CALL TO ORDER A Special Meeting of the President and Board of Trustees of the Village of Lake Barrington, meeting as the Committee of the Whole (“COTW”), was held at the Village of Lake Barrington Village Hall, Conference Room, 23860 N. Old Barrington Road, Lake Barrington, Illinois on May 9, 2024 at 5:59 p.m. (immediately prior to the regular Board of Trustees Meeting at 7:00 p.m.). 2. ROLL CALL Upon the roll being called, the following Trustees were physically present at said location: Trustees Burke, Hayes (arrived at 6:04 p.m.), Perkins, Schaller, Schallmoser, Van Ryne, and President Richardson. The following Trustee was allowed by a majority of the members of the President and Board of Trustees in accordance with and to the extent allowed by rules adopted by the President and Board of Trustees to attend the meeting by video or audio conference: None The following Trustees were absent and did not participate in the meeting in any manner or to any extent whatsoever: None Staff Present: Village Administrator Sharon Peterson, Village Clerk Rebekah Harrington and Treasurer Peggy Hirsch Others Present: Village Attorney Jim Bateman Other Attendees: 3. APPROVAL OF MINUTES A. Minutes of the Special COTW Board of Trustees Meeting April 17, 2024. BOARD ACTION: A motion was made by Trustee Schaller and Seconded by Trustee Perkins Approve the minutes, item A above. (roll call vote) Upon roll call the vote was: Ayes: President Richardson, Trustee Burke, Trustee Perkins, Trustee Schaller, Trustee Schallmoser, and Trustee Van Ryne Nays: None Abstained: None Absent: Trustee Hayes Jr. 1 Page 3 of 9  President Richardson declared the motion carried. 4. DISCUSSION Item 4.A. is detailed below. Items 4.B. through 4.E. were detailed in the Consent Agenda. Items 4.F. and 4. G. were not on the Agenda, but were provided as updates from the Board and are detailed below. A. Discussion on Water and Sewer Rate Proposal. The RFP was advertised on March 15, 2024 via Daily Herald, Village of Lake Barrington Website and email. The deadline for questions was on March 18th, the Pre Bid Conference was on March 22nd, and the deadline for the RFP proposal submission was on April 19th. Three firms submitted: Baker Tilly, Gewalt Hamilton, and New Gen Strategies. Baker Tilly is the recommended firm and it was added that this firm partners with HR Green for engineering. Also noted by the Administrator was that several other nearby Villages have contracted with Baker Tilly whom all provided a positive recommendation. B. Consideration of a Proposal for Professional Services with Tria Architecture of Burr Ridge, IL in the Amount of $5,500.00 for a Schematic Design of Renovations to Create a Breakroom Space in Village Hall. C. Consideration of a Proposal from Baxter Woodman for Source Water Protection Plan. D. Consideration of an Ordinance Amending the Village Code; Building Permit Fees. E. Consideration of a Temporary Use for the Field and Flower Garden Club to hold a Plant Sale at Freier Farm on Saturday, May 18, 2024 from 7:30 a.m. to 3:00 p.m. F. Building Permit Application Portal Discussion. It was addressed that progress has been made in the creation of the new Building Permit Application Portal by Chalmers Street. It is estimated that a soft launch of the program will be ready by the end of May or June. Throughout this process, weekly meetings have been and are still being held to ensure understanding and communication along the way. G. Barrington Harbor Estates Traffic Management Discussion. New concerns arose in regard to the safety on residential roads in Barrington Harbor Estates due to vehicle speeding and lack of signage. Trustee Schallmoser and Administrator Peterson expressed they would hear the recent concerns in Barrington Harbor Estates and discuss further action on the matter. 5. ADJOURNMENT BOARD ACTION: A motion was made by Trustee Burke and Seconded by Trustee Schallmoser to adjourn the COTW meeting. Harrington Village Clerk 3 Page 5 of 9 05/24/24 05/28/24 06/10/24 VILLAGE OF LAKE BARRINGTON ______________________________________________________________________________ ORDINANCE NO. 2024-___________ AN ORDINANCE AMENDING THE VILLAGE OF LAKE BARRINGTON VILLAGE CODE (Re: Title 6, “Public Ways and Public Property”, Section 6-3-11, “Owner to Maintain Parkways and Ditch; Cutting of Weeds and Grasses in Adjacent Rights-of-Way”) ______________________________________________________________________________ ADOPTED BY THE CORPORATE AUTHORITIES OF THE VILLAGE OF LAKE BARRINGTON, ILLINOIS THIS ___________ DAY OF _______________, 2024. ______________________________________________________________________________ Page 6 of 9  Ordinance No. 2024-O-___________ AN ORDINANCE AMENDING THE VILLAGE OF LAKE BARRINGTON VILLAGE CODE (Re: Title 6, “Public Ways and Public Property”, Section 6-3-11, “Owner to Maintain Parkways and Ditch; Cutting of Weeds and Grasses in Adjacent Rights-of-Way”) WHEREAS, the Corporate Authorities of the Village of Lake Barrington find that it is in the best interests of the Village and its residents to amend certain provisions of the Lake Barrington Village Code relative to maintenance of areas adjacent to Village rights-of-way as set forth herein: NOW THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lake Barrington, Lake County, Illinois, in exercise of its authority as a Home Rule unit, as follows: SECTION 1: The President and Board of Trustees hereby find that the recitals hereinabove set forth are true and correct and are incorporated into the text of this Ordinance as its findings to the same extent as if each such recital had been set forth herein in its entirety. SECTION 2: Section 6-3-11, “Owner to Maintain Village Parkways and Ditch” of Chapter 3, “Street Construction, Maintenance, and Repair”, of Title 6, “Public Ways and Public Property”, shall be and is hereby amended to read as follows (underlined language shall be added, and interlined language shall be stricken): “6-3-11: OWNER TO MAINTAIN VILLAGE PARKWAYS AND DITCH; CUTTING OF WEEDS AND GRASSES IN ADJACENT RIGHTS-OF-WAY: A. Unless otherwise directed by the Village, the owners and occupants of the abutting private or public property shall be jointly and severally obligated to maintain unpaved portions of adjacent Village streets, rights-of-way and easements, including, but not limited to, parkways, culverts, storm drains, ditches and any and all other drainage facilities, unobstructed and free from foreign or natural materials or objects and said areas shall be maintained in accordance with all applicable standards and provisions of this Title and and/or Title 9 of this Code. 1 Page 7 of 9  B. No person owning, having charge of or being in possession of land within the Village shall fail to keep the adjacent right-of-way between such property and the curb, or between such property and the edge of street where there is no curb, free from all weeds. C. No person owning, having charge of or being in possession of land within this Village shall fail to keep the adjacent right-of-way between such property and the curb, or between such property and the edge of the street where there is no curb, free from grass and/or weeds which have grown to a height in excess of ten (10) inches.” SECTION 3: The Corporate Authorities of the Village intend that this Ordinance will be made part of the Village Code and that sections of this Ordinance can be renumbered or relettered and the word “Ordinance” can be changed to “Section”, “Article”, “Chapter”, “Paragraph”, or some other appropriate word or phrase to accomplish codification, and regardless of whether this Ordinance is ever codified, the Ordinance can be renumbered or relettered and typographical errors can be corrected with the authorization of the Village Attorney, or his or her designee. SECTION 4: This Ordinance shall not affect any punishment, discipline, infraction, or penalty or any action based on any other Ordinance of this Village incurred before the effective date of this Ordinance, nor any suit, prosecution or proceeding pending at the time of the effective date of this Ordinance, for an offense or violation committed or cause of action arising before this Ordinance, and said other ordinances as heretofore existing shall continue in full force and effect for said limited purpose. SECTION 5: If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance, or any part thereof. The Board of Trustees hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, subdivision, paragraphs, sentences, clauses or phrases be declared unconstitutional, invalid or ineffective. 2 Page 8 of 9  SECTION 6: This Ordinance shall be in full force and effect from and after its passage, approval and publication, as required by law. SECTION 7: The Village Clerk is directed to immediately publish this Ordinance in pamphlet form.
