BOARD OF PUBLIC WORKS AND SAFETY MINUTES January 23, 2018 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, January 23, 2018 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Norm Childress, Dawn Ross and Ron Shriner. Ed Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mr. Childress moved for approval of the minutes from the January 16, 2018 regular meeting. Mrs. Murray seconded. Passed. BID OPENING City Hall Building HVAC Control and Systems Updates This being the time set to open bids for the City Hall Building HVAC Control and Systems Updates, the following bids were received and opened: D.A.Dodd LLC Lafayette, Indiana Base Bid: $544,500.00 Alternate #1: $23,000.00 Alternate #2: $14,450.00 Stambaugh & Son LP Lafayette, Indiana Base Bid: $596,000.00 Alternate #1: $24,000.00 Alternate #2: $5,700.00 North Mechanical Contracting Indianapolis, Indiana Base Bid: $685,125.00 Alternate #1: $20,934.00 Alternate #2: $6,421.00 Mrs. Ross moved to take the bids under advisement for further review. Mr. Shriner seconded. Passed. Board of Public Works and Safety January 23, 2018 Page 2 Prairie Lane Watermain Replacement (Re-Bid) This being the time set to open bids for the City Hall Building Prairie Lane Watermain Replacement (Re- Bid), the following bids were received and opened: F & K Construction, Inc. Flora, Indiana Base Bid: $383,000.00 Atlas Excavating West Lafayette, Indiana Base Bid: $341,369.43 Plant Brothers Excavating Rosedale, Indiana Base Bid: $242,206.15 Mr. Shriner moved to take the bids under advisement for further review. Mrs. Murray seconded. Passed. OLD BUSINESS Acceptance for Maintenance-Raineybrook Bay Part 2, Phase 2 (Tabled 1/16/18) Mrs. Murray moved to remove this item from the table. Mr. Childress seconded. Removed. Bob Foley, Engineering, presented to the Board and recommended approval of an Acceptance for Maintenance for Raineybrook Bay Part 2, Phase 2. Mr. Foley stated that this has passed all testing and the as-builts have been approved. Fairfield Contractors have submitted a maintenance bond in the amount of $61,085.00. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. NEW BUSINESS Engineering Addendum #7-Raineybrook Realty Corp/Suesro Development Area Mr. Foley presented to the Board and recommended approval of Addendum #7 for the Raineybrook Realty Corp/Suesro Development Area which is divided into two subdivision names for marketing purposes. Mr. Foley stated that the addendum established lot fees. Mrs. Ross moved for approval. Mrs. Murray seconded. Passed. Lafayette Renew Amendment #1-Drainage Improvements for South 30th Street Brad Talley, Renew Superintendent, presented to the Board and recommended approval of Amendment #1 for the Drainage Improvements for South 30th Street. Mr. Talley stated that this area has flooding during heavy rains. The amendment allows for a new design of the road through the construction phase. Board of Public Works and Safety January 23, 2018 Page 3 The amendment is in the amount of $28,150.00 which brings the revised contact amount to $242,050.00. Mr. Childress moved for approval. Mrs. Ross seconded. Passed. Amendment #1-Valley Street Drainage Improvement Project Mr. Talley presented to the Board and recommended approval of Amendment #1 for the Valley Street Drainage Improvement Project with Wessler Engineering. Mr. Talley stated that this amendment incorporates design needed to accommodate additional work for the Water Department, Right of Way Engineering and Land Acquisition needed for this project. The amendment is in the amount of $78,085.00 which brings the revised contract to $175,685.00. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed CLAIMS Tim Clary, Deputy Controller, presented for Board approval, Claims in the amount of $5,827,558.00. President Henriott asked if there were any further questions and there were none. Mrs. Ross moved for approval. Mr. Childress seconded. Passed. MISCELLANEOUS Taxi Cab Permits Police Chief, Pat Flannelly, presented to the Board and recommended approval of six (6) taxi cab permits for the following people: Lester L. Chaney, Marvin R. Sparger Jr, Jeffrey W. Davis, Anita Marie Williams, Hisham Nour and Don Gregory Kult. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Animal Control Appeal Hearing President Henriott stated that the Appeal Hearing will start in five (5) minutes. Animal Control Appeal for Kane Ed Chosnek stated this is an appeal for Kane who is owned by Samantha Wilson. Mr. Chosnek stated that the Board was provided with incident reports, pictures, the notice of hearing letter and Ms. Wilson’s appeal letter. Mr. Chosnek stated that Kane was involved in a biting incident on June 19, 2017. The victim of that bite was Susan Neal. There is a narrative report by Animal Control Jenna Manuel of that incident. Mr. Chosnek stated that looking at the pictures there are significant lacerations on several parts of Ms. Neal’s body. Mr. Chosnek stated that a Dangerous and Nuisance Animal Agreement was entered into on June 19, 2017 by Samantha Wilson where Kane was identified as a dangerous animal. The agreement states that if the dog gets out of owner control, they don’t even have to bite again, but the dog is subject to being taken by Animal Control seizes ownership. Mr. Chosnek stated that the next report is from January 1, 2018 where Kane was loose and attacked victim, Carla Polk. The pictures show severe injuries and lacerations to the victim. The dog was taken by Animal Control pursuant to the Dangerous Animal Agreement therefore Ms. Wilson filed an animal appeal on January 3, 2018. Mr. Chosnek made note that notice of this hearing was given to Ms. Wilson on January 10, 2018 via Board of Public Works and Safety January 23, 2018 Page 4 USPS. Mr. Childress asked Animal Control if these were the only two (2) incidents. Josh Klumpe and Jenna Manuel answered ‘yes’. Samantha Wilson, 2922 Greenbush Street, stated that she appealed to have her dog back for her kids. Ms. Wilson stated that she knows what Kane did was wrong and she knows that the right thing to do is to euthanize Kane. Ms. Wilson stated that she is scared that he will bite someone else and she stated that she feels bad for what happened already. Ms. Wilson stated that she understands if the Board decides to take him away permanently. Carla Polk, Victim #2, stated that she feels sorry that the dog will be taken away from the kids however, the dog is vicious. Ms. Polk stated that she was doing nothing but getting out of her car and was attacked. Ms. Polk stated that she is now afraid of dogs and her legs are still healing. Mrs. Ross stated that she worries that the dog would attack Ms. Wilson’s own children and suggested to Ms. Wilson pick a different breed of dog next time. Mr. Shriner moved to deny the appeal for Kane to be returned home. Mrs. Ross seconded. Passed.
