The design professionals have estimated the total trash quantity at the site at 1,050 cubic yards. That quantity of material will require 2 phases for remediattion. The site will become a nature preserve and steps will be taken to prevent further dumping. The County of Kingfisher is expected to seek an Environmental Officer grant, which will pay for signs and cameras to discourage violators. The project will be put out for bid, due to the size of the contract necessary. Funds are requested here for basic management of the grant, advertising, and protective gear. The balance of the grant will be used to pay a contractor for Phase1 of the clean-up. Budget for Grant Implementation: Preparation of Bid Documents: Prepared by City staff Advertising: $ 200.00 Contractor for Waste Removal: $ 49,500.00 Grant and Project Management: Funded elsewhere Protective Gear: $ 300.00 Total: $ 50,000.00 Page 35 of 51 Page 36 of 51 Page 37 of 51 Page 38 of 51 Page 39 of 51 Page 40 of 51 Page 41 of 51  RESOLUTION NO. __2026-001 A RESOLUTION FIXING THE DATE OF THE ELECTION IN THE CITY OF KINGFISHER, OKLAHOMA; FURTHER DESIGNATING THE OFFICES TO BE FILLED AT SAID ELECTION, INCLUDING THE QUALIFICATIONS AND VOTING INFORMATION NECESSARY FOR CONDUCTING SAID ELECTION AND DIRECTING SUBMISSION OF SAME TO THE SECRETARY OF KINGFISHER COUNTY ELECTION BOARD. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF KINGFISHER, OKLAHOMA: SECTION 1: That the general election shall be held in the City of Kingfisher, Oklahoma, on Tuesday April 7, 2026. SECTION: 2: At said general election, the office of City Commissioners Seat Three is to be elected for a four (4) year the qualified voters of the City of Kingfisher at large. SECTION 3: At said general election, the office of City Commissioner Seat Four is to be elected for an unexpired term of one (1) year by the qualified voters of the City of Kingfisher at Large. SECTION:4 The qualifications for any person seeking the City Commissioners position include, 1) the individual must be a qualified elector of the City of Kingfisher, 2) the individual must be a permanent resident of the City of Kingfisher and 3) the person shall be subject to any other applicable City of Kingfisher Charter requirements. SECTION 5: Failure of any candidate to receive a majority of the votes cast in said election shall result in a run-off election, which shall be held on Tuesday June 16th, 2026, between the two candidates who received the largest number of votes. SECTION 6: The filing period for office shall be as provided by law with the Kingfisher County Election Board at the Kingfisher County Courthouse, City of Kingfisher, between 8:00 O’clock a.m., the 2nd day of February 2026, until 5:00 O’clock p.m., and the 4th day of February 2026. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS FOR THE CITY OF KINGFISHER: SECTION 1: Amendatory Language Title 3, Chapter 5, Section 2 of the Kingfisher City Code shall be amended to read as follows: There is hereby levied an excise tax of nine percent (9%) upon the gross proceeds or gross receipts derived from all rent for every occupancy of a room or rooms in a hotel in the city, except that the tax shall not be imposed where the rent is less than the rate of five dollars ($5.00) per day. SECTION 2: Amendatory Language Title 3, Chapter 5, Section 22, Subsection B(1) of the Kingfisher City Code shall be amended to read as follows: B. Manner Of Claiming Exemptions: 1. Every hotel shall submit a monthly exemption form, as provided by the city manager, with each monthly room tax report. This exemption form will indicate the name of the person seeking exemption, the exempt organization with which they are affiliated, the period of occupancy, number of rooms occupied and any other information required by the city manager. Every exemption form shall be signed by the hotel manager or authorized agent, so that the signature shall serve as an acknowledgment that all information contained in the exemption form is true and correct. Upon submission of these forms to the city, the city manager shall make a final determination as to the validity of all claimed exemptions. Should the city manager determine that a claimed exemption is not valid, the hotel shall be assessed the nine percent (9%) hotel tax within three (3) months of the date that the exemption is claimed. The hotel claiming such exemption shall become liable for payment of the tax and shall submit the same with their next monthly tax remittance. Page 44 of 51 SECTION 3: Ordinance Subject to Vote of the People As is required for any ordinance intended to increase or modify tax rates charged by the City of Kingfisher, this Ordinance 2026-001 will only go into effect upon an affirmative vote of the qualified voters residing within the City of Kingfisher as required by law and as provided for by Resolution 2026-_____. WHEREAS, the City of Kingfisher desires to continue to promote itself and engage in economic development activities; and WHEREAS, the City of Kingfisher understands the importance bringing new business and expanding current business to provide services and employment opportunities for its citizens; and WHEREAS, the City of Kingfisher has passed Ordinance No. 2026-001 increasing the hotel occupancy excise tax from five percent (5%) to nine percent (9%); and WHEREAS, State Law and the Kingfisher City Code require that all measures requesting an increase or extension in the hotel occupancy excise tax must be submitted to the qualified and registered electors of the City of Kingfisher and that a majority of said electors must approve said hotel occupancy excise tax prior to it being enforced.
