Minutes of a Special Meeting of the Mayor and Council, held on the above date in the Council
Chambers, Municipal Complex, 70 West Front Street, Keyport, N.J. pursuant to being called by the
Mayor and Borough Council, notice on file with the Borough Clerk, forwarded to the Asbury Park
Press, Courier, Independent, the Newark Star Ledger and Two River Times, and posted on the
Bulletin Board in accordance with the Open Public Meetings Act, P.L. 1975, Ch. 231
Mayor Bergen called the meeting to order at 7:07PM. and Borough Clerk read the Sunshine Law
Notice. The Pledge of Allegiance was said and there was a moment of silence.
ROLL CALL
On Roll Call the following were present: Councilmembers Gross, Sefcik, Bolte, Sheridan, McPeek,
Mayor Bergen. Others Borough Administrator Ms. Wright Absent: Councilmember Kovacs
DISCUSSION
Administrative matters relating to the operation of the Police Department including various personnel
matters
Mayor asked Lt. Casaletto’s legal authority to not honor Council’s appointment. Lt. Casaletto read
Police Chief’s Bill of Rights. Feels Council can pay an appointed Sergeant but Police Chief assigns
him.
Joe Ruth stated that Lt. Casaletto’s answer could lead to disciplinary action and that he should have
legal representation.
Discussion ensued regarding Officer Sorber and his performance.
Ms. Bolte asked what is in Officer Sorber’s file that Council doesn’t know. Want to know how we
have a sub-standard Officer employed for 20 years? Lt. Casaletto feels he can’t discuss that without
Officer Sorber present.
Mayor asked whether Lt. Casaletto approved Officer Sorber to go on the trip with the Police
Explorers. Lt. Casaletto said yes it was approved before he was told to cut down on comp time. Lt.
Casaletto did approve three days.
Mayor read grievance memo from Officer Sorber to Lt. Casaletto. Lt. Casaletto believes the
Grievance is based on comp time. The Mayor disagreed.
Ms. Bolte stated that the council never said there would be no more comp time. Mayor spoke of the
Fair Labor Standards Act in regards to comp time and overtime. Lt. Gallo stated that the department
does not allow comp time if it creates overtime.
Mayor asked Lt. Gallo if he wants his portion in open session or closed session. He stated he would
have it in open session.
Mayor spoke of Lt. Gallo approaching a Councilmember with a disagreement. Gallo, Aumack and Ely
were volunteering at Field Day and Gallo approached Councilwoman Bolte in a way she felt was
intimidating. Ms. Bolte stated she does not feel comfortable speaking to Lt. Gallo without someone
else present. Councilwoman Bolte stated that Lt. Gallo said no one on Council respects the Police
Department except for Councilman Gross.
Lt. Gallo spoke of previous charges against him and how he never received discovery. Mayor asked
if he would like a hearing scheduled at this point; Lt. Gallo said “yes.”
At 9:06pm Lt. Casaletto, Lt. Gallo and others left the Council room.
Council went into Closed Session at 9:06 P.M. and this meeting was reconvened at 9:52 P.M.

The meeting was opened to the public for comments or questions at 9:52 P.M. moved by Mr.
Sheridan, second by Ms. Sefcik with ayes by all present
There being no comments or questions from the public the meeting was closed at 9:52 PM
ADJOURNMENT
Motion to adjourn was made and carried with ayes by all present at 9:53 PM.
