MINUTES
November 19, 2024
Regular Session:
The Board of Public Works and Safety met in regular session on Tuesday, November 19, 2024 at 9:00 a.m. in the
Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Ron Shriner, Amy Moulton
and Eric Rody
Jacque Chosnek, City Attorney, was present at the meeting.
President Henriott called the meeting to order.
The Pledge of Allegiance was given to the flag of our Country.
MINUTES
Mrs. Moulton moved for approval of the minutes from the November 12, 2024 regular meeting. Mrs. Murray
seconded. Passed.
BID OPENING
Manhole Grade Adjustment Project
This being the time set to open bids for the Board of Public Works and Safety for the Manhole Grade Adjustment
Project the following bids were received and opened:
Heartland Contractors
Lafayette, Indiana
Base Bid: $386,900.00
Dixon Construction
Lafayette, Indiana
Base Bid: $313,900.00
Rieth-Riley Construction

Mr. Shriner moved to take the bids under advisement for further review. Mr. Rody seconded. Passed.

NEW BUSINESS
Engineering
Contract-2024 Paving Loop Replacement Project
Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Contract for the
2024 Paving Loop Replacement Project with Hawk Enterprises in the amount of $15,200.00. Mr. Gernard stated
that quotes were received from James H. Drew in the amount of $35,530.00, Midwestern Electric in the amount
of $42,200.00 and Hawk Enterprises in the amount of $15,200.00. The project includes 34 loops. Mrs. Moulton
moved for approval. Mr. Rody seconded. Passed.
Permission to Advertise-Utility Emergency Repairs for 2025
Dave Griffee, Engineering, presented to the Board and recommended approval of a Permission to Advertise for
the Utility Emergency Repair for 2025. Mr. Griffee stated that the publications are set to run on November 22 and
29, 2024 with the bid opening scheduled for December 10, 2024. Mr. Griffee stated this is for the annual selection
of contractors to perform emergency work for Lafayette Renew and Water Works during the 2025 calendar year.
Mr. Rody moved for approval. Mrs. Murray seconded. Passed.
Water Works
Resolution 09-2024 PER Acceptance Resolution
Steve Moore, Water Works Superintendent, presented to the Board and recommended approval of Resolution 09-
2024 PER Acceptance Resolution. Mr. Moore read the Resolution into the minutes:
“WHEREAS, the City of Lafayette, Indiana, has caused a Preliminary Engineering Report, PER, dated
October 2024, to be prepared by the consulting firm of Wessler Engineering, Inc.; and
WHEREAS, said PER has been presented to the public at a public hearing held on Tuesday, November
12th, 2024, for their comments; and

WHEREAS, the City of Lafayette’s Board of Public Works and Safety finds that there was not sufficient
evidence presented in objection to the recommended project in the Preliminary Engineering Report.
NOW, THEREFORE BE IT RESOLVED THAT:
The Lead Service Line Replacements Preliminary Engineering Report dated October 2024 be approved
and adopted by the Lafayette Board of Public Works and Safety; and
That said PER be submitted to the State Revolving Fund Loan Program for review and approval.
Passed and adopted by the Lafayette Board of Public Works and Safety this 19th day of November, 2024,
at their regular scheduled meeting.”
Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed.
Resolution 10-2024 SRF Loan Program Signatory Authorization Resolution
Mr. Moore presented to the Board and recommended approval of Resolution 10-2024 SRF Loan Program
Signatory Authorization Resolution. Mr. Moore read the Resolution into the minutes:
“Whereas, the Lafayette Water Works of the City of Lafayette, Indiana, (the “Participant”) has plans for a
drinking water infrastructure improvement project to meet State and Federal regulations and the Participant
intends to proceed with the construction of such project:
Now, therefore, be it resolved by the Board of Works and Public Safety, the governing body of the Participant,
that:
1. The City of Lafayette be authorized to make application for a State Revolving Fund Loan (“SRF Loan”)
and provide the SRF Loan Program such information, data and documents pertaining to the loan process
as may be required, and otherwise act as the authorized representative of the Participant; and
2. The Participant agrees to comply with State and Federal requirements as they pertain to the SRF Loan
Program; and
3. Two certified copies of this Resolution be prepared and submitted as part of the Participant’s Preliminary
Engineering Report.
Adopted and Passed by the Board of Public Works and Safety of the City of Lafayette, Indiana, this 19th day of
November, of 2024.”
Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed.
CLAIMS
Paula King, Controller’s Office, presented for Board approval of Claims in the amount of $4,114,599.21. Mrs.
King answered Mr. Rody’s question regarding the relationship with the Art Museum and the City of Lafayette.

MISCELLANEOUS
Banner Request-Union Club Hotel (Purdue University)
President Henriott presented to the Board and recommended approval of a Banner Request for the Union Club
Hotel (Purdue University). The banner is to be hung across Columbia Street from December 17-31, 2024. Mr.
Shriner moved for approval. Mrs. Murray seconded. Passed.

ANIMAL APPEAL MINUTES
November 19, 2024
Appeal Hearing:
The Board of Public Works and Safety met on Tuesday, November 19, 2024 at 9:15 a.m. in the Common Council
Chambers. Members present were: Gary Henriott, Ron Shriner, Cindy Murray, Amy Moulton and Eric Rody.
Jacque Chosnek, City Attorney, was also present.
President Henriott called the meeting to order.
Animal Control Appeal Hearing-David Parker
Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that neither petitioner
David Parker or Nyla Carpenter were in attendance at the hearing for Draco. Ms. Chosnek stated that Draco was
impounded on November 9, 2024 and the appeal was filed on November 13, 2024 in the Clerk’s Office. The
owners were notified of today’s hearing both by letter, attempted voicemail, and by email.
Animal Control Officer (ACO), Mitchell Burchfield, stated that he was familiar with all of the incidents with
Draco (Pitbull). Ms. Chosnek went through the timeline of all the calls/issues with Draco with ACO Burchfield
that included the following:
April 30, 2024-Draco was Running at Large (ACO told them to use a tie-out and repair the fence)
May 8, 2024-Draco was Running at Large (When ACO arrived the dog was already back inside the home)
June 14, 2024-Draco was Running at Large
June 15, 2024-Draco was Running at Large
July 16, 2024-Draco was Running at Large (Nuisance Animal Agreement was signed by owners)
July 25, 2024-Draco was Running at Large (ACO gave extra chance and $150 citation was issued)
August 2, 2024-Draco was Running at Large (ACO gave extra chance and $250 citation was issued)
November 2, 2024-Draco was Running at Large (Dog was not located by ACOs)
November 9, 2024-Draco was Running at Large (ACO ceased, impounded and taken to Humane Society 4
Greater Lafayette)
ACO Burchfield confirmed the details of all of the calls/issues with Draco that Ms. Chosnek went over in the
timeline. ACO Burchfield answered questions from the Board regarding when the dog was ceased and the extra
chances the ACOs gave the owner. Mr. Rody asked if the fines totaling $400 were paid. Ms. Chosnek stated that
they are not paid. President Henriott asked about the behavior of the dog towards the neighbors. Discussion

ensued. Ms. Murray asked if the dog was altered. ACO Burchfield stated that the dog is not altered and is between
2-5 years old. Mr. Shriner stated that the issue is that the dog runs at large but is not considered a dangerous
animal to the public.
ACO Burchfield recommended that Draco not be returned to the owner, remain at the shelter, and the appeal
denied. Mr. Shriner moved to deny the appeal. Mr. Rody seconded. Denied.
