CALL TO ORDER Mayor Sheehy called the meeting to order at 4:45 p.m. 2. PLEDGE OF ALLEGIANCE The Mayor led in the pledge of Allegiance. 3. ROLL CALL Present: 7- Mayor Cal Sheehy, Vice Mayor Jeni Coke, Councilmember Nancy Campbell, Councilmember Jim Dolan, Councilmember David Lane, Councilmember Michele Lin and Councilmember Cameron Moses 4. VOTE TO ADJOURN TO EXECUTIVE SESSION EXECUTIVE SESSION PURSUANT TO A.R.S. § 38-41.03(A): 1.) Discussion or Consultations with the Attorneys of the Public Body in Order to Consider its Position and Instruct its Attorneys on the Public Body’s Position Regarding Contracts that are the Subject of Negotiations, in Pending or Contemplated Litigation or in Settlement Discussions Conducted in Order to Avoid or Resolve Litigation (A.R.S. § 38- 431(A)(4)); and Discussion and Consultation for Legal Advise with Attorneys for the Public Body (A.R.S. § 38-431(A)(3)). 1.1) Discussion and Possible Action, if Necessary, to Comply with Arizona Open Meeting Law Following the Executive Session Regarding Discussion or Consultation for Legal Advice with the City Attorney Regarding the Water and Wastewater Rate Study Any records or documents distributed to the City Council or any conversations occurring during executive session shall be kept confidential. Legal action involving a final vote or decision shall not be taken at an executive session. Mayor Sheehy advised that this item was brought forward by Councilmembers Campbell and Lin for discussion. Lake Havasu City Page 1 Printed on 1/26/2022 City Council Minutes - Final December 14, 2021 Councilmember Dolan said with little information he is confused as to why the City Council is going into executive session. He said if the City Council has an issue it should be discussed in open meeting. Mayor Sheehy said this particular request is for legal advice regarding the water and wastewater study. Councilmember Dolan asked if the City Council could receive legal advice during a public meeting, to which City Attorney Kelly Garry replied yes. She said the City Council can receive legal advice within a public meeting; however, the public would be privy to that; therefore, if it is something that is sensitive or potentially looking at a legal avenue then it may not be something that the City Council wants to discuss publicly. Councilmember Campbell moved to adjourn to executive session, seconded by Councilmember Lin, and carried by the following vote: Aye: 5 - Mayor Sheehy, Vice Mayor Coke, Councilmember Campbell, Councilmember Lin and Councilmember Moses Nay: 2 - Councilmember Dolan and Councilmember Lane 5. ADJOURN TO EXECUTIVE SESSION The City Council adjourned to executive session at 4:48 p.m. 6. RECONVENE TO SPECIAL MEETING The City Council reconvened to special meeting at 5:53 p.m. 7. PUBLIC HEARING 7.1 ID 21-3098 Discussion and Possible Action, if Necessary, to Comply with Arizona Open Meeting Law Following the Executive Session Regarding Discussion or Consultation for Legal Advice with the City Attorney Regarding the Water and Wastewater Rate Study There were no questions or comments from the City Council. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. 8.
