City of Laconia Zoning Board of Adjustment Tuesday , February 20, 2024 - 6:30 PM City Hall in the Armand A. Bolduc Council Chamber 2/20/2024 - Minutes 1. CALL TO ORDER The Meeting was called to order at 6:30PM 2. ROLL CALL Roll call was as follows Roland Maheu, Jane Laroche, Michael DellaVechia , Mike Foote, And Marcia Hayward. 3. RECORDING SECRETARY Scott Pelchat Zoning Technician 4. STAFF IN ATTENDANCE The Director of planning Rob Mora 5. ACCEPTANCE OF MINUTES FROM PREVIOUS MEETINGS The minutes from the December meeting were accepted and a motion was made to accept the minutes and this was seconded by mike Foote. 5.I. ZONING BOARD OF ADJUSTMENT 6. EXTENSIONS 7. CONTINUED PUBLIC HEARINGS, CONSIDERATION AND POSSIBLE VOTE Note: The Purpose Of This Agenda Section Is For The Board To Continue The Public Hearing For The Applicant And The Public To Provide Input. The Board May Also Deliberate The Application, Decide And Conduct A Final Vote At This Time. 8. PUBLIC HEARINGS, POSSIBLE CONSIDERATION AND VOTE Note: The Purpose Of This Agenda Section Is For The Board To Have A Presentation From The Applicant And Open A Public Hearing For The Public To Provide Input. The Board May Also Deliberate The Application, Decide And Conduct A Final Vote At This Time. 9. ZO2023-0122 VAR 98 Leighton Ave Romy Maurer spoke regarding the property at 98 Leighton Ave and the request for a variance from the shoreline setback which is a fifty foot setback. The existing structure is to be demolished and the new structure will be less non conforming and will encroach into the shoreline setback by 5 feet. Romy also mentioned that DES had approved the shoreline and wetland permits. Michael DellaVechia opened to public discussion at 6:35PM and closed to the Public at 6:36PM Mike Foote asked if they had water and sewer 9. Michael DellaVechia opened to public discussion at 6:35PM and closed to the Public at 6:36PM Mike Foote asked if they had water and sewer and Romy stated they had water and septic. Michael Sought a motion to grant the Shoreline Set Back Variance Marcia motioned to grant the Variance utilizing the narrative from the application as written this was seconded by Jane Laroche and was granted unanimously. 10. ZO2023-0123 VAR 98 Leighton Ave Romy Mauer Spoke regarding the property at 98 Leighton Ave and the request for a variance from the front setback which is a forty foot setback. The existing structure is to be demolished and the new structure will encroach into the from setback by approximately a foot. Michael DellaVechia opened to public discussion at 6:37PM and closed to the public at 6:38PM Michael Sought a motion to grant the variance and the motion was made by Marcia Hayward citing the narrative provided by the applicant as the criteria for this allowance this was seconded by Roland Maheu and was granted unanimously. 11. ZO2023-0125 SE 143 Court St Tim Grant spoke regarding the Veterans Of Foreign Wars application to allow for the installation of a new sign that would be digital and would allow for the static display of upcoming events and happenings at the property. Tim Stated the existing sign is very old and that the new portion going in to the existing sign structure would be electronic and more current. Michael DellaVechia opened to public discussion at 6:44PM and closed to the public 6:45PM Mike Foote made a motion to grant the special exception for the digital signage using the finding of fact The use requested is specifically authorized in this chapter yes. the requested use will not create undue traffic congestion or unduly impair pedestrian safety and it will not. The requested use will not overload any public water, Drainage or sewer system or any other municipal system, nor will there be any significant increase in stormwater runoff onto adjacent property or streets. No it will not. The requested use will not create excessive demand for municipal police, fire protection, Schools or solid waste disposal services no it will not. No special provisions were set forth for this application. The requested use will not create hazards to the health , safety, or general welfare of the public , nor be detrimental to the use of or out of character with the adjacent neighborhood. and it will not. the proposed location is appropriate for the requested use Yes it will be within the existing sign structure. The requested use is consistent with the spirit and intent of this chapter and the master plan. Yes it is. the motion was seconded by Jane Laroche and was passed unanimously. 12. ZO2024-0001 SE Gerald Hendricks Spoke regarding the ADU and the square footage of the proposed dwelling as it will be 650 Square Feet Marcia inquired about the parking situation at the property and Gerry stated there would be plenty of parking on site due to the size of the parking area. Mike Foote asked about the direction of the adu in comparison to other structures on the lot. Scott spoke regarding how the current application for the ADU would fit within the property and it would be inspected by the building inspector. Opened to public discussion at 6:54 and closed to the public at 6:50 ctp at 6:51PM Mike Foote discussed the finding of fact A. the use requested is specifically authorized in this chapter. And it is. B. The requested use will not create undue traffic congestion or unduly impair pedestrian safety. No it will not the driveway is long enough to park up to 6 vehicles. C. The requested use will not overload any public water, drainage or sewer system or any other municipal system, nor will there be any significant increase in stormwater runoff onto adjacent property or streets. No there will not be. The lot is served by its own septic . D. The requested use will not create excessive demand for municipal police, fire protection , schools or solid waste disposal services it will not the daughter of the owner will reside in the ADU. E. Any special provisions for the use as set forth in this chapter are fulfilled. it does the ADU will meet necessary guidelines'. F. The requested use will not create hazards to the health, safety, or general welfare of the public, nor be detrimental to the use of or out of character with the adjacent neighborhood. no it will not. G. The proposed location is appropriate for the requested use. Yes it is as its not visible from the road. H. The requested use is consistent with the spirit and the intent of this chapter and the master plan. yes it is. this was seconded by Jane Laroche and it was unanimous 13. ZO2024-0003 VAR Gary Thomas spoke regarding the application and the variance that was sought it was found to be a rear fifteen foot setback to allow for the construction of a garage on the property that would allow neighbors to unanimous 13. Gary emphasized the location of the garage and Marcia touched on the noted setback line . it was opened to public discussion at 6:59Pm and the Fishers spoke regarding there support of the garage project. Also Mr Pat Tierney Spoke supporting the project as well. Marcia made a motion to allow the variance for the setback 1. The request does not impact the public in any negative manner but actually the benefits the owners of 85 Fenton Ave. 2.the spirit of the ordinance is observed. 3. because there is no general gain to the public that would outweigh the needs of the applicant. 4. No evidence was presented regarding the property values. 5. the proposed use is a reasonable one. this was seconded by Jane and was unanimous. 14. ZO2024-0004 VAR Nicole Murphy spoke regarding the variance that was sought by the applicant for the DOX Restaurant to allow for two signs to be installed on the roof access of the Pier at weirs beach one sign that would point toward the boardwalk and one that would project out towards the direction of Alton Nicole stated the Variance to be obtained was to allow for an increase in signage square footage to allow for visible signage at this location where currently the Max Sign area of 18 SF is allowed. Marcia looked for more clarification as if it were to be one sign and or two signs Nicole expressed it would be two signs in alternate directions. Nicole also stated the signs being 86 SF each will be installed and angled to the directions they would be facing. Mike DellaVechia inquired about the store frontage and Scott defined it as the linear SF of store frontage. Mike opened to the public at 7:04PM and closed to public at 7.05PM.Mike Foote inquired about the Deck activity from the decking above. Nicole Murphy expressed that the signage rendering was to scale. Rob Mora expressed the counted signage that was presented as empty spaces usually are not counted. A motion was made by Jane Laroche to allow for two signs that would allow for a larger sign and signs to exist on this property. This was seconded by Roland and it was unanimous. 15. OTHER BUSINESS 16. ADJOURNMENT The Meeting was adjourned at 7:30PM and it was unanimous.
