BOROUGH OF KEYPORT REGULAR MEETING MINUTES TUESDAY, JUNE 25, 2024 7:00 PM CALL TO ORDER: 7:00 PM SUNSHINE LAW NOTICE: Read by Municipal Clerk Minutes of the Regular Meeting of the Mayor and Council, Borough of Keyport, held on the above date in Borough Hall Council Chambers, Keyport, NJ, pursuant to the Annual Notice on file with the Borough Clerk forwarded to the Asbury Park Press, and Newark Star Ledger and posted on the Bulletin Board in accordance with the Open Public Meetings Act, P.L.1975, c.231. AUMACK Administered by Mayor Araneo COMMITTEE REPORTS (Councilmember is lead or co-lead liaison of Committees in bold) Councilmember Brady: Environmental, Recreation/Senior Center, Fire/First Aid/OEM, Municipal Alliance, Green Team  Environmental Commission – there was no May meeting; unable to attend June meeting; next meeting is July 22nd.  Recreation – the Food Truck Festival was a success with about 5,400 attendees; the next one will be August 31st and Jamfam (organizer) will be making small changes. The recreation award was given out to two graduating students. Upcoming events include Keyport Day at the Lakewood Blue Claws on August 17th, summer movies which just began, and Mr. Scott the Music Man at the Mini-Park at 10am June 29th. The next meeting will be Monday, July 1st. The committee is always looking for volunteers. Councilmember Gross: KBBC, Public Works/Water-Sewer, Recreation/Senior Center, Redevelopment  Public Works – recent infrastructure repairs include boat ramp dredging, sewer repairs, cleaning up Borough Hall space including restriping the parking lot, water valve repair. Provided support for the Juneteenth and Woofstock events.  KBBC – unable to attend the meeting this month; upcoming events include the Keyport Car Show June 27th and Swifty dance party July 11th. Councilmember McNamara: Finance/Grants, Cannabis, Green Team, Police, NPP  Finance and Grants – defer to Borough Engineer who will discuss Monmouth County Open Space and DOT grants.  Cannabis – KGNJ has decided to continue litigation.  Green Team – workshop meeting tomorrow at 6pm on the next creature topic, oysters. Councilmember Peperoni: Planning Board, Recycling, Health/Registrar/Construction/Fire Bureau/Code Enforcement/Zoning, Redevelopment, Harbor Commission June 25, 2024 Keyport, NJ Page 2 of 9 Councilmember Reilly: Fire/First Aid/OEM, Police, Municipal Alliance, Finance/Grants, Cannabis  First Aid – runs to date in 2024 total 783 runs.  Police – in May there were 1,205 calls for service; this month through June 22nd there’ve been 882 calls for service. Recent officer training includes Officer Leonard completing gangs, firearms, and narcotics training. Participating in the Goal Zero initiative to confront rising traffic deaths, including the April 25th Goal Zero detail which entailed 66 officers from 32 Monmouth County municipalities, resulting in 3 arrests, 510 traffic stops, and 325 summons issued.  No Fire Department report. Council President Vecchio: Harbor Commission, NPP, Public Works/Water-Sewer  Harbor Commission – dredging at the ramp was completed by Neptune Township and thanked members of the Harbor Commission and borough; no-wake barrels are placed along the State channel from boat ramp to Matawan Creek and the federal channel from the boat ramp through Keyport Yacht Club anchorage; thanked Nancy Smalling.  NPP – last meeting included a walk-through of Beach Park; resolution for purchase of playground equipment was approved and anticipating installation in early September; and waiting for plans from Borough Engineer to confirm concrete and fencing plans. Mayor Araneo: Library, Planning Board, KBBC, Green Team, Cultural/Civic, Mayors Wellness Campaign  Library – new library door has been installed; the new boiler failed; library parking only sign was taken down; summer reading program adventure began with a kick-off block party; permitted to put up a story walk on Henry Hudson Trail for Once Upon a Book by Grace Lin and Kate Messner.  KBBC – summer events started; car show coming up; Woofstock had a huge turnout; Swifty dance party on the bay will be July 11th with a female impersonator performing; Borough Engineer reached out to Green Acres about erecting a sign by the Mini Park to advertise events on the waterfront, which is awaiting approval; there are two vacancies on KBBC for businesses and will be voting for Vice President and Treasurer due to officer resignations.  Pride celebration – thanked Councilmembers Brady and McNamara for coordinating the pride flag being displayed at the Gazebo.  Juneteenth celebration – June 15th event was well-attended; unveiled plaque.  NPP – flood gates must be kept for five years pursuant to the grant agreement and there are no places to store them.  Post office – no update. The Borough Attorney is preparing a letter to send to the lessee.  Utility pole cleanup remains the same. The Borough is reporting issues and citizens can as well.  No Aeromarine cleanup update.  Henry Hudson Trail cleanup – Monmouth County has begun cleanup but some areas are private property where homeowners chose to take no action.  First Street four-way stops – update will be provided by the Borough Engineer.  Fire hydrants – replaced at Maple Place and Route 35, Broad Street hydrant replacement is pending; Madison Street hydrant is being replaced under a claim. Borough Engineer updates  Four-way stops – submitted applications to the county for four locations, of which two were approved, at Green Grove and Second and Green Grove and Third. The county responded in a letter about performing a study for Atlantic and Broad and cannot move forward with those intersections at this time. Additional requests concerning those intersections should be directed to the county, which would review or perform any additional studies.  Church Street – concrete marked out with the contractor.  Tap grant, pedestrian improvement project for First Street, West Front Street, and Broadway, plans were submitted to DOT on April 12th, waiting on comments before going out to bid; FY2016 project with federal funding. June 25, 2024 Keyport, NJ Page 3 of 9  Cedar Street Park, phase one – all paperwork in place from county, $240,000 in Monmouth County open space grant funds; will be going out to bid.  Preconstruction meeting held regarding Broadway sanitary sewer repairs, between Aberdeen and Route 35.  Performing NJ DEP MS4 stormwater mapping, required to be done by January 1, 2026; have a $25,000 DEP grant for this work.  Beach Park pavilion – waiting CDBG award  Cass Street – received information from zoning and reviewing it. PUBLIC HEARING – Monmouth County Open Space Grant Application – Cedar Street Park Improvements The Meeting was opened to the Public for comments on the submission of a Monmouth County Open Space Grant Application for the Cedar Street Park Improvements Project Opened: 7:24 PM Motion by Vecchio, Carried by Brady. Ayes by all present. The Borough Engineer summarized the grant application and reiterated that there is $240,000 in matching Monmouth County open space grant funds. The grant included basketball courts, tennis courts, additional play features, parking lot, and sidewalks. Originally didn’t include a softball field in the original application but it needs work; recommending submission of a phase two application for $100,000 from county open space funds. A resolution with council approval would need to accompany the grant application. John Merla, 34 Broad Street – asked about pickle ball, which the Borough Engineer mentioned is eligible to be included. Asked about the box that stores school equipment and finding a permanent location for equipment storage; the Mayor noted that council approved the box being located there. Commended the engineer. Mike Lane, 51 First Street – echoed Mr. Merla and applauded the project. Stated the environmental concerns about the outfall pipe on the beach being dangerous and a risk for kids. Elmer J. Graham Jr., 22 St. Peters Place – praised the project; will help our borough considerably. Robert Bergen, 16 Green Grove Ave. – asked about the anticipated cost, to which the Borough Engineer responded it fits within the grant amount. Closed: 7:30 PM Motion by Reilly, Carried by McNamara. Resolution #2024-207 Authorizing Grant from Monmouth County Planning Board for the 2024 Park Improvement Project MM: Vecchio 2nd: Reilly Roll Call: Ayes: Brady, Gross, McNamara, Reilly, Vecchio Nays: Absent: Peperoni Abstain: Mayor Araneo asked if any councilmembers had questions or concerns about the Consent Agenda. Councilmember McNamara asked for R2024-174 to be voted on separately. Asked about R2024-222 liquor license renewal, to which the Borough Clerk explained the license. Asked about R2024-227 given the title of Assistant Zoning Officer isn’t codified in existing code, and who R2024-228 applies to, which the Borough Attorney responded. Councilmember Brady asked about R2024-224, to which the Borough Administrator responded. Councilmember Vecchio asked about salaries related to positions, to which the Borough Administrator responded. June 25, 2024 Keyport, NJ Page 4 of 9 Councilmember McNamara asked for clarification about the introduction of the ordinance concerning zoning. The Borough Administrator replied. Councilmember Reilly added that she understood it that this particular situation would be reviewed within 60 days. Councilmember McNamara asked to amend R2024-227 to provide for a temporary 60-day appointment. Councilmember McNamara asked about the payment of bills, and specifically about engineering bills from both Colliers and CME for 31 West Front Street, to which the Borough Administrator and Borough Engineer responded about the bills which are for different purposes. Councilmember McNamara reiterated her request to vote on R2024-174 separate from the rest of the Consent Agenda. Council President Vecchio asked to vote on R2024-225 separate from the rest of the Consent Agenda because she will abstain. Motion to pull R2024-174 and R2024-225 from the Consent Agenda for separate consideration. Opened: 7:51 PM Motion by Vecchio, Carried by Gross. Ayes by all present. George Walling – noted that the building doors were locked, and the Mayor replied she discussed this with the Police Captain again about the timing of unlocking the doors. Declared having an issue with Mr. Murphy, who resigned March 5, 2019, and Mr. Mulcahy was appointed as a replacement at the next meeting before Mr. Murphy came back and didn’t apply because he apparently hadn’t resigned; requested this be investigated further by council. Robert Bergen – asked if the Borough is filling positions that are not yet created in the borough, and are they created properly. The Borough Administrator confirmed that room was made in the budget because we foresaw there may be some changes that need to happen. Mike Lane – asked about R2024-226, noting that Trevor Taylor, Borough Engineer, is outstanding, but asked if he would have office hours as the zoning officer in Borough Hall. The Borough Administrator responded that an email and phone extension have been created and the Zoning Officer will make himself available. Noted that CME’s Matt Zwingraf and about 12 neighbors worked hard to keep Benjamin Terry Park from being sold to developers for midrises on the waterfront. Seems a violation for the Borough Administrator to be working with the Zoning Officer because in other towns they don’t work with zoning officers. Asked about the borough management responsibility of liquor licenses under R2024-222 and pocket licenses. The Borough Attorney clarified that pocket licenses are not on this agenda and everything is in accordance with State law. Asked about the agreement under R2024-213, to which the Borough Attorney provided a summary. Asked about the road improvements included in the grant application under R2024-216, which the Borough Engineer noted the recommendation of West Second from Broadway to Washington; Mayor Araneo asked that the resolution be updated to include the specifics about the roadway improvements. John Merla – commented that disclosing the terms and conditions of a bargaining agreement publicly, R2024-213, was a major mistake. Commented on R2024-174 since it was from May and hoped that questions were asked. Asked about who conducted the interviews for the recreation leader appointed in R2024-229, to which the Borough Administrator stated she did and invited the Recreation Committee; applauded the appointment, who was highly recommended in Union Beach. June 25, 2024 Keyport, NJ Page 5 of 9 Elmer J. Graham Jr. – Asked about R2024-208, which Councilmember McNamara explained it was a tax abatement for an improvement. Asked about the electronic tax sale in R2024-217, and the Borough Administrator provided an explanation. Robert Bergen – commented on the tax abatement resolutions, R2024-174 and R2024-208, and asked how it’s applied during the year, to which the Borough Administrator advised she will get more information. Councilmember McNamara noted the commencement and ending dates in the resolutions and that the first and final years would be partial payments. Mayor Aumack, 52 Kearney Street –emphasized, as a longtime zoning officer and former mayor, the importance of the position and not being connected with anything else; the officer should be available to meet with an applicant, inspect, and approve or deny. If it’s denied, the applicant can appeal to the Planning Board. Reiterated the importance of the person selected to serve. Closed: 8:13 PM Motion by Gross, Carried by Brady. Ayes by all present. The Borough Administrator noted that the Assessor considers it a new construction. For UCC purposes, this was not a plot of land with a new house going up and qualifying for a new home warranty. Ayes by all present. Robert Bergen – Mentioned advertising ordinances and listing the date of public hearing on the agenda. Commented on Cass Street property and distributed handout about industrial facilities. Contended that the auto junk yard is not an approved use on that property and the Borough Administrator should get copies of zoning applications, as should councilmembers; the administrator responded that she is getting them now. Commented on municipal court shared June 25, 2024 Keyport, NJ Page 8 of 9 services; the Borough Administrator responded, noting that it’s a three-year agreement but there is a get-out clause; Middletown is currently operating as a hybrid court but the AOC will make the ultimate determination; the budget set aside for police to attend/police overtime for court here is about $12,000 and moving it to Middletown would be up to $15,000, so a $3,000 difference and the police are working it out. Mike Lane – asked Borough Engineer for clarity about contacting Monmouth County regarding four-way stops. Asked about Environmental Commission’s extensive study and the Keyport Yacht Club crosswalk study being provided to the county, which can be sent. Asked about street lights, and the Borough Administrator replied she is working with the Engineer on this issue. Jack Straub, speaking on behalf of the Harbor Commission – Mariner’s Village is asking for a one-year extension and the commission recommends that the extension not be granted until certain conditions are met. Requested compliance with the required standpipe. The commission believes it’s necessary to make it a condition of further approvals. Anthony Garzone – asked about the ordinance preventing large trucks on certain roadways and the status of its effectiveness, to which the Borough Administrator responded that signs are ordered and anticipated soon, and police will be able to begin issuing citations soon, after the estoppel period ends. Paul McKeefrey – commented that the website link for issues/complaints isn’t working. Asked about when the recycling brochures would be out, and the Borough Administrator noted that the garbage contract was just awarded and will make sure it’s correct on Borough website. Asked about Beers Street, to which the Borough Engineer provided an update. John Merla – asked about Church Street issues, noting the markout for gas, and the Borough Engineer responded. Asked about the utility pole cleanup, and specifically noted that a pole in front of 276 First Street leans into the sidewalk. The Borough Administrator asked about the pole number to direct the concern to the correct utility company. Asked about follow up on the NJ American Water presentation made earlier this year, to which the Borough Administrator responded about the feasibility study the Borough would be undertaking. Mayor Aumack – recalled that the Borough pays for a number of street lights to JCP&L and police on nights would take notice of street lights that were out. Identified six lights out, including Stout and Main, Kearney and Barnes, Barnes and Main. The Borough Administrator responded that the police still monitor the lights and Keyport is part of a pilot program to upgrade lights with LEDs. Sandy Marion, 91 Perry Street – asked about trucks coming down Perry Street from Route 36, noting that some trucks are sitting on Jackson Street between Perry and Beers, and also noted that the lot is covered with fine sand that creates dust. The Borough Administrator will follow up. Anthony Garzone – conjectured that because they had to stop paving they now put sand down, and added that there’s too many trucks and the dust is covering lots of properties now. Elmer J. Graham Jr. – Recognizes Perry Street as a bad area and would like for something to be done. Recommends We Care Adult Care, which has a Facebook page. Encourages veterans to check out the American Legion meets the first Thursday of every month. Closed: 9:04 PM Motion by Reilly, Carried by McNamara. Ayes by all present. Councilmember McNamara followed up on Mr. Straub’s comment, noting the May 31, 2022 resolution for 357 West Front has specific language requiring by May 15th that boats be removed from the parking lot; she drove by earlier in the day and observed more than 6 large boats in the parking lot and no parking attendance. June 25, 2024 Keyport, NJ Page 9 of 9 R2024-233 – Authorizing a Meeting Not Open to the Public in Accordance with the Provisions of the New Jersey Open Public Meetings Act, N.J.S.A. 10:4-12b to discuss Personnel matters pursuant to N.J.S.A. 10:4-12(8) RESOLUTION #2024-233 RESOLUTION OF THE BOROUGH OF KEYPORT, COUNTY OF MONMOUTH, NEW JERSEY AUTHORIZING A MEETING NOT OPEN TO THE PUBLIC IN ACCORDANCE WITH THE PROVISIONS OF THE NEW JERSEY OPEN PUBLIC MEETINGS ACT, N.J.S.A. 10:4-12. WHEREAS, the Borough of Keyport, County of Monmouth (the “Borough”), a public body corporate and politic of the State of New Jersey, is subject to certain requirements of the Open Public Meetings Act, N.J.S.A. 10:4-6, et seq. (the “Act”), and WHEREAS, N.J.S.A. 10:4-12 provides that an Executive Session, not open to the public, may be held for certain specified purposes when authorized by resolution; and WHEREAS, it is necessary for the Borough to discuss, in a session not open to the public, matters regarding Personnel matters pursuant to N.J.S.A. 10:4-12(8) NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Keyport, County of Monmouth, State of New Jersey as follows: 1. The aforementioned recitals are incorporated herein as though fully set forth at length. 2. The Mayor and Council assembled in public session on June 25, 2024 and determined that an Executive Session closed to the public shall be held on June 25, 2024 at approximately 7:00 P.M. at the Borough Hall located at 70 West Front Street, Keyport, New Jersey, for the discussion of matters relating to the specific items designated above. 3. This resolution will take effect immediately. Motion to go into Closed Session at 9:05 PM. Moved by Reilly, Carried by McNamara. Ayes by all present. Council reconvened to Open Session at 10:35 PM.
