MINUTES OF THE LAFAYETTE COMMON COUNCIL September 9, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday September 9, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilwoman Weast-Williamson moved to recess for a public hearing on Ordinance 2013-24 (A Ordinance to Vacate a Portion of the Public Way in the City of Lafayette, Indiana-Bob Rohrman Auto Group, Petitioner and Ordinance 2013-25 (A Ordinance to Vacate a Portion of the Public Way in the City of Lafayette-Purdue Federal Credit Union/City of Lafayette, Petitioners, Councilman Downing seconded. No public comment was heard. Councilman Klinker moved to resume the regular session, Councilman Heide seconded. The motion passed by unanimous voice vote. Councilman Heide moved to approve the minutes of August 5, 2013 common council meeting Councilman Brown seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Police Department Annual Report 2012 Police Department Monthly-June Clerk’s Office Monthly-July & August Water Works Department Monthly-July Water Pollution Control Department Monthly-July Fleet Maintenance/Motor Vehicle Department Monthly-July Ordinances for Second Reading The Clerk read Ordinance 2013-23 (An Amendment to Ordinance No. 2011-11 Establishing a Local Columbia Street Historic District in the City of Lafayette, Indiana-811 Columbia St) by title only on second and final reading. Councilman Meyer moved for passage, Councilman Reynolds seconded. Aimee Jacobsen, Community Development spoke regarding the ordinance. Ordinance 2013-23 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-24 (A Ordinance to Vacate a Portion of the Public Way in the City of Lafayette, Indiana, Bob Rohrman Auto Group, Petitioner) by title only on second and final reading. Ed Chosnek, City attorney spoke regarding the requested area and suggested that this ordinance be tabled until the October city council meeting due to a rezone that will coincide with this vacate. Joe Bumbleburg, Attorney for the petitioner spoke regarding the Ordinance and the changes in the plans. Councilman Reynolds moved to table until the October 7, 2013 city council meeting table Councilman Klinker seconded. The motion passed by unanimous voice vote with one abstention, Councilman -Steve Meyer The Clerk read Ordinance 2013-25 (A Ordinance to Vacate a Portion of the Public Way in the City of Lafayette, Purdue Federal Union/City of Lafayette) by title only on second and final reading. Councilmen Klinker and Meyer left the council chambers at 7:13 due to conflict of interests. Councilman Downing moved for passage, Councilman Brown seconded. Joe Bumbleburg, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2013-25 passed 6-0 on a roll call vote on second and final reading. Councilman Klinker returned to the meeting at 7:15 pm. Ordinances for First Reading The Clerk read Ordinance 2013-26 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB), 2800 Duncan Road, Aspen Lafayette Partners, Petitioner, by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Joe Bumbleburg, attorney for the petitioner spoke regarding his clients difficulty in finding a tenant with the current zoning option. Mayor Roswarski expressed concern that a nonprofit organization may be occupying the space and this would reduce tax revenue for the city, which is needed for current bond obligations. Mayor Roswarski felt with the potential industrial growth within the city it would be best to leave the area zoned Industrial. Ordinance 2013-26 failed 0 nays-7 ayes on first and final reading on a roll call vote as follows. Ayes: none Nays: Heide, Reynolds, Brown, Ahlersmeyer, Weast-Williamson and Downing Councilman Meyer returned to the council meeting at 7:30 pm. The Clerk read Ordinance 2013-27 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from NB to GB), 3613 S. 18th St- D&D,LLC, Petitioner, by title only on first and final reading. Councilman Meyer moved for passage, Councilman Klinker seconded. Dan Teder, attorney for the petitioner spoke regarding the ordinance. Ordinance 2013-27 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-28 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from GB,NB,R3,R1 to R3), Area Plan Commission Director, Petitioner, by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Sallie Fahey, Area Plan Commission gave a brief power point presentation of the affected areas. Ordinance 2013-28 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-29 (An Ordinance to Vacate a Portion of the Public Right-of- Way in the City of Lafayette, Indiana), Larry Keller, Petitioner, portion of land the right of 1001 Queen Street, by title only on first reading. Councilman Meyer moved for passage, Councilman Reynolds seconded. Ed Chosnek, Attorney informed council that he had received a request from the petitioner to table the ordinance due to unresolved issues. Councilman Meyer moved to table Ordinance 2013-29 to time certain October 7, 2013, Councilman Klinker seconded. The motion passed by unanimous voice vote. Resolutions: The Clerk read Resolution 2013-14 (A Resolution of the Common Council of the City of Lafayette, Indiana, Approving the Order of the Tippecanoe County Area Plan Commission Amending the Development Plan for the McCarty Economic Development Area) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Dennis Carson, Economic Development Director spoke regarding the resolution. Resolution 2013-14 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no Report by the Mayor. Miscellaneous or New Business: Dennis Carson, Economic Development Director presented a 2013 Compliance with Statement of Benefits for Tax Abatement for Federated Publications and requested the Council to find them in compliance. Councilman Meyer moved to find Federated Publications in substantial compliance, Councilman Klinker seconded. The motion passed by unanimous voice vote. There were no Reports by Council. Public Comment: Pearl Speakman, 923 S. 22nd St spoke regarding concerns with code enforcement in the City of Lafayette. Mayor Roswarski responded to Mr. Speakman’s comments. Lloyd Wells, 3717 Rawlings spoke regarding concerns with possible moped law changes. Perry Barbee, 3700 Redbud asked everyone to remember the anniversary of September 11th. Brad Talley, Water Pollution Control, reminded everyone of the Rain Barrel Auction on Friday September 20. 2013 Dan Wenger, 32 Windy Hill Dr. expressed concern over the Animal Control Ordinance enforcement. Pat Flannelly, Police Chief informed everyone that the Lafayette SWAT team had placed first at a recent the State of Indiana Challenge as well as two individual honors. President Campbell requested the City Clerk send a letter of congratulations to the Police Department for their recent accomplishment from the Council. Richard Doyle, Fire Chief announced the Fire Department received an award for Fire Prevention Department of the Year for Indiana and 5 members of the department will be receiving the first ever Life Saving Awards for rescuing a young lady from a burning apartment on July 10th. President Campbell requested the City Clerk send a letter of congratulations to the Fire Department for their recent accomplishment from the Council. Bob Foley, Engineering invited everyone to the Ribbon Cutting for Veterans Memorial Parkway on Friday September 13th at 10:30 am. Councilman Heide moved to adjourn, Councilman Klinker seconded.
