for Fire Department. (Staff Resource: J. Jones) A short discussion was held concerning this item regarding the CIP plan, interlocal with Burleson, equipment has six (6) year life remaining, and possible savings in funds. Councilwoman Connally made a motion to approve if necessary, seconded by Councilman Kimble. Motion passed with no opposition. 4. Discuss, consider and take action regarding the 2018 Racial Profiling Report. (staff Resource: S. Short) Councilman Kimble made a motion to accept the 2018 Racial Profiling Report, seconded by Councilman Kidd. Motion passed with no objection.
