AREA BOARD OF ZONING APPEALS OF TiPPECANOE COUNTY
LAFAYETTE DIVISION
November 18, 2019
The City of Lafayette Board of Zoning Appeals met in reguiar session on Monday, November 18,2019 at
4:00 PM. Members present were; Jackson Bogan, Tracy Walder, Dave Williams, David Lahr, and Jake
Gray.
The meeting was called to order by Mr. Bogan. Ms. Walder moved to approve the minutes of the previous
meeting as distributed; second by Mr. Williams. The motion passed by unanimous voice vote.
OLD BUSINESS
2019-26 Petition filed by GAETA CONSTRUCTION, LLC for multiple requests for property located
atHSS.EARLAVE.
1) Variance to reduce the front yard setback to 10' instead of the required 40'.
2) Variance to reduce the side yard setback to 14" instead of the required 30'.
This petition was continued from the October 21, 2019 meeting.
Ms. Waider moved to hear and approve the petition, second by Mr. Williams. Joe Bumbieburg, agent for
the petitioner, presented the petition. The petitioner, Marino Gaeta, was also present.
Mr. Bumbieburg stated that this is his third time at the meeting representing this petition and that two issues
have been brought before the board. The first issue has to do with enforcement matters which Mr.
Bumbleburg believes are not relevant to the purpose of the board. Regardless, these matters have been
corrected to the satisfaction of city code enforcement and an email from Mr. Griffee confirmed this. Mr.
Bumbieburg stated that the second issue has to do with a decrepit building onsite that should be replaced.
The plan is to rebuild the new building over the footprint of the existing building which would be a positive
impact on the site and genera! area. Mr. Bumbieburg respectfully requested approval of the variances.
Mr, Williams asked for clarification on the building that is being replaced and the buiiding towards the front
of the property. The rear portion of the existing building is being replaced but the front portion of the building
is staying as-is. The reason they are requesting the front yard setback is to make sure that any issue with
grandfathering goes away. This will bring the entire structure into compliance.
Mr. Williams asked if anyone would like to speak in favor or in opposition of this petition. Jen Dekker stated
that she hopes enforcement continues moving forward. She also stated that to operate an auto sales
business, other site improvements must be made before the certificate of occupancy can be granted. She
is happy with the improvements that have been made thus far.
Mr. Griffee confirmed that parking spaces wiil need to be paved and that will be part of any future building
permit requirement. We also have the authority to enforce our tree-planting requirements with any
redeveiopment. Any other zoning parameters will need to be foilowed.
The Board voted by bailot:
1) 5 yes 0 no. Petition GRANTED.
2) 5 yes O no, Petition GRANTED.
2019-28 Petition filed by ARCP MT LAFAYETTE IN, LLC for a variance to allow a total sign area of
90 SF (two 45 SF signs) instead of the allowed 40 SF. Property located at 210 S. GREASY
LN.
Ms. Walder moved to hear and approve the petition, second by Mr. Williams. Dan Teder, agent for the
petitioner, presented the petition.
Mr. Teder stated that the petitioner is the owner of Lafayette Pavilions and the variance is for a tenant
located on Lot 10 in Lafayette Pavilions. The tenant is Five Guys. The strip center is approximately 1,500
square feet and is located on the east side of Lafayette Pavilions. They are requesting an increase in
signage so a 45 square feet sign can face Greasy Lane to the east and another 45 square feet sign can
face the Lafayette Pavilions entrance drive directly to the north. Mr. Teder stated that the board has granted
similar requests in the area and he believes the request is reasonable,
The Board voted by ballot:
1) 5 yes 0 no. Petition GRANTED.
2019-29 Petition filed by STAR CITY CROSSING for a variance to allow a total sign area of 258 SF
instead of the allowed 104 SF. Property located at 500 SOUTH ST.
Ms. Walder moved to hear and approve the petition, second by Mr. Williams. Chris Shelmon, agent for the
petitioner, presented the petition. The petitioner, John Caron, was also present.
Mr. Shelmon stated that the request permits multiple building signs on the new mixed-use building being
constructed on this site. This would allow for commercial and residential signage. Ms. Walder asked for
clarification on one of the site plans and Mr. Shelmon went over the site plans to explain where the
signagewill be.
The Board voted by ballot:
1) 5 yes 0 no. Petition GRANTED.
The next meeting of the Lafayette Board of Zoning Appeals will be on Tuesday, January 21, 2020 at 4:00
PM. There being no further business to come before the Board at this time, the meeting was adjourned at
4:20 PM.

2) Variance to allow a total freestanding sign area of 98 SF instead of the allowed 40 SF.
3) Variance to allow a freestanding sign setback of 8’ instead of the required 20’
