Page 2 of 8 Page 1 of 6 Village of Lake Barrington AGENDA MEMORANDUM To: Village President and Board of Trustees From: Karen Daulton Lange, Village Administrator Subject: KAZIMOUR DRIVE Action Requested: ☐Approval ☐Concurrence ☒Discussion ☐Information Recommended for Consent Agenda: ☐Yes ☐No Meeting Date: May 03, 2022 Executive Summary Kazimour Drive was platted as a private street, along with a portion of Center Drive, which is now called Rivers Bend Drive, as part of the Basswood Island Estates subdivision. Discussion Background Basswood Island Estates was platted in 1963. It was a subdivision of 4 lots on Kazimour Drive and 3 lots on Center Drive. Based on the Lake County aerial imagery, the homes along Center Drive were constructed sometime between 1974 to 1980, and the homes along Kazimour were constructed between 1990 to 1992. Center Drive, which is now called Rivers Bend Drive, was dedicated to the Village with the platting of the Rivers Bend Subdivision in 1977, but Kazimour Drive remains a private street. Subsequent to the four homes being built in Lake Barrington along Kazimour, the Port Barrington developments to the west of the restaurant and townhomes were developed, around 1997. In 2004, the Village granted a permit to the Port Barrington Shores Property Owners Association (“PBS POA”) to regrade the ditches in front of the four Lake Barrington homes, and in 2010, the Village granted a permit to that PBS POA to grind and resurface the entire Kazimour Drive from River Road to the Village limits which end at the property line to the restaurant. Current Situation When any of the four Lake Barrington homeowners along Kazimour applies for a driveway resurfacing permit, or replaces their private driveway culvert, the only rights of access such homeowners have for such work is reliance on the original dedication of Kazimour Drive on the Basswood Island Estates Plat of Subdivision because technically those areas where this work would have to be done fall within the parcels still owned by Henry J. Lageschulte and/or Harris Trust 6679. Page 3 of 8 Page 2 of 6 The Port Barrington Shores HOA has requested in the past that the Village regrade the ditches again, and I have said we cannot as we do not own the road, nor will Cuba Township as it is considered private property. Recently the HOA contacted me again as they would like additional drainage work to be done and they are looking at resurfacing the road again. Their immediate concern is the condition of the culverts and ditch drainage in front of the four homes, which they contend is detrimental to the life of the pavement due to the standing water. They also did not realize that the road in front of the four homes was not owned by the HOA. Considerations Kazimour is a private drive which provides ingress and egress for the 32 residential condominium units in the gated Port Barrington Shores condominium complex, and the Port Barrington Shores Dock Association which has approximately 50 docks within the Village of Port Barrington that are accessed through the ‘No Wake’ restaurant and bar parking lot, along with the customers who only come to No Wake. The immediate concern is that there may be a need to evaluate the drainage in the south ditch line adjacent to the four homes and to decide if the Village should proceed with any necessary drainage improvements regardless of the respective ownership interests of this private street, or should the Village attempt to contact the Trust No. 6679 and Henry J. Lageschulte and request transfer and dedication to the Village, or to allow the present circumstances to continue as is. An ongoing consideration is that this is a very unusual private road most of which is within our Village. The private right-of-way that exists now is 36 feet wide, instead of the standard 66 feet. It also only serves four Lake Barrington residents. These Lake Barrington homeowners have no HOA on record, and these owners do not have an ownership interest in or management authority for the private road, other than the private road dedication recorded as part of the Plat of Subdivision of Basswood Island Estates (recorded on January 30, 1963, as Document No. 1175492). Recommended Action Discuss and direction.
