PUBLIC HEARINGS Lake Havasu City Page 2 Printed on 4/11/2018 City Council Minutes - Final March 27, 2018 8.1 ID 18-1545 Adopt Resolution No. 18-3208 Proposing a $5,000,000 Permanent Adjustment to the 1979-80 Base Expenditure Limitation of Lake Havasu City (Jess Knudson) Mr. Knudson stated that discussions between the City Council and City staff regarding the Expenditure Limitation (EL) have been ongoing for a number of years; however, this is the Council’s first formal action in terms of the Permanent Base Adjustment and making a determination about the next steps in terms of an August 28, 2018, election. Mr. Knudson outlined the following in his presentation: What is a Permanent Base Adjustment? • City cannot spend more per year than the base amount (with adjustments) that was created in 1980. • Voters decide if the City should adjust its base limit. • 11 out of 91 Cities and Towns in Arizona have already addressed the issue (85%) through either a Permanent Base Adjustment or Home Rule election. • Cities and Towns can issue debt to circumvent restriction (not always fiscally responsible). • It is not a tax increase or decrease. Mr. Knudson displayed pictures of Lake Havasu City when it was first incorporated, in 1979, compared to today, 2018. He said a lot of things have changed in Lake Havasu City since this law was put in place and our base limit was first decided by the State of Arizona. Major Changes in Last 40 Years • Many new City services and facilities: o 15 parks (Rotary Park, SARA Park, Cypress Park, etc.) o Aquatic Center o Sewer infrastructure o Water treatment plants (manganese problems) o Paved roads and stoplights o Animal control o Jail o Protecting water quality and supply and managing existing threats of the Lower Colorado River Election Details • The Permanent Base Adjustment Election is on Tuesday, August 28, 2018. o A YES vote allows the City to adjust its base limit. Mr. Knudson added that a no vote would result in cuts to City services and programs, and said projects the City has planned would be postponed to a later date. He added that a no vote would restrict the amount of resources used to provide City services, but would not restrict the amount of revenues that the City would collect. Mr. Knudson said in 1979 the city’s population was 15,925, compared to 53,796 today. He added that the population figures do not include the seasonal residents, which add 10,000 to 20,000 residents annually, or the tourists that visit throughout the year. Mr. Knudson said citizens can find more information on the Permanent Base Adjustment, Prop 409, on the City’s website at www.lhcaz.gov/prop409. Mayor Nexsen opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to adopt Resolution No. 18-3208 proposing a $5,000,000 permanent adjustment to the 1979-1980 Base Expenditure Limitation for Lake Havasu City be submitted to the voters of Lake Havasu City, seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Coke, Councilmember Groat, Councilmember Lane, Councilmember Lin, Councilmember McCoy and Vice Mayor Sheehy 8.2 ID 18-1504 Adopt Resolution No. 18-3210 Ordering and Calling a Primary Election to be Held on Tuesday, August 28, 2018, and, If Necessary, a General Election to be Held on Tuesday, November 6, 2018, to Nominate Candidates for Mayor and Councilmember Positions and to Propose a Permanent Base Adjustment to the 1979-1980 Base Expenditure Limitation for Lake Havasu City; and Providing for and Giving Notice of Such Elections and the Deadline for Voter Registration; and the Place and Last Date for Candidates to File Nomination Papers (Kelly Williams) Ms. Williams advised that the resolution before the Council designates Tuesday, August 28, 2018, as the date for holding the Primary Election in Lake Havasu City for the purpose of nominating candidates for one mayor and three councilmember positions, and to propose a permanent base adjustment to the 1979-1980 Base Expenditure Limitation for Lake Havasu City. Ms. Williams said Lake Havasu City will also hold its General Election on Tuesday, November 6, 2018. She added that any candidates receiving a majority of all votes cast at the Primary Election will be declared elected without running in the General Election. She further stated that candidates seeking office for mayor or councilmember may obtain nomination petitions and other materials at the City Clerk’s Office, and must file nomination papers and other required forms by the deadline of 5:00 p.m. on Wednesday, May 30, 2018, in order for their names to appear on the Primary Election ballot. Mayor Nexsen opened the public hearing. There being no comments, he closed the public hearing. Councilmember McCoy moved to adopt Resolution No. 18-3210 ordering and calling a Primary Election to be held on Tuesday, August 28, 2018, and, if necessary, a General Election to be held on Tuesday, November 6, 2018, to nominate candidates for Mayor and Councilmember positions and to propose a permanent base adjustment to the 1979-1980 Base Expenditure Limitation for Lake Havasu City; and providing for and giving notice of such elections and the deadline for voter registration; and the place and last date for candidates to file nomination petitions, seconded by Councilmember Lane, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Coke, Councilmember Groat, Councilmember Lane, Councilmember Lin, Councilmember McCoy and Vice Mayor Sheehy 8.3 ID 18-1559 Introduce Ordinance No. 18-1196 Amending Lake Havasu City Code Section 14.05.01, Reviewers and Decision-Making Bodies, Regarding Term Limits for Board of Adjustment and Planning and Zoning Commission Members (Kelly Garry) City Attorney Kelly Garry advised that this item is to introduce a proposed change to the City Code to remove the term limits for the Planning and Zoning Commission and the Board of Adjustment. She said over time the City has removed the term limits for all other boards and commissions. She added that there were discussions while amending the Development Code regarding removing the term limits for these two meeting bodies; however, it was overlooked. She said staff is requesting that these term limits also be removed, mainly because the City has a hard time finding volunteers for its boards and commissions, and would like to retain members who are willing and able to serve for as long as possible. Mayor Nexsen opened the public hearing. There being no comments, he closed the public hearing. Councilmember Coke moved to introduce Ordinance No. 18-1196 amending Lake Havasu City Code Section 14.05.01, Reviewers and Decision-making Bodies, Lake Havasu City Page 5 Printed on 4/11/2018 City Council Minutes - Final March 27, 2018 regarding term limits for Board of Adjustment and Planning and Zoning Commission members, seconded by Councilmember McCoy, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Coke, Councilmember Groat, Councilmember Lane, Councilmember Lin, Councilmember McCoy and Vice Mayor Sheehy 8.4 ID 18-1565 Introduce Ordinance No. 18-1197 Amending Lake Havasu City Code 2.60, Personnel System, to Remove Section 2.60.100, Fingerprinting (Shirlee Palbicki) Human Resources/Risk Manager Shirlee Palbicki advised that the item before the Council is to introduce an amendment to the City Code which currently requires that the City run background fingerprint checks through the Department of Public Safety (DPS). Ms. Palbicki explained that in Fiscal Year 2016-17 the City implemented a new online background check system for its volunteers. She said the online system proved to be very successful as the City was able to receive results within 12 to 48 hours, versus six to seven weeks with DPS. She said the City extended the online system to all current and contracted employees. Ms. Palbicki said overall it is a more efficient and streamlined process, and added that the online system is also the preferred vendor of the City’s applicant tracking system (NeoGov). Councilmember Lane asked if there was a cost difference, to which Ms. Palbicki said the costs would be about the same due to a reduction in staff time and processing paperwork. Councilmember Lane asked if there was any difference in the quality of the background check, to which Ms. Palbicki replied no. She added that the City ran parallels, which resulted in the same information. Mayor Nexsen opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to introduce Ordinance No. 18-1197 Amending Lake Havasu City Code 2.60, Personnel System, to remove section 2.60.100, Fingerprinting, seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Nexsen, Councilmember Coke, Councilmember Groat, Councilmember Lane, Councilmember Lin, Councilmember McCoy and Vice Mayor Sheehy 9. CURRENT EVENTS Mayor Nexsen reported on House Bill 2333 regarding home-based businesses.
