CALL TO ORDER Mayor Nexsen called the meeting to order at 6:00 p.m. 2. INVOCATION: Pastor Ken Belch, Hilltop Community Church Pastor Ken Belch with Hilltop Community Church gave the invocation. 3. PLEDGE OF ALLEGIANCE The Mayor led in the Pledge of Allegiance. 4. ROLL CALL Present: 7- Mayor Mark S. CALL TO THE PUBLIC Major John Henage addressed the Council and stated he spent 23 years in the Army and 4 years in the Navy Submarine Service and made a trip to Lake Havasu City on one of Robert McCulloch’s Constellation Aircrafts back in 1964 before there was an island. Mr. Henage suggested that the City consider building a tunnel on the north end of the channel with access from London Bridge Road as an alternative to building another bridge. He said that would be a possible idea or alternative for future transportation. 6. CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT 7.1 ID 15-0162 Quarterly Investment Report at March 31, 2015 Mayor Nexsen noted that the investment report was for information only. 7.2 ID 15-0153 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions City Clerk Kelly Williams announced the current vacancies on various Lake Havasu City Boards, Committees, and Commissions. 7.3 ID 15-0154 City Manager’s Report City Manager Charlie Cassens reported on the following: • Human Resources-Quarterly Retirement Announcement. Jean Vinson, 22 years of service Linda Irwin, 27 years of service Ken Weaver, 25 years of service Dori Pace, 24 years of service Joe Archie, 25 years of service Chip Shilosky, 35 years of service • The Police Department would like to invite the public to attend a Peace Officer’s Memorial Service at the Lake Havasu City Police Department on Friday, May 15, 2015 at 8:00 a.m. to recognize and pay respect to our fallen heroes. • Approximately 175 people from across the State were in Lake Havasu City last week to attend the Arizona Airport Association Conference. • Increased traffic at the airport is due to military crews landing for fuel and meals. • The annual road chip program will be wrapping up this week. • Code enforcement updates. There are currently 57 active and open cases. • The Recreation Sunshine Kids Summer Camp and Camp Iwannago is now open. Registration is available at the Aquatic Center or on the City’s website at lhcaz.gov. 8. PUBLIC HEARINGS 8.1 ID 15-0120 Adopt Ordinance No. 15-1130 Amending City Code Section 9.16.160, Aircraft and Parachute Landings and Takeoffs, to Remove the Word “Balloon” Mr. Cassens advised this item was introduced at the last meeting and was before Council for final adoption. Mayor Nexsen opened the public hearing. Councilmember Barlow moved to adopt Ordinance No. 15-1130 amending Lake Havasu City Code Section 9.16.160, Aircraft and Parachute Landings and Takeoffs, to remove “balloon,” seconded by Councilmember Callahan, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.2 ID 15-0149 Adopt Resolution No. 15-2920 Appointing Member(s) to the Trails Advisory Committee Ms. Williams stated that at the April 14th meeting, the City Council adopted an ordinance establishing the Trails Advisory Committee. She added at the April 28th meeting, nine vacancies were announced and at this time, eight applications were received requesting consideration for appointment to the committee. The following applicants gave a presentation before Council: • Ms. Dale Bailey • Mr. Bruce Wallace • Mr. Jeff Smolek • Mr. Jim Rosensweet • Mr. John Masden • Ms. Mary Van Rooy • Mr. William Bryan Mayor Nexsen opened the public hearing. There being no further comments, he closed the public hearing. Councilmember Sheehy thanked the applicants for their interest in serving on the Committee. Councilmember Barlow moved to adopt Resolution No. 15-2920 appointing Ms. Dale Bailey, Mr. Bruce Wallace, Mr. Jeff Smolek, Mr. Jim Rosensweet, Mr. John Masden, Ms. Mary Van Rooy, Ms. Mindy Ritter, and Mr. William Bryan to the Trails Advisory Committee with a term ending June 30, 2017, seconded by Councilmember Brister, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.3 ID 15-0143 Adopt Resolution No. 15-2921 Declaring the “2014 Amendments to the Lake Havasu City Page 4 Printed on 5/27/2015 City Council Regular Meeting Minutes - May 12, 2015 Final Lake Havasu City Tax Code” a Public Record Mr. Cassens stated this is a routine item that when the State makes changes to the Model City Tax Code the City needs to adopt those changes at a local level. Mayor Nexsen opened the public hearing. There being no further comments, he closed the public hearing. Councilmember Callahan moved to adopt Resolution No. 15-2921 declaring the “2014 Amendments to the Lake Havasu City Tax Code” a public record, seconded by Councilmember Barlow, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.4 ID 15-0144 Introduce Ordinance No. 15-1132 Amending the Tax Code Contained in Title 3 of the Lake Havasu City Code to Adopt the 2014 Amendments to the Model City Tax Code Mr. Cassens stated this is a companion item to the previous item, declaring the changes to the Model City Tax Code as a public record and this item adopts those changes. Mayor Nexsen opened the public hearing. There being no further comments, he closed the public hearing. Councilmember Callahan moved to introduce Ordinance No. 15-1132 amending the Tax Code contained in Title 3 of the Lake Havasu City Code to adopt the 2014 Amendments to the Model City Tax Code, seconded by Councilmember Barlow, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.5 ID 15-0158 Introduce Ordinance No. 15-1131 Amending Lake Havasu City Code Chapter 12.08, Building Codes, to Adopt Designated Editions of Published Building Codes and Amendments to Codes by Reference Community Services Director Greg Froslie stated this is an amendment to Chapter 12.08 of the Lake Havasu City Code regarding building codes. He added that this is the first step in transitioning from the 2006 International Building Code to the 2012 International Building Code. Mayor Nexsen opened the public hearing. He added that the 2015 codes have been issued but have not yet been vetted so they are operating under the 2012 International Building Code. There being no further comments, he closed the public hearing. Councilmember Callahan moved to introduce Ordinance No. 15-1131 amending Lake Havasu City Code Chapter 12.08, Building Codes, to adopt designated editions of published building codes and amendments to codes by reference, seconded by Councilmember Barlow, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.6 ID 15-0163 Approve Cooperative Purchase for 2015 Polaris Rangers with Polaris Sales Inc. Maintenance Services Division Manager Mark Clark stated the item before Council is the purchase of Polaris Rangers for both the Water and Maintenance Services divisions. Mayor Nexsen opened the public hearing. There being no further comments, he closed the public hearing. Councilmember Coke moved to approve a cooperative purchase for seven Polaris Rangers with Polaris Sales, Inc., seconded by Councilmember Brister, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 8.7 ID 15-0152 Approve Sole Source Purchase for Replacement Backhoe (Case 580 Super N) with Hertz Equipment Rental Corporation Mr. Clark stated this request is for replacement of an existing Water Division backhoe. He added that the Water Division will be reducing their fleet from six to five backhoes. Mayor Nexsen opened the public hearing. There being no further comments, he closed the public hearing. Councilmember Sheehy asked for clarification how they would be reducing their fleet. Mr. Clark explained that they currently have six in operation but would be auctioning one backhoe which would leave a total of six in the fleet. He further explained that over the next year they would auction another backhoe which would leave five in the fleet. Councilmember Sheehy asked if Lake Havasu City Page 6 Printed on 5/27/2015 City Council Regular Meeting Minutes - May 12, 2015 Final equipment purchases follow the same fleet policy as other vehicles, to which Mr. Clark explained they do follow the same initial point procedure as other vehicles but replacement for equipment is based on higher points. Councilmember Callahan moved to approve a sole source purchase for one CASE 580 N Backhoe with Hertz Equipment Rental Corporation, seconded by Councilmember Barlow, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Barlow, Vice Mayor Brister, Councilmember Callahan, Councilmember Coke, Councilmember Sheehy and Councilmember Lin 9. CURRENT EVENTS There were no Council committee reports. 10. CALL TO THE PUBLIC There were no requests to address the Council. 11.
