BOARD OF PUBLIC WORKS AND SAFETY
MINUTES
January 26, 2016
Regular Session:
The Board of Public Works and Safety met in regular session on Tuesday, January 26, 2016 at 9:00 a.m.
in the Common Council Chambers. Members present were: Dawn Ross, Norm Childress and Ron
Shriner. Absent: Gary Henriott and Cindy Murray
Ed Chosnek, City Attorney, was also present.
Mr. Childress called the meeting to order.
The Pledge of Allegiance was given to the flag of our Country.
MINUTES
Mr. Childress stated that the Minutes will stand approved as distributed.
NEW BUSINESS
Engineering
Change Order #3-Old Romney Road Phase III
Dave Griffee, Engineering, presented to the Board and recommended approval of Change Order #3 for
the Old Romney Road Phase III Project. This change is for a few miscellaneous items that include new
storm sewer infrastructure for the new roundabout. The change order is in the amount of $5,197.06 which
brings the revised contract amount to $3,814,423.35. Mr. Griffee stated that all three change orders for
this project total $17,514.00. Mrs. Ross moved for approval. Mr. Shriner seconded. Passed.
Order to Remove Dead Tree-1909 Beck Lane
Leanne Wells, Urban Forester, presented to the Board and recommended approval of an Order to Remove
a Dead Tree at 1909 Beck Lane. Ms. Wells stated that she was approached by the property owner to the
south of the 1909 Beck Lane property which prompted her to go evaluate the tree. The ash tree has
succumb to the ash borer and the tree is leaning. The tree has the potential to fall onto the sidewalk and
into the road. The property owner has been communicated with via letter three times and then a fine was
issued. The property owner has yet to make any contact. Mr. Chosnek stated that the property owner will
be given 15 days from the receipt of this certified notice to remove the tree or show proof that they have
hired a contractor. If not, the Board can direct the Street Commissioner to make the arrangements to have
tree removed. Mr. Shriner moved for approval. Mrs. Ross seconded. Passed.
Legal Counsel
Contract for Employment of Attorney-City of Lafayette
Mr. Chosnek presented to the Board and recommended approval of a Contract for Employment of
Attorney with the City of Lafayette. Mr. Chosnek stated that this contract is the same contract that has
been in force since he was appointed by the Mayor as Corporation Counsel for the City of Lafayette in

2004. Mr. Chosnek stated that the last change was three years ago. The change for this contract is to
increase the hourly fee from $195 to $215. Mr. Chosnek represents a public service rate which is about
two-thirds of his normal fee for general practice. Mayor Roswarski stated that over the last 12 years Mr.
Chosnek legal counsel and the counsel of his office have been invaluable to this community. Mayor
Roswarski stated that Mr. Chosnek was very gracious with his rate back when he was first elected as
Mayor and also since then. Mayor Roswarski recommended the Board approve these contracts. Mr.
Shriner moved to approval. Mrs. Ross seconded. Passed.

Mr. Chosnek presented to the Board and recommended approval of a Contract for Employment of
Attorney with the Water Pollution Control Department. Mr. Chosnek stated that this contract is the same
contract that has been in force since he was appointed by the Mayor as Corporation Counsel for the City
of Lafayette in 2004. Mr. Chosnek stated that the last change was three years ago. The change for this

Mike Jones, Controller, presented for Board approval, Claims in the amount of $2,630,529.27. Mr.
Childress asked if there were any further questions and there were none. Mrs. Ross moved for approval.
