PLANNING & ZONING COMMISSION MINUTES AUGUST 24, 2021 The meeting was called to order at 5:30pm by Chairperson Willie Swayne and on roll call the following members were present: Kirsten Meyers Lucas Young Mike Cox Willie Swayne Mike Conner Jr. Jacob Vander Ecken Members not present: None Staff Present: Bill Mettee, Planning and Zoning Administrator and Heather Ussery, City Manager Public Present: Mark Lee, Lee Chamberlin Engineering and Carrie Woerdeman, Kading Properties The agenda of the August 24, 2021 meeting was approved on a motion by Lucas Young and seconded by Mike Conner Jr. On voice vote: All ayes. The minutes of the July 13, 2021 meeting were approved on a motion by Mike Conner Jr. and seconded by Lucas Young. On voice vote: All ayes. New Business: Consider a subdivision request from Bloomfield Acres, LLC at West Bell Avenue, Knoxville, for a Plat of Survey of Parcel C of Part of the NE ¼ of the NE ¼ of Section 13-75-20, Marion County, City of Knoxville, Iowa. Bill Mettee presented an outline of the project, as shown in the staff report. The purpose of this Plat of Survey was to split a parcel of land in order to facilitate a residential development project. Mettee noted the new parcel would be just over 18 acres in size for the purpose of constructing 152 units. Carrie Woerdeman of Kading Properties stated that they have an agreement in place with the current owners to purchase the property. City of Knoxville | 305 S. The motion was seconded by Mike Conner Jr. On roll call vote: All ayes: Motion carries 6-0 Consider a rezoning request from Bloomfield Acres, LLC at West Bell Avenue, Knoxville to change the zoning from C-1 Residential-Commercial to R-3 Multi-Family Residential at Parcel C of Part of the NE ¼ of the NE ¼ of Section 13-75-20, City of Knoxville, Marion County, Iowa and the NW ¼ of the NE ¼ of Section 13-75-20, City of Knoxville, Marion County, Iowa, except the Final Plat of the Walmart Subdivision and North and East of the State Highway 92 Right-of-Way Bill Mettee presented an outline of the project, as shown in the staff report. Mettee mentioned that Kading’s project would be permitted in its current C-1 zoning, but that R-3 Multi-Family Residential makes more sense. Lucas Young asked if the density proposed fell within the ranges of the Zoning Code. Mettee stated it did, had researched it but did not incorporate the numbers into the staff report. Lucas Young asked if we had considered a PUD. Mettee stated the conversation was brought up but short lived. Mark Lee stated that when a project falls within straight zoning, a PUD isn’t necessarily required. Mettee stated that the only staff comment received was from Pat Murphy from Water Reclamation who said the sanitary sewer cut diagonal across the lot and would need to be moved. Kading has agreed to move the sewer line parallel to Bell Avenue. Mark Lee confirmed to the Commission that this was a rezoning for two lots, one R-1 and one C-1, both to R-3. Willie Swayne asked if the tree buffer shown on the renderings would be incorporated into the final design. Mark Lee said yes. Carrie Woerdeman stated that this was now a combination of bi-attached, four-plex and six-plex buildings instead of only bi-attached as originally planned. This is due to the financial tool they use. Lucas Young asked about setbacks between buildings. Mettee stated that the setbacks would be measured from the outline of the lot, since it’s one lot. City of Knoxville | 305 S. This will be a more in-depth look at the project. Motion was made by Mike Conner Jr. to approve the Rezoning as presented. The motion was seconded by Jacob Vander Ecken. On roll call vote: All ayes: Motion carries 6-0 Consider a rezoning request from Gary Cowman at 407 N Kent Street, Knoxville, to change the zoning from C-1 Residential-Commercial to M-1 Service Commercial | Limited Industrial for 401 AND 407 N KENT STREET, JONES & HANKS BLK 2 RR PROPERTY LY N&E OF BLK 2, JONES & HANKS BLK 2 LOT 4 EXC S50’ AND JONES & HANKS BLK 2 LOT 3 W1/2 OF S50’, ALL CITY OF KNOXVILLE, MARION COUNTY, IOWA Bill Mettee presented an outline of the project, as shown in the staff report. Mettee stated that this proposal came before them due to code compliance problems. The owner allows another gentleman to use this property to run a business. This gentleman admitted to running a salvage business with some sales. Salvage yards are not permitted in the C-1 district, so the proposal was for a rezoning to M-1. Mettee mentioned that while salvage yards weren’t listed as a permitted use in M-1, it’s a similar use to the others in this district. Some Commissioners questioned the rezoning was only to allow a continued use of the property that wasn’t in conformance with the zoning code. They had concerned that the property would never be cleaned up. City Manager Heather Ussery stated that code enforcement officers have been trying to get this property cleaned for over 10 years. Motion was made by Lucas Young to deny the Rezoning. The motion to deny was seconded by Mike Cox. On roll call vote: All ayes: Motion to deny carries 6-0. The meeting was adjourned on a motion by Mike Conner Jr. and seconded by Lucas Young.
