BOARD OF PUBLIC WORKS AND SAFETY MINUTES July 20, 2021 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, July 20, 2021 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton, Norm Childress and Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the July 13, 2021 regular meeting. Mrs. Murray seconded. Passed. NEW BUSINESS Engineering Permission to Advertise-Community Crossing Street Resurface Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Permission to Advertise for the Community Crossing Street Resurface Project. The publications are set to run on July 23 and July 30, 2021 with a bid opening on August 10, 2021. This project will encompass Elston Road from South 100 West to Old US 231, Beck Lane from Old US 231 to Old Romney Road, Old Romney Road from Beck Lane to US 52; and S. 11th Street from Kossuth Street to State Street. This is a State grant that matches 50/50 with the City. The City’s portion is $315,000.00. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. Change Order #3-Concord Road Trail Lighting Mr. Grenard presented to the Board and recommended approval of Change Order #3 for the Concord Road Trail Lighting Project with INDOT. This change order includes replacing a damaged light pole from March 2021. The amount of the change order is $2,390.50 which brings the revised contract amount to $410,164.23. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Addendum #5 for Utility Service Agreement-Avalon Bluff Subdivision Section 3, Phase 3 Mr. Grenard presented to the Board and recommended approval of Addendum #5 for the Utility Service Agreement for Avalon Bluff Subdivision Section 3, Phase 3. The owner is Tippecanoe Development II, LLC and consists of 72 residential lots approximately 15.434 acres. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. Board of Public Works and Safety July 20, 2021 Page 2 Utility Service Agreement-Barrington Woods Subdivision, Section 2 Mr. Grenard presented to the Board and recommended approval of a Utility Service Agreement for Barrington Woods Subdivision Section 2. The owner is Tippecanoe Development II, LLC and consists of 29 single family residential lots. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed. Purchasing Declaration of Surplus Property-Police Department Dave Payne, Purchasing Manager, presented to the Board and recommended approval of a Declaration of Surplus Property with the Police Department that includes 9 vehicles that will be traded in on new vehicle purchases. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. CLAIMS Jeremy Diehl, Controller, presented for Board approval, Claims in the amount of $4,260,549.89. Mr. Childress asked a question on Page 5 regarding the Old National Bank invoices for revenue bonds for the Police Station. Mr. Diehl stated that those are different invoices for two different bonds that were issued separately for the Police Station Project. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. MISCELLANEOUS Special Event Request-Yoga by the Fountain Kim Barrett, Event Representative, presented to the Board and recommended approval of a Special Event Request for Yoga by the Fountain to held on September 23, August 13, September 10 and October 1, 2021 from 12:00noon-1:00pm located at Riehle Plaza by the fountain. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. 2021 Byrne Local law Enforcement Assistance Grant Chad Robinson, Lafayette Police, informed the Board that Lafayette Police will be applying for the 2021 Byrne Local Law Enforcement Assistance Grant for $35,220.00 with a 80%/20% split with the Tippecanoe County Sheriff’s Department. The $28,176.00 City allotment will go towards a purchase for 6 portable police radios. Time: 9:12 a.m. President Henriott stated that the Board will reconvene in five (5) minutes for the Animal Control Appeal Hearing. Animal Control Appeal Hearing-Macey Waters Board of Public Works and Safety July 20, 2021 Page 3 BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES July 20, 2021 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, July 20, 2021 at 9:18 a.m. in the Common Council Chambers. Members present were: Cindy Murray, Amy Moulton, Ron Shriner and Norm Childress. Absent: Gary Henriott Jacque Chosnek, City Attorney, was also present. Mrs. Murray called the meeting to order. Animal Control Appeal Hearing-Macey Waters (Lola) Mrs. Chosnek stated that the appeal was filed by Macey Waters for her dog Lola that was impounded. Mrs. Chosnek stated that no one is an attendance on behalf of Ms. Waters and Lola. Mrs. Chosnek stated that Ms. Waters was notified of the hearing by both telephone and mail regarding today’s proceedings. Mrs. Chosnek asked Animal Control Officer (ACO) Josh Klumpe to give a brief history and overview of this animal. ACO Klumpe stated that the ACO’s have known about Macey and her boyfriend Derek Nees for quite some time. They have lived in multiple areas of town. Every time their animals have gotten loose they co-claim ownership of all their dogs in the house. The animals get loose often. There is a Dangerous Animal Agreement dog inside the house. ACO Klumpe stated that on the same day that Lola was ceased, Zena was also ceased on a final Nuisance Animal Agreement with no appeal rights after that. Lola was ceased on a Habitual Offender offense. ACO Klumpe agreed that if the dog Lola is returned there would be further violations. ACO Klumpe stated that Lola might be pregnant. ACO Klumpe recommended to the Board that they deny the appeal and not return the dog to the owner Ms. Waters or Mr. Nees. The dog is approximately 1 year old. Mr. Childress moved to deny the appeal and not return the dog to the owner. Mrs. Moulton seconded. Denied.
