1. CALL TO ORDER
Chairman Bownes called the meeting to order at the above date and time.

Chairman Bownes noted all three members of the subcommittee were in attendance and a quorum has
been established.

5.A. Proposed criteria to accept these roads "as-is"

Director of Public Works Anderson gave a brief background on the subject matter. The following is a
list of criteria to accept a road as "as is" condition:
1. The "unaccepted street" must be maintained by the City and have been maintained by the City
since 1979.

2. The developer of the newer roads must have met all conditions established by the Planning Board
or went out of business before the development was completed.
3. The condition of the road must not be such that it is a disservice to the abutters to accept the
road in an "as is" condition.
4. The condition of the road and its drainage system is such that it does not present a hazard to the
abutters or those residents that are downhill/downstream of the road.
5. Deeds or covenants on the road or development do not restrict the private road from becoming
public.
6. The road has been constructed, i.e. it is not a trail used by vehicles to gain access to their
property.
7. The road must not be in a state right of way.
Director Anderson did state that one abutter in the wrong spot could stop the entire process.
Meaning if an abutter that was in the beginning of the road and the City couldn't get by that property
than the entire road wouldn't be accepted. If this process is done through a betterment process to
bring the roads up to standard than the City would foot the bill and the residents would have 10 years
through a betterment process to pay the City back. If these roads are accepted "as is" than there
are minimal costs.
Director Anderson stated of the 52 roads that are uncategorized, by accepting the roads "as is" on
the list tonight, there would only be an estimate of 15 roads left to determine how to categorize.

City Manager Myers stated that when a public meeting was held in regards to the Methodist
Campground, the residents were onboard with this process.
Director Anderson stated that after the budget process is done, he will come back to Council to
discuss the remaining 15 roads and what action to take with those.
City Manager Myers said another small benefit to the City by accepting these roads, is that it will

add miles to our inventory which will help with funds the City may receive.
Councilor Hosmer would like some extra time to read the criteria to fully understand it.
Councilor Haynes is concerned that people that live on private roads may down the road decide they

want to be accepted "as is." Director Anderson stated that in order for a private road to be accepted
"as is" they would need to meet the criteria that the Council accepts.
Councilor Hosmer moved to recommend to the Council to accept the criteria set forth in the April 22,
2019 document and for the Council to table the topic to the next available Council meeting,

seconded by Councilor Haynes, the motion passed with all in favor.
