MINUTES OF THE REGULAR MEETING OF THE JURUPA VALLEY CITY COUNCIL December 3, 2020 The meeting was held at the Jurupa Valley City Council Chamber, 8930 Limonite Avenue, Jurupa Valley, CA 1. 7:00 P.M. - CALL TO ORDER AND ROLL CALL FOR REGULAR SESSION ● Anthony Kelly, Jr., Mayor ● Lorena Barajas, Mayor Pro Tem ● Chris Barajas, Council Member ● Brian Berkson, Council Member ● Micheal Goodland, Council Member Mayor Kelly called the regular meeting to order at 7:03 p.m. Council Member Brian Berkson participated via teleconference. 2. INVOCATION was given by Pastor Jeremy Williams, Grace Fellowship Church. 3. PLEDGE OF ALLEGIANCE was led by Council Member Chris Barajas. 4. INTRODUCTION AND PRESENTATION BY JULIE BANK, DIRECTOR OF RIVERSIDE COUNTY DEPARTMENT OF ANIMAL SERVICES Julie Bank, Director of Riverside County Department of Animal Services gave a brief presentation the County’s Animal Services Department. She introduced the inaugural Pet of the Month, “Bonnie,” a 6 year-old black and brown shepherd mix. Her ID # is: 1576562. Ms. Bank provided information on a new program that is grant funded that is called the “Healthy Pet Zone.” This new program provides services and resources to individuals in need. She encouraged anyone that needs this type of assistance or is looking to adopt an animal to visit their website at: https://www.rcdas.org -1- 6. PUBLIC APPEARANCE/COMMENTS Spencer Rogers spoke on behalf of the Jurupa Valley Vendors Association, a newly formed group of legal vendors operating within the city who are concerned about the proliferation of illegal food vendors throughout the City. Mr. Spencer asked the Council to address this issue as it is unfairly impacting the legal vendors that are properly licensed. Mayor Kelly asked City Manager Rod Butler to look into this issue. Colin Markovich, representing Assemblymember Sabrina Cervantes reported that the California Department of Tax and Fee Administration (CDTFA) has begun accepting applications for the Small Business Tax Credit. Applications will be processed on a first- come, first-served basis through January 15, 2021. Small businesses can apply by visiting the CDTFA website at: www.cdtfa.ca.gov Mr. Markovich gave an update on transportation grant funding for various transportation projects. In advance of the new legislative year, their office is collecting input from the community for future legislation. Further information is available at their office at (951) 371-6860. 7. INTRODUCTIONS, ACKNOWLEDGEMENTS, COUNCIL COMMENTS AND ANNOUNCEMENTS Mayor Anthony Kelly provided comments regarding the ongoing COVID-19 pandemic. He encouraged residents to continue to practice social distancing and to wear a facemask as it keep everyone safe. He announced a fire incident near the Agua Mansa corridor and asked City Manager Rod Butler to provide an update on the containment status. Mayor Pro Tem Lorena Barajas commended the City’s Code Enforcement staff for their efforts especially with the illegal truck yards and helping to clear homeless encampments that are a safety hazard. Council Member Micheal Goodland welcomed everyone to tonight’s meeting. He urged everyone to be safe and to continue to pray for the end of the coronavirus. Council Member Brian Berkson urged residents to be safe especially while driving during the busy Christmas season. 8. CITY COUNCIL MEMBER ORAL/WRITTEN REPORTS REGARDING REGIONAL BOARDS AND COMMISSIONS A. MAYOR ANTHONY KELLY, JR. 1. Mayor Kelly gave an update on the Interagency Coordinating Council meeting of November 20, 2020. 2. Mayor Kelly gave an update on the Riverside Transit Agency meeting of December 2, 2020. -2-  B. COUNCIL MEMBER BRIAN BERKSON 1. Council Member Brian Berkson gave an update on the Riverside County Transportation Commission - Western Riverside County Programs and Projects Committee meeting of November 23, 2020. 9. CITY MANAGER’S UPDATE City Manager Rod Butler reported that effective tomorrow, City Hall is going back to a by- appointment-only process at City Hall for the next month as some employees and consultants tested positive for the coronavirus over the past several weeks. In order to keep employees and customers safe, he encouraged citizens to do as much as they can online instead of visiting City Hall. He noted that this situation will be reevaluated in mid- January. Mr. Butler announced that this year’s Holiday Open House has been cancelled; however, visitors may still enjoy walking or driving by City Hall to enjoy the holiday decor and lighted Christmas tree. 10. APPROVAL OF MINUTES A. NOVEMBER 19, 2020 REGULAR MEETING A motion was made by Council Member Micheal Goodland, seconded by Mayor Pro Tem Lorena Barajas, to approve the Minutes of the November 19, 2020 regular meeting. COUNCIL APPROVAL OF A MOTION TO WAIVE THE READING OF THE TEXT OF ALL ORDINANCES AND RESOLUTIONS INCLUDED IN THE AGENDA Requested Action: That the City Council waive the reading of the text of all ordinances and resolutions included in the agenda. B. CONSIDERATION OF CHECK REGISTER IN THE AMOUNT OF $3,416,004.92 Requested Action: That the City Council ratify the check registers dated October 29 and November 5, 12, and 19, 2020 as well as the payroll registers dated October 30, 31, and November 13, 2020. -3- C. APPROVAL OF THE AMENDED APPENDIX TO THE CITY OF JURUPA VALLEY’S CONFLICT OF INTEREST CODE Requested Action: That the City Council approve the amended Appendix to the City’s Conflict of Interest Code and adopt Resolution No. 2020-87, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JURUPA VALLEY, CALIFORNIA APPROVING AND ADOPTING AN AMENDED APPENDIX TO THE CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF 1974 D. APPROVAL OF AN AGREEMENT WITH T & B PLANNING, INC. FOR THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT FOR THE “MANITOU COURT LOGISTICS CENTER” PROJECT; (CASE NUMBER: MA20004); (APPLICANT: BRE SPACE MIRA LOMA LLC) 1. Requested Action: That the City Council approve the Agreement for Consulting Services with T & B Planning, Inc. for the completion of an Environmental Impact Report (EIR) for the proposed Manitou Court Logistics Center in an amount not to exceed $209,795.80 to be funded entirely by an advance deposit made by BRE Space Mira Loma, LLC, the “applicant,” sufficient to cover completion of the EIR document; and 2. That the City Council authorize the City Manager to sign the Agreement on the City Council’s behalf. E. ADOPTION OF A RESOLUTION RECONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY AND IMPOSING ADDITIONAL REGULATIONS DUE TO THE COVID-19 (CORONAVIRUS) PANDEMIC Requested Action: That the City Council adopt Resolution No. 2020-88, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JURUPA VALLEY, CALIFORNIA, RECONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY RELATING TO THE COVID-19 VIRUS PANDEMIC AND IMPOSING ADDITIONAL REGULATIONS TO DEAL WITH THE COVID-19 PANDEMIC A motion was made by Mayor Pro Tem Lorena Barajas, seconded by Council Member Micheal Goodland, to approve the Consent Calendar. CONSIDERATION OF ANY ITEMS REMOVED FROM THE CONSENT CALENDAR 13. PUBLIC HEARINGS 14. COUNCIL BUSINESS A. INITIATION OF A STUDY TO REVISE ZONING CODE DEVELOPMENT STANDARDS TO ACHIEVE CONSISTENCY WITH THE GENERAL PLAN AND STATE LAW PERTAINING TO EMERGENCY SHELTERS FOR PEOPLE EXPERIENCING HOMELESSNESS Tamara Campbell, Principal Planner, presented the staff report. Further discussion followed. A motion was made by Council Member Chris Barajas, seconded by Council Member Micheal Goodland, to initiate a study to revise Jurupa Valley Zoning Ordinance Sections 9.145.050.K(e) and 9.145.050(k) to establish a homeless shelter parking requirement of one space per employee or volunteer; eliminate the prohibition of or modify the operation of an emergency shelter within any distance of an airport; and add new Sections to reflect new state law, pertaining to, among other things, the factors the City uses to assess the need for an emergency shelter and establish that low barrier navigation centers are allowed “by right” if certain requirements are met. This action will result in consistency between the zoning code and the General Plan in addition to bringing the City into compliance with State Law. A roll-call vote was taken. Roll-Call: Ayes: C.
