City Council Meeting Agendas and Minutes

REGULAR SESSION OF OCTOBER 31, 2017 The City of Kings Mountain, North Carolina met in Regular Session at 6:00 p.m. on Tuesday, October 31, 2017 in the Council Chambers of City Hall with Mayor Scott Neisler presiding. ATTENDANCE The following Councilmembers were present: Howard Shipp, Keith Miller, Curtis Pressley, Jay Rhodes, Rodney Gordon, Mike Butler and Tommy Hawkins. Also present: Mickey Corry, City Attorney; Marilyn Sellers, City Manager and Lynda Mattox, City Clerk. INVOCATION The invocation was given by Pastor Scott Whitney, East Gold Street Wesleyan Church, Kings Mountain, North Carolina. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Neisler. AGENDA ADOPTION Upon Motion by Councilmember Jay Rhodes, seconded by Councilmember Curtis Pressley, it was unanimously voted to adopt the Agenda as presented. SPECIAL PRESENTATION AND RECOGNITIONS City Councilmember’s Comments and Remarks: No comments. MAYOR’S COMMENTS AND REMARKS Mayor Neisler read a Resolution honoring Bess Phifer on her 100th birthday and presented her with a Key to the City. Mayor Neisler read a Resolution honoring Marie Perry Burris on her retirement from the Kings Mountain Housing Authority Board. Mayor Neisler read a Resolution honoring Brianna Meagan Rochford for being selected Miss Cleveland County Fair Queen. Mayor Neisler recognized the following employees for their years of service: Minutes – October 31, 2017 Page 2  Gregg McKinney Police Dept. 10 years  Terry Bivens Library 5 years Mayor Neisler read a Resolution recognizing Corporal Paul Alexander for obtaining his Criminal Investigation Certification from the State of North Carolina. Mayor Neisler read a Resolution recognizing the following for obtaining their North Carolina Grade 1 Collections Operator Certification:  Corbin Berryman  Richelle Meek  Mark Estes  Nathan Jones Mayor Neisler read a Resolution recognizing Bryan Mauney for obtaining the Mechanical Inspector Level 1 Certification. SPECIAL EVENTS UPDATE Christy Conner, Special Events Coordinator, updated council on the Mountaineer Days Festival that was held on October 20th and 21st and the Halloween Parade held this morning. She also reminded everyone of the upcoming Veterans Day Parade and Observance on November 10 and the Home for Christmas, Christmas Parade, Winter Wonderland Extravaganza and the kick-off of the Christmas Light Show on December 2nd. Mayor Neisler commended Christy for doing such a great job with our Special Events. CITIZEN RECOGNITION No one requested to speak. CONSENT AGENDA Upon Motion by Councilmember Mike Butler, seconded by Councilmember Jay Rhodes, it was unanimously voted to approve the following Consent Agenda items: A. Minutes of the Special Session of September 7, 2017 and Regular Session of September 26, 2017. B. Ordinance 17-21 declaring a roadway closure for the Kings Mountain Christmas Parade being held on Saturday, December 2, 2017 at 3:00 pm. (This is required to be on file with NCDOT). Minutes – October 31, 2017 Page 3 C. Budget Amendment in the amount of $250,000 to increase property tax revenues and the corresponding economic development incentive expense due to increased property valuation at the data centers (T5 new building and equipment not included in original budget). The entry will have no impact on fund balance. D. Budget Amendment in the amount of $532,050 to appropriate additional revenues in the gas and electric funds, a portion of which will be used for capital improvements to Patriot’s Park and Ramseur Park; a portion of which will be held in contingency and the remainder will be used for various operating purposes. E. Resolution 17-40 awarding financing of a 2017 Swaploader Hook Lift Hoister to HomeTrust Bank in the amount of $118,920.70 with an interest rate of 2.03% and financing terms of 5 years with the first payment being made in the next fiscal year for the Street Department. (budgeted item) F. Resolution 17-41 directing the City Clerk to investigate a Voluntary Non-Contiguous Annexation Petition received under G.S. 160A-58.1 for Maliks International, Inc. – Case No. 2017-VA-1 – Cleveland County Tax Map 4-39, Block 1, Lot 9. G. Schedule a Public Hearing for November 14, 2017 at 6:00 pm to discuss an incentive agreement for Project C. REGULAR MEETING City Attorney, Mickey Corry, reviewed with Council the proposed lease of Senior Park which adjoins the recently renovated building at 133 West Mountain St. Thoroughbred Partners, LLC who own 133 W. Mountain Street are planning to put a restaurant in and would like to lease a portion of the Senior Park from the City for the purpose of some outside dining. They would like to have an initial lease of three years and potential two extensions of that for three years each making it a total of nine years. The rental rate would be $1.00 per year. Insurance will be the same amount the city requires for itself. If for some reason in the future the City would need that property, the tenant would be notified and the City would get the property back with 90 days’ notice. This lease cannot be transferred to another entity if the restaurant were to close. The lease would terminate immediately. Minute – October 31, 2017 Page 4 The proposed lease has been available in the City Clerk’s office for inspection but no one requested a copy. It was advertised 30 days prior to this meeting as law requires. Upon motion by Councilmember Mike Butler, seconded by Councilmember Jay Rhodes, it was unanimously voted to have the Mayor execute a lease of the “Senior Park” with Thoroughbred Partners, LLC.
