COMMITTEE OF THE WHOLE
A meeting of the Committee of the Whole was called to order by Chair Penterman on Tuesday,
January 6, 2026, at 6:30 P.M.
Members present: Antoine, DeCoster, Eggleston, Kilgas, Moore, Schell, Schumacher, and Thiele.
Also present: Mayor Penterman, Attorney Greenwood, DPW/Eng. Neumeier, Fire Chief Carrel,
HR Director Hodge, Police Chief Graff, Fin. Dir. Van Rossum, Mark. and Com.
Manager Fencl, Associate Planner Nelson (Zoom), and interested citizens.
1. Correspondence – none.
2. Discussion Topics.
a. Clarification on the definition of voting and non-voting capabilities for an ex-officio member.
Attorney Greenwood led a discussion on the clarification of the definition of voting and non-voting
capabilities for an ex-officio member. Greenwood went over what an ex officio member means. Ex
officio has been often misunderstood to mean non-voting. Unless non-voting is included in an
ordinance, ex-officio members have the right to vote. Greenwood pointed out several spots in
Kaukauna’s ordinance that call out ex-officio members. One of the ordinances states that the
mayor is an ex-officio member of all standing committees and the board of public works, which
implies he is a voting member. Greenwood’s recommendation was to clarify ordinances under
each standing committee if ex-officio members are voting or non-voting. Attorney Greenwood will
bring proposed changes to the Legislative committee.
b. Clarification on current meeting procedures.
Attorney Greenwood led a discussion on clarification of current meeting procedures. Alder
Antoine asked for a discussion on this due to changing and inconsistent practices. Attorney
Greenwood will continue to do research on what future procedures should be.
3. Adjourn.
Motion made by Moore, seconded by DeCoster to adjourn.
All members voted aye.
Motion carried.
