City Council Meeting Agendas and Minutes

REGULAR SESSION OF JANUARY 31, 2012 The City of Kings Mountain, North Carolina met in Regular Session at 6:00 p.m. on Tuesday, January 31, 2012 in the Council Chambers of City Hall with Mayor Rick Murphrey presiding. ATTENDANCE The following Councilmembers were present: Howard Shipp, Rodney Gordon, Keith Miller, Dean Spears, Mike Butler, Tommy Hawkins and Rick Moore. Also present: Mickey Corry, City Attorney, Marilyn Sellers, City Manager and Ann Sessom, City Clerk. INVOCATION The invocation was given by Reverend Doug Allen, Penley’s Chapel Church, Kings Mountain, N.C. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Rick Murphrey. AGENDA ADOPTION Mayor Rick Murphrey asked City Council if they would like to make any changes to the proposed agenda. Upon motion by Councilmember Rick Moore and seconded by Councilmember Dean Spears, it was unanimously voted to adopt the agenda as presented. SPECIAL PRESENTATION AND RECOGNITIONS City Councilmembers Comments and Remarks: Councilmember Mike Butler thanked Jackie Barnette, Public Works Director and his department for the excellent job Christmas Eve on the luminaries at the cemetery. 2,500 cars came through the gates. Councilmember Mike Butler also thanked Jackie Barnette and his department on how great the City looks and on them getting all the leaves up. Mayor’s Comments and Remarks: Mayor Murphrey recognized the following employee for her years of service with a framed certificate and service pin: • Christy Conner 10 Years Children’s Librarian Minutes – January 31, 2012 Page 2 Mayor Murphrey recognized the Mauney Memorial Library for being awarded two Service Innovation Awards at the North Carolina Public Library Directors Association meeting. The two awards were: • Register Online! For Summer Reading • Breaking New Ground Mayor Murphrey presented Shirley Q. Payne with a framed copy of Resolution 12-01 in recognition and appreciation upon her retirement. Mayor Murphrey thanked her for her many years of valuable service and expressed City Council’s sincere thanks. Mayor Murphrey and City Council extended personal congratulations and best wishes for continued success in her life’s pursuits. Mayor Murphrey presented Penny E. Fulton with a framed copy of Resolution 12-02 in recognition and appreciation for donating one of her kidneys to Captain Jerry Tessneer. Penny Fulton did this unselfish act, never once wavering in her decision, put her own life in danger to save the life of another, displaying the loyalty to her oath of being a Police Officer. Mayor Murphrey and City Council commend Penny Fulton and view her action as an act of love and selfless giving and her true gift of life. Mayor Murphrey recognized the following winners of the Martin Luther King Photography Contest: Student Category • 1st Place “Grandmom’s Realities” by Brian Johnson • 2nd Place “Free Now” by Douglas Parker • 3rd Place “Freedom to Serve and Play” by Aaron Watson Adult Category • 1st Place “Dreams in Black & White” by Starr Dove • 2nd Place “Big Dreams Start Small” by LaSundra Williams • 3rd Place “A Sea of Possibilities” by Erica Williams The Mayor’s Award was presented to Gena Hart for the following vision: “My vision of the American Dream “Ever Burning Hope” is best represented as a flickering light that has led the way for generations past and continues to burn and reflect itself in generations to come. This light has been shown through all of the people that have had the courage to stand up and make a change. This small but flickering light, lies within all of us and as Dr. King’s legacy shows us, will continue to shine long after we are gone. This is inspirational to me because I know that if I strive to keep the American Dream alive, it will continue to burn brightly and inspire others.” – By: Gena Hart Minutes – January 31, 2012 Page 3 SPECIAL EVENTS UPDATE Ellis Noell, Special Events Director, updated the City Council on the following event that took place in January: • Martin Luther King Celebration Presentation of 2010 – 2011 Audit – Shane Fox, Martin Starnes & Associates Shane Fox with Martin Starnes & Associates presented the 2010 – 2011 fiscal year audit in which he stated that the City of Kings Mountain had an excellent audit. He thanked Beverly Moschler and her staff for their assistance in completing the audit. He reviewed the following highlights: • Unqualified opinion • No findings or questioned costs • No significant deficiencies or material internal control weaknesses identified • Cooperative staff Mayor Murphrey stated that City Council was thankful for another perfect audit and the continued hard work of all associates. CITIZEN RECOGNITION Boyce Tesenair, 409 Country Club Acres, stated “both houses of Congress have passed a resolution deeming March 30th as “Welcome Home Vietnam Veterans Day”. On behalf of all Vietnam Veterans of the Kings Mountain area, I would like for the City of Kings Mountain to be the first in the county to pass a resolution declaring the last Sunday in March as “Welcome Home Vietnam Veterans Day”. If I may use a quote from one of the Rambo movies – “All we ever wanted was for our country to love us as we love it.” I would change one word instead of country I would us City. Thank you.” Maurice Tate and Bernadette Byars, Kings Mountain Elite Organization, stated that the Club is dedicated in providing youth programs from the ages of 5 – 18 that focus on the recreational, educational and social opportunity components within our community. The Elite Club is committed in implementing core values and character qualities to empower our youth to make good life choices in order to attain a bright and prosperous future. A copy of the program analysis will be given to City Council for review. CONSENT AGENDA Upon motion by Councilmember Tommy Hawkins and seconded by Councilmember Rodney Gordon it was unanimously voted to adopt the following consent agenda: Minutes – January 31, 2012 Page 4 A. Minutes: Approve Minutes of the Regular Meeting December 12, 2011 and the Special Work Session of December 15, 2011. B. Re-appoint Margaret Leach to the ABC Board with term expiring January 31, 2015. C. Appoint Rebecca Dye to fill the unexpired term of Stacy Ledbetter on the Tourism Development Authority with term expiring June 30, 2013. D. Adopt Resolution 12-03 approving the Cleveland County Multi-Jurisdictional Hazard Mitigation Plan. E. Adopt Resolution 12-04 approving the Gaston County Multi-Jurisdictional Hazard Mitigation Plan. F. Adopt Ordinance 12-01 posting the speed limit on West Gold Street Extension to 25 MPH. G. Approve Concealed Weapons Class for the public scheduled for Monday, February 6, 2012 and Saturday, February 11, 2012 at the Kings Mountain Police Firing Range with Corporal Keith Davis conducting the class. H. Adopt Resolution 12-05 in support of the City of Kings Mountain’s designation as a North Carolina Main Street Community. I. Set the date of Tuesday, February 28, 2012 at 6:00 p.m. for a Public Hearing to consider an Industrial Incentive Grant to Project Merlot. J. Set the date of Tuesday, February 28, 2012 at 6:00 p.m. for a Public Hearing to receive public comment concerning new CDBG applications for FY 2011 and FY 2012 monies. K. Authorize Anthony Everette and Sharon Thorsland project proposal to remove trees on the Moss Lake Reservoir control strip. L. Award contract to Steve Austin for administrative service on CDBG Project for Small Business Entrepreneurial Assistance Program. M. Authorize the Mayor to execute the contract with Arcadia Press for the publication of the book Images of America Kings Mountain. N.
