MINUTES OF THE LAFAYETTE COMMON COUNCIL January 09, 2012 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday January 09, 2012 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Campbell, Brown, Ahlersmeyer, Downing and Weast- Williamson. Councilwoman Weast-Williamson moved to nominate Councilman Meyer as President of the Common Council for the year 2012, Councilman Downing seconded. The motion passed by unanimous voice vote. Thereafter, Councilman Meyer presided over the meeting. President Meyer thanked Councilman Campbell for his service during the last year. Councilman Heide moved to nominate Councilman Campbell as President Pro-Tem for the year 2012, Councilman Downing seconded. The motion passed by unanimous voice vote. The City Clerk stated that there was a quorum present. Councilman Campbell moved to approve the minutes of December 5, 2011 common council meeting and December 22, 2011 special meeting, Councilwoman Ahlersmeyer seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerks Office Monthly-November Water Pollution Control Department Monthly-November Water Works Department Monthly-November Police Department Monthly-November Fleet Maintenance/Motor Vehicle Department Monthly-November Ordinances for Second Reading The Clerk read Ordinance 2011-30 (An Ordinance Voluntarily Annexing Certain Land into the City of Lafayette, Indiana-Lafayette East Voluntary Annexation) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Mayor Roswarski spoke regarding this Ordinance. Ordinance 2011-30 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading: President Meyer asked for consideration to take Ordinance 2012-01 out of order and hear it prior to Ordinance 2008-27. Councilman Klinker moved to change the order, Councilman Campbell seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2012-01 (An Ordinance to Amend Title 4 of the Lafayette Municipal Code Entitled “Business Licensing and Regulations” to Create and “Entertainment Activities Ordinance”) by title only on first reading. Councilman Klinker moved for passage, Councilman Campbell seconded. Don Roush, Police Chief requested the Council table Ordinance 2012-01 for further review. Councilman Campbell moved to table Ordinance 2012-01 until time uncertain, Councilwoman Ahlersmeyer seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2008-27 (An Ordinance Amending the Lafayette Municipal Code Title 13 Entitled Building and Construction, by Adding Chapter 13.06 Entitled Electrical License Required) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Jenny Miller, City Engineer presented an amended version of the Ordinance and spoke regarding the changes. Councilman Campbell moved to amend Ordinance 2008-27 in its entirety and replacing it with Amended Ordinance 2008-27 as filed stamped January 9, 2012 by the City Clerk. Councilwoman Weast-Williamson seconded. Ms. Miller explained the changes. Scott Giese, 10 N 7th St, Lafayette and Brent Green 1274 Meadowbrook Dr. Lafayette both spoke regarding the amendment. Amendment passed 8-0 on a roll call vote. Councilman Campbell moved for passage of Ordinance 2008-27 as amended, Councilman Brown seconded. Ms. Miller gave a presentation regarding the Ordinance. Tim Stacey and Mark Gick, Electrical Inspectors, City of Lafayette both spoke regarding unsafe inspections within the City. Grant Giese, President of Builders Association of Greater Lafayette questioned if more meetings could be held for public input. The following citizens spoke regarding Ordinance 2008-27amended: Brent Greene, 1274 Meadowbrook Drive Chapman Flack, 1219 Brown Street Mark Dolfini, President Tippecanoe Apartment Association Perry Barbee, 3700 Redbud John Riehle, 17 N. 28th Street, Owner Steve’s Overhead Door Lloyd Wells, 3717 Rawlings Drive Rob Griffith, 28 Sonoma Court John English, 2968 Cajun Court Jon Huston, Huston Electric John Schultz, 1124 Westridge Ted Uppole, National Electric Contactors Association Chris Voglund, Artisan Electric Ordinance 2008-27amended passed 8-0 on a roll call vote on first reading. President Meyer assigned Ordinance 2008-27amended to the Ordinance Committee for a public meeting. The Clerk read Ordinance 2012-02 (An Repealing Chapter 3.01, Fire Protection: Chapter 3.02, Installation and Maintenance of Fire Warning Devices and Section 6.07.110, Burning of Paper and Leaves on Private Property and Adding Chapter 3.01; Chapter 3.02; Chapter 3.04; Chapter 3.05; and Chapter 3.06) by title only on first reading. Councilman Heide moved for passage, Councilwoman Weast-Williamson seconded. Ron Richey, Assistant Chief Fire Department spoke regarding the code changes. Ordinance 2012-02 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2012-03 (An Ordinance to Amend section 1.02.040 of the Lafayette Pertaining to the Ordinance Violation Bureau) by title only on first reading. Councilman Campbell moved for passage, Councilwoman Ahlersmeyer seconded. Jacque Chosnek, Deputy City Attorney spoke regarding the changes. Ordinance 2012-03 passed 8-0 on a roll call vote on first reading. There were no Resolutions: There were no Reports of Standing Committees: President Meyer requested Council Members review their Committee Appointments. There were no Reports of Special Committees: There was no Report by the Mayor: Miscellaneous and New Business: Councilman Campbell move to reappoint Don Teder and John Thieme Jr. to the Redevelopment Commission for term of one year, reappoint David Bathe to the Economic Development Commission for a term of 4 years, and appoint Councilman Reynolds to the Area Plan Commission, Councilman Heide seconded. The Motion passed by unanimous voice vote. There were no Reports of Council: Public Comment: Perry Barbee, 3700 Redbud congratulated Richard Doyle and Jerry Reynolds on their new positions with the City. Councilman Campbell moved to adjourn Councilwoman Ahlersmeyer seconded.
