BOARD OF PUBLIC WORKS AND SAFETY MINUTES October 28, 2025 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, October 28, 2025 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton, and Ron Shriner. Absent: Eric Rody Jacque Chosnek, City Attorney, was present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the October 21, 2025 regular meeting. Mr. Shriner seconded. Passed. NEW BUSINESS Engineering Subdivision Variance Request-Hinder Minor Subdivision: South Street Right-of-Way Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Subdivision Variance for Hinder Minor Subdivision: South Street Right-of-Way. The request is for a two-lot single-family subdivision on 0.4 acres located on the northwest corner of South Street and 22nd Street. The existing right-of-way is a total of 60’ (30’ half-width). This variance would allow the subdivision to go forward without the dedication of the 10’ of additional right-of-way on the north side of South Street. Mr. Grenard answered questions from the Board. Mrs. Murray moved for approval. Mrs. Moulton seconded. Passed. Contract-2025 Paving Loop Replacement Project Mr. Grenard presented to the Board and recommended approval of a Contract for the 2025 Loop Replacement Project with Hawk Enterprises in the amount of $26,700.00. The Engineering Office solicited quotes from James H. Drew, Hoosier Company and Hawk Enterprises. Only one quote was received by Hawk Enterprises. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Purchasing Recommendation of Contract Renewal for Landscape Maintenance-Brightview Landscapes Mr. Payne presented to the Board and recommended approval of a Recommendation of Contract Renewal for Landscape Maintenance with Brightview Landscapes, LLC. Mr. Payne stated that Brightview will perform the same landscape services for the same contract amount in the 2025 contract ($409,261.20). Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Board of Public Works and Safety October 28, 2025 Page 2 Declaration of Surplus Property-Fleet Maintenance Mr. Payne presented to the Board and recommended approval of a Declaration of Surplus Property for Fleet Maintenance that includes a 2022 Ford Explorer PIU VIN#1FM5K8ABXNGC23218 City# 22-8. Mr. Payne stated that the vehicle will be transferred to the insurance company as part of the settlement in a total loss crash. Mrs. Murray moved for approval. Mr. Shriner seconded. Passed. CLAIMS Jeremy Diehl, Controller, presented for Board approval of Claims in the amount of $4,747,132.11. President Henriott asked if there were any further questions and there were none. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. MISCELLANEOUS Special Event Request-Purdue University Holiday Reception President Henriott presented to the Board and recommended approval of a Special Event Request for the Purdue University Holiday Reception to be held on December 11, 2025 from 4:00pm-9:00pm in the Big 4 Depot Community Room. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Special Event Request-Pearl Harbor Day Robert Mantle, Event Representative, presented to the Board and recommended approval of a Special Event Request for Pearl Harbor Day to be held on December 7, 2025 from 12:00noon-2:00pm in the Big 4 Depot Community Room. Mr. Mantle distributed the program for the event and invited the public to the 250th Ball for the Marine Corp League. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. President Henriott stated that there will be a brief recess and then will continue for the Code Violation Appeal in 3 minutes. Time: 9:10 a.m. Code Violation Appeal-Onyx Mining LLC Kara Boyles, Staff Attorney, gave a brief description of the procedure for this hearing. The appeal is for 1324 Union Street and the property is owned by Onyx Mining, LLC. Jay Rosen, Code Enforcement Officer, stated that his role is to uphold the tall grass ordinance and encourage property owners to comply with that ordinance within the City limits. Mr. Rosen stated that on September 9, 2025 he went by the lot at 1320 and 1324 Union Street and observed that the grass was well over the 10-inch limit. Mr. Rosen tagged the lot/fence with an orange tag and then sent a letter to the property owner via USPS mail. Mr. Rosen stated that he measured the grass at that time, and it measured at 26 inches tall that is in the public right-of- way. Mr. Rosen used a PowerPoint presentation to show pictures of the lots. Mr. Rosen stated that he went back to the property on September 16, 2025 to do a reinspection for mowing. The grass still measured 26 inches in height and only partially mowed. There are weeds in the vegetation. Mr. Rosen wrote the property up for the mowing crew to come mow the property. Mr. Rosen stated that the mowing crew came later that day on September 16, 2025 and mowed the property. There was debris that needed to be removed in order for the Board of Public Works and Safety October 28, 2025 Page 3 mowing crew to mow. The pictures were provided to the Board of that debris. Mr. Rosen stated that 1324 Union Street has had 6 tall grass violations starting back in 2018 and the 1320 Union Street has had 5 tall grass violations since 2018 as well. Mr. Rosen answered questions from the Board. Angelica Kokkalis, Partner of Onyx Mining and Property Supervisor, stated that she has owned the property with her son since 2017. Ms. Kokkalis stated that every time she received a notice from the city she in turn had the property mowed. Ms. Kokkalis provided a PowerPoint presentation for the Board that includes pictures and summaries. Ms. Kokkalis stated that she was surprised to get the ordinance ticket on September 16, 2025 because the property was mowed on September 14, 2025. Ms. Kokkalis introduced Jim McKenna, Friend and Associate of Ms. Kokkalis, to the Board to help her with the presentation and appeal. Mr. McKenna stated that the appeal is based on the city taking action on the property without clear communication. The work would have been done themselves if given the opportunity with a notice from the city. Ms. Kokkalis stated that she has never mowed that back corner section of the property in the last seven years because it is very hard for the mower to get through that part and that section could be used as a buffer between her property and the neighboring building (Lincoln Center) and also a place for wildlife habitat. Ms. Kokkalis complained that there is trash and debris that is constantly being thrown into this property. Mr. McKenna went over all of the notices/letters/violations that the city sent to Ms. Kokkalis, making note that clear instructions were not given. Mr. McKenna stressed to the Board this could all have been avoided with better communication from the city. Mr. McKenna showed the Board a video of the property from Thomas Gongora, Property Manager, depicting the status of the property. Ms. Kokkalis answered questions from the Board. Discussion ensued. President Henriott stated that this process is to get property owners to clean up the mess and kept clean by their own initiative, not by waiting for the city to send notice of violation. Ms. Kokkalis stated that Mr. Rosen could have communicated better and this could have been avoided. Ms. Kokkalis requested that the Board remove the code violation citation. Mr. Shriner stated that there is an ordinance violation history with this property and understands that Ms. Kokkalis is upset about the citation. Mrs. Moulton moved to deny the appeal. Mr. Shriner seconded. Denied. Ms. Kokkalis asked the Board for direction with the property for future use and/or partnering with the city.
