She added that applications are available on the City’s website at www.lhcaz.gov. 6.2 ID 20-2330 City Manager’s Report (Jess Knudson) City Manager Jess Knudson said while this is not the ideal council meeting, he is grateful for the means to communicate openly and timely while maintaining essential City services and fiscal accountability during the COVID-19 response. Mr. Knudson read the following message to the City Council: “I would like to recognize and thank all the City employees for their professionalism and dedication during this difficult time while protecting our residents and the community. To the public safety professionals who are putting their lives at risk when responding to a call of help from a resident, to the dedicated Public Works staff who work tirelessly to ensure the water flows, the sewer is properly managed, and the roads are safe, to the Parks and Recreation employees who are ensuring that the parks are maintained and sanitized routinely, and to the countless staff in Administrative Services, Information Technology (IT), Human Resources (HR), City Attorney, Development Services, Municipal Airport, City Clerk’s Office, City Manager’s Office, Municipal Courts, and many others that provide our residents with services and protection in these trying times. I thank you, our City Council thanks you, and our residents thank you. We are all making sacrifices together, and together we will get through this. The last few weeks have been a whirlwind. We have had to ask non-essential businesses to do the right thing and close their doors, asking tourists who want to come for the weekend to stay out of Havasu and suspend their travel plans. We all need to do the right thing to protect the health and safety of our residents above all else. To our community members and business owners you are reminded that this is a rapidly changing and unprecedented situation and we are working around the clock making decisions to protect life and property in Lake Havasu City. We are thankful to our community members and business owners for their understanding and flexibility during this pandemic. The City took many proactive actions to slow the spread of the virus, and we are working with the Mohave County Department of Public Health and Governor Doug Ducey’s Office to advocate for the actions needed that are out of our control. We created a page on the City’s website related to the COVID-19 pandemic, lhcaz.gov/covid-19. Since March 19, 2020, Governor Ducey has issued 24 Executive Orders, including three today, all related to the COVID-19 pandemic. His first set of directives were the closure of all bars, movie theaters, gyms and on-site dining at restaurants for counties with a positive COVID-19 result. As you know, the first positive case reported in Mohave County was in Lake Havasu City on March 24. His Executive Orders identified essential and non-essential businesses and services and restricted cities Lake Havasu City Page 3 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 like Lake Havasu City from wavering from these directives. Language taken from the Executive Order 2020-18 reads: “no county, city or town may make or issue any order, rule or regulations that conflicts with the policy, directives or intent of this Executive Order.” Essential businesses as defined by Governor Ducey in this same Executive Order 2020-12 are businesses that provide the following products or services, including: hotels and motels to the extent used for lodging, including RV Parks, restaurants providing delivery or carryout food services, daycare centers providing care for individuals with children serving in any essential services categories, healthcare and public health operations, businesses that sell groceries, medicine or pet supplies, businesses that manufacture, produce, process and cultivate food, beverage and agricultural products, outdoor recreation activities including golf courses, charitable and social services, media, gas stations, financial institutions, hardware and supply stores, critical trades such as builders and contractors, shipping and delivery services, laundry services, businesses that provide supplies to work from home, transportation including airlines, taxis, and vehicle rental services, and funeral services. The City receives many questions about essential and non-essential businesses, including why we do not shut down specific businesses, these businesses and operations described are specifically protected by Governor Doug Ducey through Executive Order, and counties, cities and towns are expressly prohibited from contradicting his executive orders. As you know, this pandemic has been and continues to be a fluid situation and the City is following the guidance of our national, state, and local public health authorities in the response to COVID-19. We rely on the Mohave County Department of Public Health who has made efforts with the hospitals, healthcare providers, cities, public safety departments, fire districts, and the county with the responsibility to monitor and report testing, provide direction and information regarding the impacts of COVID-19, assist with the procurement of Personal Protective Equipment (PPE), and make the regional decisions necessary to keep us safe and healthy. Their website contains information on the data describing the number of tests performed, including negative and pending results, confirmed cases by city area, and information about age group and gender. The Mohave County Director of Public Health, Denise Burley, will provide an update to Council and we are grateful for her leadership. The City relies on the Arizona Department of Health Services, the Governor’s Office, the Arizona State Parks Department, and the Arizona State Land Department, among other state agencies for information, direction, and distribution of funds and medical equipment needed to keep our residents safe during this pandemic. The direction we received from the State of Arizona determines what businesses must close or remain open and is responsible for the operation of the boat launch ramps at Windsor State Park. To be clear, the Governor and Arizona State Parks Department operate the state parks and the boat launch, not the City. The State of Arizona is also the entity and has the authority to restrict, minimize or remain unchanged, the comings and goings of visitors and tourists to our community including the possible closure of State Highway 95 and the Lower Colorado River, which is a federal waterway. Lake Havasu City Page 4 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 In talking about partnerships and regional collaboration, I would like to thank the city leaders in Bullhead City and the City of Kingman including Mayors Tom Brady and Jen Miles, and City Managers Toby Cotter and Ron Foggin for their efforts and collaboration. It is essential that we all work together as a region. Our ability to collaborate with our neighboring cities in Mohave County is invaluable and we greatly appreciate our routine communications. The health and safety of our employees and the community continues to be our top priority. As the number of confirmed COVID-19 cases in Mohave County continues to rise, the City leadership has taken the necessary precautionary efforts to slow the spread of the virus and mitigate its impact in our community. Even before the first Executive Order, issued by Governor Ducey on March 19, our City leadership took proactive measures to protect life and property: • On March 10, 2020 - Mayor Sheehy hosted a meeting with the Tri-City Council mayors and city managers and the Mohave County Department of Public Health Director to review the COVID-19 emergency operation plan. • On March 16, 2020 - City began altering operations including canceling Teen Break, suspending all Spring Break activities and events, closing the Lake Havasu Aquatic Center, closing public tours at the fire stations, and limiting lobby access at the Police Department and Courts. The City added a COVID-19 resource page and Mayor Sheehy, the Fire Chief, and I began discussions with our EMS provider, River Medical. • On March 17, 2020 - Mayor Sheehy joined the daily conference meetings with Arizona Governor’s office to coordinate local relief efforts from the State. • On March 18, 2020 - Mayor Sheehy declared an existence of a local emergency by proclamation and released the announcement by video to the media and to the public. • On March 20, 2020 - Mayor Sheehy urged bars and restaurants to do the right thing and take immediate action based on Governor Ducey’s Executive Order. • On March 21, 2020 - City closed the City Hall lobby to the public. • On March 24, 2020 - City canceled all city events, programs, and activities. Mayor Sheehy, Havasu Regional Medical Center Chief Executive Officer, Mike Patterson, and I released a video to the public discussing COVID-19. Mayor Sheehy appointed Vice Mayor David Lane to lead the Lake Havasu City Resource Alliance with River Cities United Way, Havasu Community Health Foundation, Lake Havasu Area Chamber of Commerce, and the Better Business Bureau of Arizona as a means to connect the community in need through the COVID-19 crisis. The first positive result for COVID-19 was identified in Lake Havasu City and in Mohave County. • On March 25, 2020 - Mayor Sheehy announced that Governor Ducey’s Executive Order 2020-09 suspended services in all bars, gyms, fitness centers, Lake Havasu City Page 5 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 theaters, and dine-in services in restaurants. The Police Department suspended all in-person lobby transactions for dog licensing and renewals. • On March 30, 2020 - City suspended mooring of boats on the shores of the Bridgewater Channel and London Bridge Beach Park. • On March 31, 2020 - City closed the Tinnell Memorial Skate Park, bocce ball, horseshoe, basketball, and volleyball courts; and, canceled group activities at park ramadas. Mayor Sheehy released a COVID-19 City video with updates and questions and answers to the media and public. • On April 3, 2020 - Based on additional guidance on essential services from Governor Ducey’s office, Mayor Sheehy urged visitors to stay home, which read: “Lake Havasu City has always been a special place for visitors, but we ask that you stay home to protect the safety of our citizens, and you, during the COVID-19 pandemic. We look forward to inviting you back when the health and safety of our citizens is not at risk. Stay home, stay healthy, and stay connected, and we will see you soon.” Public access to restrooms, playground equipment, pickleball courts, and dog parks were closed. • On April 4, 2020 - Mayor Sheehy announced Governor Ducey’s Executive Order 2020-18 and urged all non-essential businesses to suspend operations. • On April 7, 2020 - Mayor Sheehy hosted a Tele-Town Hall with Senator Martha McSally’s office to discuss business relief opportunities to assist our small businesses in Mohave and La Paz counties. Mayor Sheehy signed on with 11 other Arizona Mayors urging Governor Ducey to send the message that now is not the time for out-of-state travelers to come to Lake Havasu City and to Arizona. The City released a second COVID-19 video with updates and questions and answers to the media and public. Under Mayor Sheehy and the Council’s leadership, the City took immediate action to combat the spread of COVID-19 in Lake Havasu City. The City will continue to monitor, evaluate, and analyze information regarding this pandemic and communicate relevant information to the Council and the community as quickly as possible. The City trusts the leadership of Mayor Sheehy and the Council and we trust our community to act responsibly during this time and limit community movement to the extent possible, as we continue to combat the spread of the coronavirus in the community. I am amazed at the generosity and compassion of our residents, and the countless times people in our community are helping others. The fear surrounding the COVID-19 pandemic can bring out the worst in people, but it can also provide us with opportunities to help those that surround us, such as donations to social organizations, offering supplies to neighbors and strangers, and just sending good thoughts to our friends, family and neighbors is critical in these times. People helping people is how we are going to get through this mess.” Mr. Knudson reported on the following: Lake Havasu City Page 6 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 • Welcomed new Lake Havasu City Fire Chief Peter Pilafas. He said Chief Pilafas started on April 13, 2020, and has 24 years of experience in the fire service most recently serving as the Deputy Fire Chief for the Village of Oak Park, Illinois, since 2015. He also served as Adjunct Faculty, at the College of DuPage, in the Fire Science Program teaching fire prevention, firefighter safety and survival, and building construction courses. • Thanked Interim Fire Chief Paul Adams for his efforts, leadership, and expertise over the last few months while the search for the permanent fire chief was underway. He said under Chief Adams’ leadership the City protected the men and women in the Fire Department, made early decisions to procure PPE, and put the City in the best possible position to protect the community. • Congratulated Human Resources/Risk Manager Shawn Marie Irula for earning a Bachelor of Science Degree in Business Human Resource Management. • Congratulated the Administrative Services Department for earning the Achievement for Excellence in Financial Reporting from the Government Finance Officers Association for the Comprehensive Annual Financial Report. • Update on the City’s pavement preservation efforts. • Update on the Census 2020. 6.3 ID 20-2345 Mohave County Department of Public Health Update Regarding COVID-19 (Denise Burley, Director of Public Health) Mohave County Department Director of Public Health Denise Burley thanked the Council for the invitation to give an update on COVID-19 in Mohave County. She said their website identifies 45 total cases in Mohave County; however, there were three new cases reported today in Kingman, for a total now of 48 cases: four in Bullhead City, 17 in Lake Havasu City, and 27 in Kingman. One of the reasons for the high numbers in some of the communities is a result of testing, which is not a poor reflection on the hospitals but more of the testing capacity and availability in those hospitals. Ms. Burley discussed the new Arizona Department of Health Services (ADHS) website which breaks down the case information by zip code; however, she cautioned the public in putting too much weight on those numbers due to the limited testing. She explained the discrepancies between the ADHS and Mohave County Department of Public Health websites. She said the numbers reported on Mohave County’s website are in “real time” and are updated throughout the day with no cutoff time. As they receive cases they follow an internal process before the case is reported which reflects a lag time from when they get the case information and when it is updated on the website. Ms. Burley said the only way to resolve the discrepancy between the two websites is to link their site to the ADHS, but that would not give “real time” information on their site. She said there is also a discrepancy in the testing numbers as Mohave County collects information from the major health providers in the county, those being: Western Arizona Regional Medical Center (WARMC), Valley View Lake Havasu City Page 7 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 Medical Center (VVMC), Havasu Regional Medical Center (HRMC), Kingman Regional Medical Center (KRMC), Peach Springs Clinic (PSC), Fort Mohave Indian Health (FMIH), and Creek Valley Health Clinic (CVHC); however, there are a number of private health providers that also do testing that do not report to Mohave County, but do provide that information to the ADHS for their numbers. Councilmember Groat asked about antibody testing, to which Ms. Burley said there has been a lot of discussion about serology testing to determine whether a person has had the virus, that are asymptomatic, and do not show any symptoms and recover. There has also been a lot of discussion about rollout when that testing becomes available, FDA approval, and whether it will be under an emergency order or if all of us will be engaged in that activity. Councilmember Groat asked about amplifying testing, contact tracing, and their plan moving forward, to which Ms. Burley said testing is number one. She said the more people tested, the more information they have available. She said for each new case in Mohave County, they reach out to the individual to identify their close contacts and guide them on steps to take to ensure they are not infecting other people and to stop the spread. Ms. Burley stated that Mohave County received their Personal Protective Equipment (PPE) from the national stockpile and distributed to healthcare facilities, first responders, and long-term care facilities. She said Mohave County continues to procure PPE supplies but have also asked community partners to do the same. She added that Mohave County worked with KRMC, VVMC, KRMC, and HRMC to submit a bulk order of a half million in product. She said this is a commitment on their part because the supplies belong in the community, which is where there is the greatest need and where there continues to be a shortage. Councilmember Dolan said the numbers at the hospitals are down and asked if Mohave County receives updates on the number of people tested at the hospitals, to which Ms. Burley said the capacity at the hospitals is down and it is a preparation stage for them so they can prepare for a surge if needed. She said flattening the curve and reducing the number of people hospitalized and in ICU are their major goals. She added that the hospitals report a census count daily to ADHS including the number of ventilators to see if there are any increases. Councilmember Dolan asked if the number of cases reported by Mohave County reflects patients who are hospitalized and self-quarantined, to which Ms. Burley replied yes and noted that there is low number of cases that are hospitalized. Ms. Burley added that approximately 70 to 75 percent of the cases self-isolate and recover at home. Lake Havasu City Page 8 Printed on 4/29/2020 City Council Minutes - Final April 14, 2020 Councilmember McCoy thanked Ms. Burley and the Mohave County Department of Public Health for their hard work and the progress they are making. Mayor Sheehy asked Ms. Burley if she could explain the role of the Mohave County Department of Public Health and how they are the lead agency in the pandemic, to which Ms. Burley stated that public health is one piece of a large local health system and they rely on community partners such as first responders, local leadership, social service agencies, and clinics to work together to be successful fighting this virus and ensure that it does not cause harm to our community. Ms. Burley explained that the Mohave County Department of Public Health facilitates and takes the lead on contact tracing, following up on investigations, and ensuring that people have information but they also rely on partners to work with them and make the community successful as a whole. Mayor Sheehy thanked Ms. Burley for sharing this information and for their Department’s leadership and partnership during this pandemic. 7. PUBLIC HEARINGS 7.1 ID 20-2320 Series #10 Beer and Wine Store Liquor License, Pizza Hut #29615, 2960 Kiowa Boulevard North/Morse (Kelly Williams) Ms. Williams advised that Ms. Theresa June Morse has applied for a Series #10 Beer and Wine Store Liquor License for Pizza Hut #29615 located at 2960 Kiowa Boulevard North. Ms. Williams noted that all posting requirements have been met, all fees have been paid, and no objections were received. She added that the location is properly zoned for a beer and wine store liquor license. Mayor Sheehy opened the public hearing. Ms. Williams noted that no public comments were received. (Greg Froslie) Mr. Froslie stated that this item is part of the City’s ongoing efforts to update the Trojan UV3000+ disinfection system at the Mulberry Treatment Island Treatment Plants. He said Council recently approved the purchase of new wiper systems to clean the UV bulbs and this item is to purchase the system controllers to replace older equipment that is obsolete and difficult to maintain. He said funds are budgeted and available in the Fiscal Year 2019-20 budget, and noted that this is a sole source purchase as Trojan is the proprietary supplier of these parts. Councilmember Groat asked about the UV spectrum and controller for the UV equipment, to which Mr. Froslie said this item is to purchase the controller systems that operate the overall Trojan disinfection system and the City is not purchasing any new UV bulbs. Mr. Froslie added that last week he sent all the specifications for the UV bulbs used in the water and wastewater systems over to the Fire Department for their evaluation to see if they could be used as part of a disinfection room. Mayor Sheehy opened the public hearing. Ms. Williams noted that no public comments were received. Mayor Sheehy closed the public hearing. CURRENT EVENTS Mayor Sheehy announced that the City Council and Planning and Zoning Commission will continue to hold regularly scheduled meetings through technological means. He said the Public Safety Personnel Retirement System Local Police and Fire Boards will also meet as needed through technological means, and the Airport Advisory Board and Parks and Recreation Advisory Board meetings are canceled at this time.
