AREA BOARD OF ZONING APPEALS OF TIPPECANOE COUNTY
LAFAYETTE DIVISION
November 20, 2023
The City of Lafayette Board of Zoning Appeals met in regular session on Monday, November 20,2023 at
4:00 PM. Members present were: Jackson Bogan, Dave Williams, Dick Murray, Bob Metzger, and Carlynn
Smith.
Mr. Williams moved to approve the minutes of the previous meeting as distributed; second by Mr. Metzger.
The motion passed by unanimous voice vote.
NEW BUSINESS
2023-19 7 BREW Variance to allow a total sign area of 99.4 SF instead of the allowed 31 SF.
Property located at 3842 SOUTH ST.
Mr. Williams moved to hear and approve the petition; second by Mr. Metzger. Crystal Whitehead and Toby
Whitehead, agents for the petitioner, presented the petition.
Ms. Whitehead stated that when travelling on eastbound South Street that is difficult to see this location
and there also needs to be signage behind from the direction of the hotels. Mr. Whitehead stated that the
signage is similar to other signage in the area.
Referencing the submitted plan, Mr. Began confirmed the location of the proposed signs with the
presenters.
The Board voted by ballot: 5 yes 0 no. PETITION GRANTED
2023-20 DOLLAR TREE Multiple requests for property located at 3577 PROMENADE PKWY:
1) Variance to allow a total sign area of 146.25 SF instead of the allowed 52 SF.
2) Variance to allow a freestanding sign area of 44 SF instead of the allowed 40 SF.
Mr. Williams moved to hear and approve the petition; second by Mr. Metzger. Andrew David, agent for
the petitioner, presented the petition.
Mr. David stated that they are seeking sign variances for standard Dollar Tree signage. The variance will
be for "Dollar Tree" and its emblem as well as a monument sign. Due to the setback from the street, the
increased signage will provide for better visibility. Other requests in this area have been granted, some
for even more area, but we are asking for this petition to be approved.
The Board voted by ballot:
1) 5 yes 0 no. REQUEST GRANTED
2) 5 yes O no. REQUEST GRANTED
2023-21 TRIPLE R, LLC Multiple requests for property located at 106 S 8TH ST:
1) Variance to allow a lot area of 3,069 SF instead of the required 4,000 SF.
2) Variance to allow a maximum lot coverage by all buildings of 38% instead of the
allowed 35%.
3) Variance to allow a lot width of 32 feet instead of the required 40 feet.
Mr. Williams moved to hear and approve the petition; second by Mr. Metzger. Kevin Riler, agent for the
petitioner, presented the petition. The petitioner, Jeff Rider, was also present.
Mr. Riley explained that the owners have acquired similar approvals in the past; they are developing lots
in this area for single-family homes. He passed out a drawing representing a typical home that they are
building. This is a remnant lot which is why the variance requests are necessary. All of the other zoning
requirements will be met. Mr. Riley then discussed their general assessment of the findings of fact.
Mr. Williams asked why they were starting with the lot in question. Mr. Rider explained that they will be
building the homes in a row, and this one is at the end. Mr. Williams asked about the lots on the other side
of the street. Mr. Rider explained that those lots will have a different price point. The lot in question also
has an owner that will be buying the lot after it is developed. Mr. Williams and Mr. Rider continued with a
brief discussion on the overall development that is occurring.
Mr. Murray asked about previous remonstrance regarding a prior petition. Mr. Rider answered that there
were no complaints about this petition and that there has been a significant turn-around with that
remonstrator.
The Board voted by ballot:
1) 5 yes 0 no. REQUEST GRANTED
2) 5 yes 0 no. REQUEST GRANTED
3) 5 yes O no. REQUEST GRANTED
2023-22 DJS LEASING, LLC Multiple requests for property located at 410 & 434 TEAL RD W:
1) Variance to allow a side yard setback of 20 feet instead of the required 30 feet (434
TEAL RD W).
2) Variance to allow a rear yard setback of 20 feet instead of the required 40 feet (410
TEAL RD W).
Mr. Williams moved to hear and approve the petition; second by Mr. Metzger. Kevin Riler, agent for the
petitioner, presented the petition. The petitioner, John Huston, was also present.
Mr. Riley explained that the reason for the variance is that the owner plans to build a workshop in
connection with the existing operation on the adjacent parcel. They believe this will help clean up the site.
The positioning of the building is intentional as it will align with the existing building and allow for a flow of
work.
The Board voted by ballot:
1) 5 yes 0 no. REQUEST GRANTED
2) 5 yes O no. REQUEST GRANTED
2023-23 HUTCHISON SIGN COMPANY Multiple requests for property located at 2207
SAGAMOREPKWY S:
1) Variance to allow a total sign area of 190 SF instead of the allowed 42 SF.
2) Variance to allow a freestanding sign area of 91 SF instead of the allowed 42 SF.
3) Variance to allow a freestanding sign setback of 6.7 feet instead of the required 7 feet.
Mr. Williams moved to hear and approve the petition; second by Mr. Metzger. The petitioner, Bill
Baumgartner presented the petition.
Mr. Baumgartner stated that they had received a permit for a sign that faces Sagamore Parkway. We are
asking for two additional signs on building elevations and a monument sign. Referencing the submitted
signs he showed the presented signs. We are asking for an amount of signage that has been approved
for other locations in this area.
Mr. Murray asked if this was related to the first petition today. Mr. Baumgartner stated that the client is the
same but that petition was being handled by a different vendor.
Mr. Williams asked about the sign posting requirement. Mr. Baumgartner stated that the signs were posted
in the windows and had provided photographs of the posted signage to the Engineering Department.
Mr. Bogan asked why the amount of signage being requested was different from that in the first petition.
Mr. Baumgartner responded that they are asking for more signage needed for this location due to the
multiple directions that are used to access the site.
The Board voted by ballot:
1) 5 yes 0 no. REQUEST GRANTED
2) 5 yes O no. REQUEST GRANTED
3) 5 yes 0 no. REQUEST GRANTED
The next meeting of the Lafayette Board of Zoning Appeals will be on Tuesday, January 16, 2024 at 4:00
PM. There being no further business to come before the Board at this time, the meeting was adjourned at
4:25 PM.
